    No camera is normal for Fed LE, they do not even audio record. So no, that by itself is not evidence of conspiracy. Not defending the Feds, just saying that no recordings is not a "one off." Food for thought. Just saying. Again, it's just conjecture but that's all IV8888 is doing too... So, you're a tac guy looking to serve a warrant. You have intel that he travels armed and evidence strongly suggests he's always armed. So one tactical dude says "take him at work" all businesslike. Then another dude says "yeah, then what if he takes hostages and or we have a shootout in a crowded building?" Oh, tactical team says, "maybe not a good idea." Next dude says, "let's take him on a casual traffic stop." Then next dude says, "what if he doesn't stop? Then we have a pursuit of a probable armed suspect on public roads during rush hour." Oh, then tactical team says "not a great idea either." Then another dude says "let's just serve the search warrant on his house while he's at work and take him later at a safe time and place." Then another dude says "he has a security system and will know the moment we show up even if he's not there...back to armed suspect in a workplace." These kind of discussions happen when we plan missions. The idea is that if one of these ends in a shootout, it's a failed mission. Every time. So...I wasn't there in the meetings or planning and I don't know how they made the decision. Neither do you or Idiot V8888. No, complete investigative results of an OIS (officer involved shooting) usually take several weeks to complete...I know because OIS investigation was my job. So. Not defending Fed LE, I don't like the way they operate, but making up conspiracy theories for clicks is typical Guntuber IdiotV8888.

    Dream on, the last thing any AG or DA would want to do is alienate the police unions which finance their election campaigns. Federal task Force work brings in very good money for state and local LEOs. Lawyers are not going to save us from a rogue and hostile federal government

    Unfortunately, as the ATF is a Federal law enforcement agency, they are not subject to state laws due to the separation and hierarchy of power between the federal and state governments. The federal government and its agency would have to agree to go to a lower court to face state charges. They have complete immunity.

    @@esfowle understood. However, I wonder if they would lose their qualified immunity because of individual actions that could be separated from their official duties as federal agents? If their official duties are in conflict with state law, I can agree with that legal argument. My point is that once, they commit state crimes even while being employed and working in the capacity of federal law-enforcement, they may jeopardize that privilege.

    They had a search warrant, not an arrest warrant. What is stupid is doing predawn no knock warrant instead of daylight. No knock warrants are inherently dangerous and should only be used for the most heinous situations.

    The warrant did not support no-knock, but it was exercized as such. To my mind that basic felony elevates the event to murder 1 even if it wasn't intended as an execution.

    This ATF raid wasn’t Botched or Failed, it accomplished exactly what they wanted. Citizens intimidation is the key goal. What they don’t understand is how much actions like this angers some of us that only wish for the government to leave us alone freely to enjoy our freedoms.

    @@Williamswartz the Bill of Rights are NOT privileges. The Constitution is for the people not the government. It limits the government not the people. I don’t understand how ignorant people can even support their rights being violated every day for a fantasy of security. I feel both major parties are bad and with the one party that absolutely hates the fact that we the people have rights. I will never vote for any democrat ever for what they have proven themselves to be. The second amendment is the right that protects all other rights and freedoms.

    Violence intended to induce fear in population to further political goals is the very definition of terrorism. Terrorism under color of authority absolutely should be handled with capital punishment. Question is how high we go in prosecuting this crime - does it stop with Dettlebach or do we off his boss as well? These governmental acts certainly justify American recreation of the French Revolution.

    There are generally three types of law enforcement: Good people who are good at the job, good people who are bad at the job and criminals with a badge. That said, the culture is such that good people who are good at the job are afraid to call out the other two kinds because they would most certainly be retaliated against.

    Agreed! Or even Knock on the door, and hand them the warrant, and detain them in a cop car for house inspection... This was murder. It's not the first time. No-Knock Warrants are just not needed for most situations.

    Why would they cover the Ring camera? No good reason. They are going in anyway. The ATF thinks they own our guns and can tell us what to do with them. My gun did not come from the ATF and I owned it before they were born.

    The ring camera covering i understand. Even tho i hate the ATF. Tactically speaking covering the ring camera is a good option to give the opposition one less area to see you from especially if it’s a barricaded suspect. Also how many people are encroaching. Again i do not agree with the ATF at all. They should be abolished. They have no merit under the constitution to enact all the crap laws that they do. Really we need to abolish all agencies infringing on our constitutional god given rights.

