    I think its important to recognize that the Constitution, particularly the Bill of Rights merely outlines and codifies EXISTING God-Given/Natural human rights. So as much as I respect the Constitution, even if they somehow repealed the 2nd Amendment I would still say the Right to Bear Arms is still an inherent human right that all people are entitled to.

    The more I peeled the onion back on the roots of abortion and one of it's strongest proponents beliefs, Margaret Sanger, the less I cared for the practice. Not even on a religious level, just more of a general morality perspective. Do I have a problem with the law as a Texan? It's a bit ham-fisted and top heavy yet that is government intervention. Every. Single. Time. On a moral level, no. I don't have a problem with it.

    @@thegunpenguin you should always be upset when rights are taken. I don't like abortion, all I ask is not to subsidize it with taxpayers money. The laws have gotten extremely liberal in other parts of the country (NY to be specific). It seems like it's a response, most likely it will be overturned. I wish my state was focusing on other things then abortion. I said don't be grumpy because it's what we've been told( gun owners) for a while. Remember that saying " elections have consequences "

    If abortion stays entirely legal, I think we can perhaps compromise on use of public funds. Is that what I want to see? No. But American stability sprouts from that sort of compromise. I personally want the government to give every American coupons for 6 free abortions, and 6 free suppressors, but I don't always get what I want. So gun folks have been told not to be grumpy? Why shouldn't we be? And yes, elections have consequences. In the above podcast, I discussed that for 35 minutes.

  • @Insectoidoverlords

    Hopefully I can offer another perspective on the abortion laws. A pro-life vote is a pro individual right vote. If you do not defend the rights of a person that has just been conceived the line of what constitutes a person with rights is severely skewed, that's why you have people saying it's okay to have an abortion up to 5 years old, at what point does somebody's constitutional right to life liberty and the pursuit of happiness or property kick in? I do not argue pro-life on the grounds of religion but on the grounds of individual rights and I believe that at conception if your gender, and personal attributes are now decided for the rest of your life then your rights should be protected as well. if you are looking for historical precedent look up blackstone's commentaries on British law. The moment that you are aware that you have a child is when they become a British citizen. And nowadays we can discover if somebody is pregnant almost immediately so at that point their constitutional rights should be protected.

  • @thegunpenguin

    I appreciate your perspective. The problem is that life is not consciousness. And as a society, we absolutely weigh consciousness above life. We do it every day, with the food we eat. Cells are not a living person. A mother is conscious, and has a human life. And if we want to discuss precedent, mothers have been disposing of babies, often legally, for as long as human society has existed. I can cite more examples than can be mentioned in a comment, or video. That said, I say none of this to disrespect your perspective or position.

    @@thegunpenguin I have literally watched a baby try to fight off a doctor in the womb over ultrasound. If that is not consciousness and life I don't know what is? If a person in the womb can recognize a threat and fight that threat for survival I believe that that right should be protected. I am a believer in all life is precious and should be protected. I do not believe in animal cruelty nor do I believe in chopping down rain forests that have been alive for thousands if not millions of years to meet corporate quotas but I also don't necessarily believe that dolphins and palm trees have the right to bear arms or the right of free speech. I believe those are human rights and when a sperm meets an egg that becomes a human being. I do not deal necessarily with consciousness but scientific certainty. Unless you can provide evidence that a human sperm meeting a human egg will turn into a puppy I don't think there's any reason to doubt the inevitable outcome. Thanks for the response. Overall we have to work together to protect our rights.

  • @thegunpenguin

    @thegunpenguin

    How old was the baby? Did it tell you it was fighting to live? Sometimes things don't come across well in text, so I want to express that I mean no disrespect. But I need more information than a gut feeling. As to when a fetus attains consciousness, you have not presented evidence. You have presented a feeling, and an assumption. I hope that comes across the way I intend it to. Gut feelings are very important, but we can't legislate them. But we can measure brain activity, and can use that information to find a compromise point. America is built on compromise, and neither side has any intention of backing down. Regardless of our personal feelings, abortion is a federally-accorded right, and has been for decades. Beyond the precedent that Americans don't relinquish rights once they've been given, there is surely a compromise point. I'll leave that to the doctors. Six months perhaps. The fight really boils down to this: Are human cells human life, or is consciousness necessary? Really, only the latter matters. If not, then many aspects of our way of life are called into questions, or rendered moot. You're still weighing the value of one consciousness higher than another, so your argument also implies that consciousness matters, and is a factor. We need to be careful about making the argument that a collection of human cells is a valid human life that must be protected at all costs. You see the dangers. That could lead to the restriction of other medical procedures, therapies, and medicines, in a hurry. I think we should avoid that road. I really hope this comes across the way I intend it to. I'm always afraid of that, with KZread comments. What would seem like a really good, vigorous discussion in person, can often seem callous or rude online.

    @@thegunpenguin thank you so much for your understanding and your delicacy. the general consensus is that a baby can feel pain at 20 weeks. Depending on your sources some say earlier. Pain and fear are something that can be observed. It does not require vocal cords and the ability of articulate speech to be communicated. It's not a very big stretch of the imagination that when you raise a newspaper to a dog and it tucks its tail between the legs that it is in fear of being hurt. Or if an animal postures in defense it senses some form of threat and is preparing to meet it. In the case of the 18 week old baby it sensed that something was in its environment this was detected by body posture (through ultrasound) and heart rate elevation and rapid movements. These were not opinions or gut feelings they are observable facts. The woman who was pro-abortion at this point (and had who had abortions) was so Disturbed by what she saw she became pro-life. As far as empirical evidence I think it is very important to follow. Not everything can be reduced to cold calculating facts. I wish it could but that is not the case. To your other point about once a right is given it should not be relinquished. The Constitution does not give rights it recognizes them. A woman has the right to choose whatever form of contraceptive preventing sperm meeting egg that she wants. For me I am okay with a morning after pill for rape, the question of rape is a whole other topic, I'm focusing on two consenting adults. The answer to these questions definitely won't be decided today LOL it will take time, philosophical and scientific research. I'm willing to compromise when we have more information. For now I draw the line at conception and believe that person's right should be protected because they will inevitably become a human being. Sperm will not become a human being on its own nor will an egg so I am okay with preventing that from happening just not aborting the pregnancy. I love to hear skepticism and conflicting points of view it's the only way to help us grow.

    @@thegunpenguin as far as historical precedent. I am only referring to that which is relevant to the forming and interpretation of our constitution. The founding fathers used blackstone's commentaries on English law when they were forming the Constitution and United States supreme Court justices have often cited blackstone's commentaries as a way to interpret what the founding fathers intended in the US Constitution. According to Blackstone when a woman is aware she is pregnant the child in her womb had its rights as a British citizen protected. This was United States supreme Court legal precedent until recently with roe v Wade. I don't think anybody would argue from the perspective that under ancient near East culture it was perfectly acceptable to sacrifice your child to a deity to win a battle or have a good harvest, that because they did such atrocious things we should be allowed to do them. Even if somebody did want to argue that point it would be moot because it is completely irrelevant to the intent of the Constitution.
