    I'm no lawyer but I'd be interested if the female tyrant with the gang mask even had qualified immunity because she wasn't formally dressing as a police officer, she wasn't identifying as a police officer, she wasn't making lawful orders, she was dressing as a gang member. How can you tell as a member of the public that she wasn't there as a citizen, on free time, still wearing parts of her official uniform? Qualified immunity doesn't apply to their private citizenship. I think qualified immunity should be granted only when there are constitutionally compatible policies and these policies aren't violated. Whoever writes the policies should be held accountable for any constitutional violations of the policy and whoever violates the policies should be held accountable as a private citizen. And the compliance obviously should be investigated by an independent party and not by the city itself.

    @@matfax The Supreme Court have been gutting the constitution for centuries. There should be no qualified immunity, they have abused it from day one. The police should follow the law to the extent the law is within the constitution or face the consequences like everyone else. These cops do not respect the constitution, or the law or your rights they are suppose to enforce, they are a criminal gang with the government franchise on violence and that is all they are. The 2nd amendment is your gun licence, your carry licence and your concealed carry licence. The right to bear (carry) arms "shall not be infringed" it could not be more clear.

    The problem is that in _Turner v. Driver_ the 5th Circuit used its discretion under _Pearson v. Callahan_ (Supreme Court 2009) to bypass the constitutional question (was a constitutional right violated?) and instead only dealt with the qualified immunity question (was the right in question clearly established at the time of the alleged conduct?). Therefore the conduct of Turner and the police relative to Turner’s First Amendment claim cannot be used as precedent for other cases. This is not how clearly establishing cases are supposed to be adjudicated…in that the Court of Appeals used caselaw from other circuits to “clearly establish” a constitutional right….completely devoid of any 1st Amendment analysis of the facts in _Turner._ _Turner_ is a highly problematic citation as to the First Amendment issue.

    I've been saying that for years that cops should not be completely protected from being sued for the criminal behavior. I do think that cops should be protected from people taking them to court just to harass them, but as in this case you can clearly show that a cop and then multiple cops engaged in criminal behavior, not only should you be able to sue the county and the city, but you should be able to go after the cop's personal assets. Cops should know that when they go off on their power trips that trip might just be a very expensive one, meaning they'll be having to pay their victim's vacations for next few decades, or longer. We've been successful in a few locations having cops qualified immunity being removed, but not enough people know about cops not having to worry being held liable for their actions, but there are many different groups trying to get the word out. I thank the Real News Network for helping in this battle, I love good cops, but when you have power hungry thugs who use the badge to victimize their fellow citizens that love turns to hate.

I've known a couple cops that see themselves as going into combat every day. They actually think they're going to combat with the public. And they think that their job is so dangerous that they deserve a special considerations and freebies. Many cities and states offer tuition forgiveness for police officers. So they choose a degree and a career path, get a job, and a taxpayers end up paying for it? And then even while in civilian uniform they're wearing a police t-shirt carrying their gun and thinking they're badass. Meanwhile at a school shooting 300 from behind for 45 minutes, while waiting for a SWAT team, because none of those cops have the balls enough to rush in and save children dying. I guess that's why they earn really good paychecks. And I'm not lying when I say that. And if you try to tell him to do anything, he would pull up his cop card and say just wait till you come through my town. His town? And again he talked about how he goes to combat every day. I fully expect to hear him shooting someone in the back, and him saying," I thought he was going for a gun."

    There is actually. But you have to take them to court. Unfortunately you're complaining to the people that control the system. So their first act is to delay the case in the hope that you will give up. That works in the majority of cases because time is money. While the have the infinite funding by the state, no average individual can sustain waiting for that long since time is moeny especially when lawyers are involved. There is one youtube case that is 5 years old and still counting.

  • @ryanalheim3093

    @@krane15 That's true, what I mean to say is qualified immunity goes too far. If an officer of the law is so bad at their job that they don't even know what the laws are, they are unqualified to enforce it. At the very least they should be pulled off of the streets, seeing that citizens are not subject to officers whims and hunches. And I believe there is supreme court precedent stating exactly that.

