So a few days later my GF sends me this little clip of Jack and one of his friends. His friend askes him what his surveyor says.
Anyone want to guess the answer?

    You should definitely thank your neighbor for the fence section he built you, on your property. People think the local jurisdiction will decide one way or another and that's the end of it, but reality is nothing like that. I worked in zoning and development services a few years back and we'd get this all the time. Folks would call and ask us to come out and determine if their survey way accurate or not and settle their dispute with their neighbors. Ain't how it works, folks. You property owners have to hash it out yourselves, usually via attorneys who know what they're doing. First step though, surprise, is getting a surveyor to locate the property pins. After that, it's pretty clear where things stand. But the other guys don't always want to admit to reality so you get yokels like this dude pulling out the pin as if that's going to magically fix things. If I were him, I'd smile to my neighbors and say "Enjoy your new fence I built you. If you want it moved, you can pay for it. It's on your property after all."

    @@craig5923 Because the property deed, which is a legal document, dictates property lines. It is not the citys responsibility to police private deeds...It's a legal issue.

    ​@@LoriL010 so how does the tax situation work? They will tax your property based on you owning the full lot, not the lot minus a sliver because the neighbor took some of your land. Maybe he out to pay full taxes on the lot, except for on that little sliver that was stolen. Since it isnt his anymore. I bet the city would get involved then.

    @@tommywolfe2706 The owner should pay the taxes regardless of the dispute. If the homeonwers tax rates went up because of improvements made, via the fence, then he'd have to address that in court also.

    I'd smile back and respond, "Actually, I think it'll look a lot better on the other side of my house......think I'll get started on that little project next week. After that, I think I'll plant some White Oaks along our property line..."

    It’s like they don’t understand that is how surveyors work. Those are not just some buddies of yours putting in pins, they are impartial in marking property lines.

    I think you're right, they have no idea that the surveyor is not "his guy" They think the surveyors are just paid to drop the pins where someone thinks their property line is. The property line is not where anyone says or thinks it is, the line exists where it exists and the surveyors are there to show where that is.

    Yep, the property lines for the building lots were set years before when the land was divided for housing, LONG before he moved in. He doesn't get to pick and chose his property line because it suits him.

    They could hire a guy but more than likely said guy will just reaffirm that the pin is correct and bill them for it.

    In the Carolinas, the local county agency did all the heavy lifting. They confirmed the property line, notified the neighbor of the violation, issued fines until the offending property was removed, and inspected the property line after the correction was made. My out of pocket costs: $0.00. Never discussed the situation with the neighbor. The situation never escalated as they knew they were wrong as they never secured a required permit to construct a permanent structure. You are paying too much in property taxes to receive such lousy service.

    Other states take a more active stance on property lines also. I just do not get all the government bodies playing "hot potato" with this situation. These people are not right in the head, and hopefully they will not take this to an extreme level. If that happens, the department in charge of these property line problems has dropped the ball and deserve a call out.

    What Carolinas are you in. As a Professional Land Surveyor in North Carolina, we don't have county surveyors and you will be charged for our services if you call us to determine where your property lines are. I have seen some big problems in older subdivisions where you might have anywhere from a couple of feet overlap to 30' or more. Then when you go to court the judge looks at all the evidence and rules. That's when it gets costly because of all the surveying and legal fees.

    @@robertdavis4614 our private cemetery is in Prospect Hill. We sold all the land except the cemetry and road way. I wonder if we will have a battle someday down the line? But hopefully it was all done correctly. 👍

    @@robertdavis4614 Maybe you misread my post. I stated the county confirmed the property line. As you know, once the pins are set and undisturbed in the ground, the county agency will use those pins to confirm the property lines against their records.

    IIRC Chad moved the property corner pins, TWICE. Then had the fence company put the fence in line with the illegally relocated pins.