    There was no reason they couldn't have walked up to him as he was leaving for work and detained him as they served the warrant. He had no record and this is a classic case of the rogue agency just wanting to play with their cool toys! No knock warrants should be the exception and not the rule!

    Federal agents should be required to make it very clear who is at the door and give citizens the opportunity to communicate with them to make it very clear that they have a warrant and can enter. Give the citizen a chance to cooperate. It should be unlawful to put agents and citizens at risk by making homeowner think he is being robbed at gun point .

    There's no reason government should be pulling raids. They can't wait till the target comes out in public.     Mrs. Malinowski deserves a $500 Million lawsuit settlement and each officer involved in this raid should stand trial for Bryan Malinowski's Murder. The 6:01AM assault guaranteed the Mr. Malinowski would be home, in bed, asleep. The covering of the doorbell camera insured that no one could see who was assaulting the house, the door was busted down, the electricity to the home was cut off so Mr. Malinowski could not see who the intruders were, several heavily armed intruders swarmed into Mr. Malinowski's home unannounced. Any reasonable thinking person in the same circumstances would immediately come to the conclusion that there was an armed invasion of their home but a gang of criminals. Mr. Malinowski did what most of us would do in the same circumstances, he fired at their feet in order to stop the invasion of his home. There was no need for Mr. Malinowski to be present while his home was searched in accordance with the search warrant. I was a cop 1978-2006, I worked Narcotics 1983-1985 and, in my opinion, this ATF raid under the guise of serving a search warrant was either horribly bungled or a deliberate execution of a man with no criminal record.

    The ATF policy doesn't require them to wear body cameras, that is the problem. They weren't wearing any because it would come back on them. This way they can just say they were following policy and they didn't have body cameras on. There is no justifiable reason that law enforcement should be using no-knock raids, it's a bad idea tactically when you are trying to arrest someone and/or collect evidence. The safe thing would to pull him over a quarter mile from home then take him back in custody to the home and search it.

    Having done some playing with Body cams, I am not sure they provide much in the way of usable footage in a dark environment. Yes, some do have tiny IR LEDs, but they are not flood lights and the ones I have used under dark conditions acutaly are of very little value for events more than 3 feet in front of the camera. Even adding more Gamma to the resulting image usually does not greatly extend the range of their effectiveness. So how dark it was in the hosue at the moment of confrontation can be important regarding what the camea shows. Someone may also have had a weapons cam and if we are talking about a camera inside a thermal scope, those may be more useful, but only if someone asks for any weapons cam footage too. Having been involved in shootings as a FLEO and also executed or assisted in a few State and Federal Search Warrants I know that all usage of deadly force by a FLEO regardless of any local or state investigation is also routinely investigated by the FBI, and if the head of an agency (or other person of importance) so requests is also subject to an investigation by the DoJ's Civil Rights Division. Civil Rights Division investigations sometimes result in findings totally contrary to the other investigations. This incident is troubling. The ATF team had no arrest warrant, if there had been an indictment or True Bill, it's existence has not yet been publicly revealed, Subject was not known to be a felon and was a gainfully employed family man. There were some strategic and tactical critical decisions made before and during the execution of the Search Warrant which seem to be not wisely chosen and those events may result in results the participants might not enjoy. Not yet discussed in any video I have seen is the Search Warrant Affidavit that requested a 'no knock' during hours of darkness (or between 10PM and 6AM) Search Warrant. As every non-prohibited person has a right to self defense, the mere probability that a home dweller lawfully has a firearm is not usually grounds all by itself to receive and execute a potentially very violent 'no knock' warrant during hours of darkness on a residence. When it is done it usually involves to prevent the destruction of exigence (i.e., flush drugs down a toilet or ignite betting slips written on flash paper, etc.) or a history of known violence and a reasonable expectation of armed resistance based on a past history. I am very curious to read what it was in the Search Warrant Affidavit that justified a 'no knock' entry. I also think someone higher than any of us should be asking the Magistrate or Judge who signed the Search Warrant what he or she was told that justified in their mind such an approval for the raid.

    I heard from another video a few weeks ago that ATF wasn't wearing any body cams. Allegedly because they either didn't have time for it or because their rules allowed them to not wear them.

    There was no reason to kick the guy's door in during the wee hours of the morning. They could have had local LE contact/detain him at work while AFT served the search warrant at his house, there was no exigency to the case - AFT CREATED the exigency with their over-the-top overreaction to a low grade felony. That is why this man is dead.