  • @krane15

    @krane15

    Жыл бұрын

    @@ryanalheim3093 Indeed it does. These laws are in place, and QI does not apply when the violation is known and intentional. QI was designed to protect cops from frivolous law suits. Not an intentional violation of someone's civil rights. Thing is, none of the means anything if nobody enforces it, and prosecution blindly side with the cops regardless. What most of us fail to consider is the bigger picture: an illegal arrest may be subsequently dropped, but by that time the damage has already been done. You have been given an arrest record and become part of a criminal database with your likeness and finger prints. The record may later show the charges were dropped or dismissed, but how long does that process take? An arrest is IMMEDIATELY RECORDED, but there is no required mandates for any amendments. It becomes your responsibility to monitor since the state no longer cares. What happens to you and your reputation in the mean time? As far as some are concerned, a dropped case simple means you got off on a technicality. What the record doesn't indicate is that the cop violated your civil right, was corrupt or vindictive or incompetent, and that the arrest was illegal to begin with. The state has zero responsibility to restore your reputation or your good name. There is no database for illegal arrests. That's one of the many inherent problems with our criminal justice system. It focuses 90% on the criminal part, and almost no resource towards the restoration of innocence. There is zero incentive for anyone in the system to prove you innocent. Once you're in the "system," you've been criminalized, even when you're 100% innocent. That's the power of a single corrupt cop and a system that blindly follow after him. If you read to the end, thank you. This was the abridged version. 🙂

    This so often happens when a chief of police is ( allegedly ) running an illegal private security business. These illegal businesses use our tax payer equipment, desks, lights, telephones, cop man power and in many cases double bill the city and bill the paying customer that needs the private security services. The cop then pays the button nose chief of police a bit something something.. This is called RACKETEERING. 3 OF the criteria for RACKETEERING is hierarchy, intimidation, and fraud. There is no time off for bad cops. To the public it looks like they are on paid vacation, but mostly the cops work this illegal private security business. The only one fooled here is YOU!!!!!! The Chief of police needs a bad cop to work an illegal private security business. It's a kind of brotherhood. " Hay bro we have something on each other", a mutual agreement. Also, most cops drink vodka to sleep at night. An alcoholic cop may have pulled you over and you would never know. Or could you? The big giveaway is the menacing, belligerent, confrontational, aggressive dangerous grainy VODKA VOICE. When you get pulled over , make as little contact with an alcoholic cop. Like any alcoholic, they are dangerous with a license to carry a gun and kill. They will testilie against you and get away with it. You are dealing with a gang with a badge.. Sometimes , with corrupt judges there are many conflicts of interest, but you will never know. Sink your teeth into this and pass it on....And please, learn some law because obviously, the cops follow protocol and not the Constitution.. Get Constitutional Law for dummies or any book. Cops don't have continuing education. Because of the rampant alcoholism, they should be breathalyzed after every incident and before they can start our tax payer police cars.. Many of these guys are void of empathy and murder people without a second thought. We the People need to enforce the Constitutional Law.

He that believeth on him is not condemned: but he that believeth not is condemned already, because he hath not believed in the name of the only begotten Son of God. I jus wasn't ready and fast enough.. But, when I go on over to my sister's house on Vacation again, I'll be there and ready for the Police, at my sister's side..

    If cops are "professionals", they need to have an individual, professional liability Insurance policy tied directly to them, just as all of us other professionals (doctors, cosmetologists, plumbers, electricians...etc.) are required to have. A bad cop would at some point be uninsurable and unemployable. And then abolish Qualified Immunity.

    Qualified immunity has got to go. This is at the root of the problem. In addition, law enforcement should be required to obtain a bond (paid by them ) to practice their profession. When I say law enforcement, I mean every level of it and not paid by tax dollars. With this in place the “bad” ego-maniacs would weed themselves out. As excessive bonds get paid out the ones causing the problem can’t get bonded or it becomes excessively costly for them to get bonded and therefore can no longer work in that profession.

It needs to be a federal law that all police officers wear body cams in order to perform any kind of legal duty and if not, then nothing they do is legal. only a corrupt police unit would allow their officers to not wear body cams. They've always been this way, its just we're only now learning the ugly truth about cops thanks to phone cameras and the internet. The reason these cops are so brazen, abusive, and more murderous than Blackbeard's pirates is because for generations they've always been this way. Its what they're made to do, only back in the day they'd have a focused target group no one cared to listen to or believed when they cried out to anyone within earshot. They were black people from past generations who had been victimized by targeted enforcement from the start. As for why cops continue being this way is because its perfectly ok, even after the ugly truths about them have been proven left and right hundreds fold with video evidence. Thats because the injustice system doesnt judge the abuses of police as crimes, never has. Its allowed to continue because the only cops that get prosecuted and judged for such evil deeds usually have to make national headlines for atleast three straight weeks and the country has to be on fire with the public outrage to prosecute just one cop for a cold blooded murder, but what about the cops that carried out crimes and murders the press just didnt catch or report on hard enough? The country is just as friendly systemically to their sins towards innocent people as its always been. That hasnt changed yet, and i dont think the country will be standing long enough to see such changes