    WELL actually, they can and often do! In preforming my due diligence, I hired a well-respected company (big city, not a po dunk town) prior to closing on ag zoned property. I paid for a 10 foot survey. So every 10 feet I wanted to know what was there if there was any encroachment etc. It came back with tree diameter, t post, t post colors, count of barbed wired, species of tree, boulder size and color. 2 posts were outside my line and the rest were either on the line or were inside my line. I was confident I got a clear understanding of what was mine and proceeded to finalize the purchase. Two months later the BIGGER survey company all the developers use contacted me to say my entire fence was encroaching on the planned development in some places 2 feet. I said that is impossible I paid for every 10 foot and I know all of my stuff is on my property- the 2 posts. Contacted my survey company for them to cure the other's mistake. When they learned BIG WIG FANCY PANTS survey company was opposing their findings...they FOLDED, buckled like little girls. "well, then they must be correct". WHAT??? What did I pay you to do? When can I expect the return of my $10,000. _ They refused. They are licensed and remain one of the oldest established firms in the city.

    Oh, man! This brings a true story to mind. I grew up primarily where it was a house and a driveway and a house and a driveway with at least 3' from your house to the neighbor's drive. The property line went straight, of course. Over the years, my sister took over the gardening from our mom, and very slowly, the garden began to encroach upon the property of the one neighbor. I warned her about how the property line went, but my sister insisted it was "our property all the way to the edge of our driveway". She has, to this day, a vile temper and any attempt to get her to listen to reason doesn't end well, so I wisely just dropped it. Well, one day, the neighbor's let her know that they wanted to plant some veggies, so needed the patch of land that was on their side. She refused, stating it was "her' property (um, it was our mom's house, soooo.. ). Wisely, they didn't argue, but called in a land surveyor, who put stakes with those bright orange streamers - you know the ones...and they went through my sister's/mother's garden, cutting off 2 feet of it.. Sister flipped her lid, insisting they were lying ( her go-to when she's losing an argument) and called in surveyors (City? County? I don't remember). They came out and surveyed, and - guess what? - the original surveyors were WRONG - by about one foot! So my sister lost ANOTHER foot of garden - about 40' long, so she lost a LOT of garden. The best part is that when the bill was received, my sister was outraged (she'd never inquired about costs involved, because, you know "I pay taxes!"), but handed the bill to our mom. Mom took one look at it, handed it back to my sister and said "YOU called them; YOU pay it." The ensuing drama was worthy of pulling up a lawn chair and making some popcorn. And that's how my sister lost over 100 square feet of garden.

    He doesn't really say anything, they just walk down the hill, look at the other pin. No audio on that camera for some reason so we have no idea what was said.

    You shouldn't take a polygraph anyway they are pretty useless they basically measure anxiety but if you are someone who is a normal person and intimidated by the police you will be throwing false positives all over the place lol. The guy who invented them basically said they were for fun and not to be taken seriously but you know how that goes too late now.

    The fence company must have been of Craigslist.... no reputable company would run a fence line based on just the owner saying "put it here" especially when Wayne informed them.

    The company that put a total of 100 ft of 6 ft chain link fence on 2 of my property lines with a 24 foot gate in the 40 ft side put it exactly where I told them to. There was existing posts but no fence from the old fence line belonging to the neighbor on the 60 foot line. I told them to set it back 2" from the pipes on the 60 ft line. I had them set the fence back 4 ft from the 40 foot line at their recommendation so i could turn my travel trailer into my yard easier from the private road behind my house. The neighbors back fences on each side of my yard are only 18 inches from the paved road. If I had not set the fence back 4 ft from the property line I would have needed a 28 ft gate to make the turn. They went on my word as to where the property line was when they did the estimate. They were only concerned about buried utilities and had the utility people mark them. It's not on them if the fences have to be pulled up it's on me. They will never need to be moved because I know exactly where the corners are from previous surveys on the next door neighbor's houses. I also have a copy of and showed them the 1950's plat for my property. They never checked the pins.

    I encounter similar disputes with property lines but also easements way too often. It never ceases to amaze me that people will spend hundreds of thousands of dollars and work for 30 years to pay off property and not have a single clue of what they actually own.

