So they basically denied him his legal right to counsel when he asked for it & instead kept questioning him over & over knowing he'd get sicker & more desperate with each hour. Pretty cheap & nasty tactics. At 12hrs he would've been a mess, but he stuck it out & stuck it to 'em. Hooray for Jeff!

It’s really stupid, but if the investigators feel like they can make a case that the person did not clearly insist on counsel then they will continue. I think I heard it in one of my forensic psych classes, but unless that person states “I will not continue without counsel” and further insists on “I am enacting my right to counsel” then they will often be ignored.

It's always funny that the right he used is the same right most people never use when given the chance. They think talking to the interrogators will actually help them when in reality it won't do anything but help them cast reasonable doubt on them. Unless it is absolutely clean and clear 100% fact that it's not you and there's no discernable evidence to say it could be you then you shouldn't/ don't need to speak with them without a lawyer. @@jeng6786 They're not supposed to but police often ignore it. They often ignore your rights to manipulate you. Even if you're innocent, do not speak with them without a lawyer and every time they try and talk to you, only say that you won't answer anything without a lawyer and you're invoking your right to a lawyer right now. There's a lot of people in jail who were convicted of a crime they didn't do. Even people who confessed to something they didn't do because the cops manipulated them and mentally wore them down to the point they gave in just to make the mental torture stop. That's what it is, really. Especially since this guy was going through withdrawals. He asked for methadone, which helps to ease the symptoms. I'm prescribed pain meds for medical issues and when there was an issue with the pharmacy and I couldn't get my meds for a day or two, it was actual hell. Physical and mental hell. The cops know this and didn't give him medication and ignored his right to counsel so that they could use the hell he was already going through to help them manipulate him into breaking down and confessing because they had no real evidence he did it. What they had was circumstantial at best which you cannot get a conviction on.

This is the best example of never trying to talk your way out of something you did or didn't do. They're not your friend, period. Always ask for a lawyer. If they say they have evidence it's almost always a lie if they still want to talk to you and "get your side of the story" or to "find out what happened". Request a lawyer and refuse to talk to them because anything and everything you say will definitely be used and held against you in a court of law.

Jeff is one of the best examples of how an innocent person behaves when accused of a crime they didn’t commit. They don’t ramble, evade, or soften language; they make a strong, positive denial and no matter what the detective tries to talk about, they focus on the impossibility of evidence because they’re innocent. Additionally, when recalling what he did the prior night, he gave an unrehearsed, true account of where he was and what happened in a direct and emphatic manner, with very brief hesitations to simply access the information, instead of long pauses for the purpose of invention. Jeff's verbal tense use was consistent, and he repeated his account with no discrepancies, congruous nonverbal behaviour and downward vocal intonation with a considerable volume. The primary reactions from an innocent person wrongfully accused of a crime are anger, an emphatic denial and consistent negative emotion, with their sole focus on how the police have it wrong. They offer no tangents, no deflection, and have no problem stating the crime they didn’t commit “armed robbery”; guilty people generally soften the language to “hurt” instead of murder or “take” instead of steal, for example. Thus, Jeff not only played this beautifully, but was also truthful - not the perpetrator of the crime he was being questioned about - and was able to work through it during withdrawal. As a result, he was released, got clean and has a youtube channel that’s easy to find.

I mean I'd say an initial interrogation is safe to talk but when they ask you to come back thats when you stop talking since theres clearly something you don't know about thats on the table which they're going to push to get more out of you on, typically in a round about fashion as they need to make you feel comfortable or build trust to get your guard down before pushing their real agenda. Better to play it safe since you can be unwittingly damning yourself even if you didn't do it, because you lack the full picture never let your own assurance of your own innocence blind you into talking too much. For all you know someone has you pinned as the scapegoat to throw under the bus.

Pretty sure we root for the guy just because he's clearly wise to the officer's tactics and so he reflects our own ego after watching all these JCS vids, thinking now we're also wise to this kind of stuff. He's also not intimidated by them at all (even outright confrontational), and seems certain they don't have evidence against him, giving the impression that he actually didn't do anything.

From a website: You have the constitutional right to talk to a lawyer before answering questions, whether or not the police tell you about that right. The lawyer’s job is to protect your rights. Once you say that you want to talk to a lawyer, officers should stop asking you questions. If they continue to ask questions, you still have the right to remain silent. If you do not have a lawyer, you may still tell the officer you want to speak to one before answering questions. If you do have a lawyer, keep his or her business card with you. Show it to the officer, and ask to call your lawyer. Remember to get the name, agency and telephone number of any law enforcement officer who stops or visits you, and give that information to your lawyer.

I don't understand why the police keep wanting them to talk without a lawyer. Like. Their rights are there in purpose. They aren't supposed to talk without a lawyer. And yet if someone asks for their rights they get all offended because they don't want a lawyer there apparently, idk I'm confused. What am I missing?

  • @luzy6474

Is pretty simple, the reason why they make him talk without a lawyer its 'cause thats the only way to obtain the information about the robbery (they look for contradictions ) Its not ilegal, law only says that he can call for a lawyer if he want. But that would be inconvenient so they make him wait in order to get answers
