    After applying for an EB3 visa and having my case in administrative process for more than 6 months, finally this week and after a complaint to the State Department, my documents were returned with a visa denial. I was only verbally informed of the denial. Can I appeal? To which instance? I consider that there has been bad consular work, the staff was not even prepared for an interview under this visa category for not having experience in it.

    The airline has no way to know for certain if somebody was outside of the US for over a year.

    As long as you have a valid green card, airline should allow you boarding unless you have other complications.

    Hello lawyer, do you know if USCIS officially updated this new rule/interpretation already ? Are they applying this new update on new cases already? My son's mother entered the United States legally with a tourist visa and an I-94 form in June 2001, she overstay her visa permit of 6 months and In December 2003, she went to Mexico and returned to the US in March 2004 in the same manner (same visa diferent I-94) and she has remained in the US since then and has been a law-abiding and upstanding individual. My son is a 23 yers old American Citizen by the way. Given these circumstances, I would like to know the steps involved in petitioning for her to obtain legal status. My son earns enough money to support her, but the issue of her previous exit and reentry may require a waiver such as I-601 or I-601a due to Unlawful Presence and Inadmissibility I kindly request your guidance and advice on the necessary steps to take in this matter.     I would say BUILLSHIT. That’s Impossible. H4 EAD can only applied for or get approved after 18 months of staying in the US. Even if you leave for just a day, it will not be counted

    What if my H1B is rejected for any reasons ? I'm currently on F1-OPT and it is expiring in July, I've the option to apply for Stem-OPT which will give me 2 more years of EAD , should I apply for this as a backup if my H1B got rejected in the worst case ?

    Hi me and my husband have the green card(valid till 2030), my son is an american citizen(he is a minor). We left the US a month before the pandemic to visit family 4 years ago, I was pregnant at the time. Due to the Pandemic we couldnt fly back when planned I had to give birth out the country, once my son was born he had a medical issue and needed operated on. We now want to return to the US but want to know what our chances are, as we havent returned in 4 years? If I did manage to get in, I am also worried as my youngest son doesnt have a green card, we lost the chance of him automatically being able to get one as we didnt return before his 2nd birthday( hes 3 now). It would be really appreciated if anyone could give me any information, thank you

    I got laid off. I have i-140 approved (EB2) and my current H1B expires on Apr 20th, 2024. However - my former employer filed for a H1B extension on Feb 20th, 2024 and this should take some 1.5 to 2 months to complete. Since i am in hunt for the job market - do i only have time till Apr 20th? Or is my status still active? If yes, what is the duration? I am currently on my 2nd H1B term at this time (6th year) My drivers license expires on Apr 4th 2024, Can I still use my existing I-797 documents for the same?​​