    They're not ignorant. They are very aware that what they do is completely illegal. There *are* *NO* consequences for them. The behavior is taught to them by their trainers in the academy and during their so called "continual training" on the job. The fact that there is no telling how many hundreds of thousands of hours of footage of law enforcement commiting these crimes exists, and that the only place you will see any of it is on KZread is a crime in itself. There should be a segment of the nightly news dedicated to showing police misconduct. In decades past there would have been if the technology to capture the footage existed at that time.

    If the police want to investigate they shouldn't do it in public. Additionally, obstruction is physical act preventing an officer from doing his/her duties. Standing quietly filming isn't obstruction. Since everything that happened based on the false assumption of the officer everything else is mute or void. A simple explanation of why you're recording may have de-escalated the situation, not always possible in high stress situations though. That's why it's important to always keep a cool composure. Always stand your ground when your rights are being violated. Never let the cowardly thugs intimidate you. Intimidate them with the knowledge of your rights & the law.

    @@lady4real75, Every state has a Judicial Conduct Board, if you're violated anyone can file charges. Judges, cops & attorneys, They investigate if your charges are founded (true), Then they file charges that have to be answered. I had a corrupt judge of 14 1/2 yrs. on the bench, removed for life or face my charges against him & if he tried to testify in his own defense, Because the state already proved all of my charges were true. I could then sue him for violating my civil & constitutional rights, & the abuse of a service connected disabled Veteran. He submitted his resignation. The J.C.B. was so incensed, they told him, we except your resignation under these conditions. If you ever run for judge magistrate in the confines of the state, You will face the charges on the table before you ! The 450 lb. corrupt landwhale was accosting 20 yr. old girls with tickets & sexual favors would make the ticket vanish. During the state investigation they found out they were all embezzling & misappropriation of court funds & Giving themselves loans. The state law was changed, No town or county court could keep court costs & all had to surrender all funds to the state within 24 hrs. of collection. Then the state would redistribute the funds. So, after the corrupt judge resigns, tells his political mouthpiece to say to the public that he resigned for personal reasons & his wife was home dying in bed with cancer. She was dying of cancer when he was accosting babies & violating disabled Veterans. He also endangered my baby girl, by placing her in the custody of an alcoholic drug abuser. I know it's hard to think/act especially in that moment. If they tell you to stop/leave or you're under arrest (for recording) don't physically resist in any way. You have ALL you need to file and win a lawsuit. You HAVE to assume they will and want to hurt you. Also try to keep calm and make declarations. I'm on MY PROPERTY, I live here, she asked me to record, if you touch me it's nonconsensual, I FEAR FOR MY SAFETY GET BACK I'MSCAREDOF YOU GET BACK, (any physical contact you make can then be Self Defense, tell them to DEESCALATE CALM DOWN, remember to state Turner V Driver if you can etc Do an anonymous records request or read their policy on their website etc about recording. Memorize it and state it...it can be very useful if it goes to court. Tell them to call a DA, we give them 24/7/365 access to one. DEMAND a supervisor before they make a mistake and become a liability. But remember the Sgt may be as dumb as stupid as they are...expect it. If you feel threatened...call 911 and report the man/woman grabbing you. Assaulting you. File a CRIMINAL COMPLAINT with the Sheriff dept or a state agency...someone other than that dept. Name the man/woman. Type out a statement that you can just submit and have multiple copies. Good job standing up for yourself. Keep learning and educating yourself and your friends. Have a sit down chat with legislators, city councils, Mayors. Have the Dept Policy on recording. Have a printout of Turner V Driver...read it to them. DEMAND these rogue officers stop assaulting kids...stop violating Rights and Freedoms people died for. Put up a NO Trespassing sign on your property. Even cops can be trespassed. Tell your dad about using IP security cameras. They can have multiple NVR's, so the closet is a good idea...but a hidden 2nd one is easy, just need a single network cable and a power outlet. In the back of a cabinet behind the drawers, in a basement ceiling etc...super easy to hide 1. Leave a 3rd out as a dummy haha. Put them and your cameras on a UPS(battery backup) for power outages etc.