    He realizes finally that he's going to have to move the fence. But moving the fence will create a space just wide enough for a push mower, so probably be better to take the fence out and plant a living fence where they're other plants are on the actual line!     They have planted some plants along the fence line. There is also a wall going up slowly on their side of the fence with whatever they can find. I feel like this is a metaphor but in real life..

    Okay, don’t know how I got here but I’ve binge-watched everything and am totally addicted. It’s like reading a captivating book but not knowing when the next chapter will be released. I really need updates and to see how/if the police have educated your neighbor. I’d have an 8 foot fence up on the property line yesterday with private off-duty police to protect the fence crew.

    I eagerly keep checking back for a follow up. Can very much relate. For years I was portrayed as the bad guy for making a constant issue over the property line on my 80 acres. Turned out after a survey, that he had 17 acres of my land fenced and was using another 10 or so for hay bales. At least in my situation though the survey put an end to things and the fence got moved and everybody is on good terms now. Its unfortunate your neighbours are so far out of touch with reality. I wish you folks luck!

    Can't wait for the day that fence comes down an the look on your neighbors face. Had a neighbor like that once he was caught by me an another neighbor removing our survey markers which had been there for over 60 years, it's illegal to remove them in Canada my neighbor was shocked when he landed himself in court over this. Then he tried to sue me over it, having an original deed helped me in court and forced him to paid my legal fees.

    JACK WON'T HIRE A SURVEYER. HE KNOWS THAT HE IS WRONG. BUT THE CRAZY WIFE WON'T LET THE 2 FEET GO. HE KNOWS THE SURVEYER WILL TELL HIM HE IS WRONG. AND HE CAN'T HANDLE THE TRUTH. HE WILL HAVE TO MOVE HIS FENCE. WHAT A TERRIBLE NEIGHBOR. NICE LITTLE DOG. SOMETIMES I WISH I HAD A NEIGHBOR THAT I COULD MESS WITH LIKE THEM.     Surveyors are not your guy or their guy. They are the towns guy. Does he think they just make up property lines out of thin air? I can understand him being upset if he was told the property line was different than what it actually is but theres no excuse for not checking this legally. You don’t buy property without knowing what you are buying.

    The convo shoulda been... I had it professionally surveyed, here is my surveyors card, they set proeperty markers according to the law. Any questions can be sent to their office.

    Do NOT let this fester. This is exactly like the situations you see on those crime recreation shows where one neighbor flips out and shoots the other. File lawsuits against your neighbor, the builder, and the town. Also, submit a bill to your neighbor for rent. Unfortunately, the new normal is you have to force people into doing their jobs.

    So basically you had the Survey done, I’m guessing this would’ve been the 2nd time. So what have you heard from lawyers or the town ? Will Frick and Frack eventually have to move that fence ? I find it totally foolish of a homeowner to put a fence up and have no clue where the property line is. Here in the NE N.Y. Our county wants a permit, variance, a letter to neighbors within eye shot. Oh did I mention the latest copy of a survey ? Fence guy was great, let me put this fence up and pay me IDGAF pay me, I’m out !…..LMAO

    That was most likely a lawyer. Did you see what looked like a Mercedes sports car he's driving. thats a higher class person they are used to by seeing how they are and live.i would laugh if that guy walks over and puts his card in your mailbox with a note on the back i can represent you.     @@davidnull5590 they still make the BMW Z4, you can “build your own” 2022 Z4 online today. I bought a brand new Z3 at the end of that model year either 2001 or 2002 can’t remember exactly. That was a fun car to drive.

    My cousin and her husband went through this with a neighbor. It's very frustrating. The guy was a person with a criminal record. Real nutcase. They believe he got tossed back in prison for something else and that stopped the issue. Hopefully you get through their thick skulls how this legally works.

    Tell him to hire his own "licensed" surveyor and if the markers change you'll pay the bill. But make sure to tell him you need to see the surveyors license first. Something tells me he'd just try and get his nephew to come out and just *say* the marker is "over there".
