The “data collection company” doesn’t really work for Billboard (even if they are getting paid by Billboard). They are working for the record companies, distribution companies, etc. Independent artists are a threat to that business model.

Courts won't care. Private company, no contract between the parties. At best he could try filing a deceptive advertising complaint with the FTC, but as he isn't actually their customer it probably won't have much weight. The most effective course of action would be a social media crusade naming and shaming the company or pressuring Billboard to cut ties with them if they don't change.

Can tell you now that courts won't care. It's a private business and there was no contract between the parties, it's not the place of the government to step in on this. Best course of action is to name and shame the data collection company so the public applies pressure on them to change.

I’m 7 minutes in and this is interesting, but I want to know which data collection agency you were in contact with. I report physical sales to billboard independently every album and initially I had to give them access to the website’s backend, which I did. They’ve never asked about publishing or anything of that nature. They did count the physical sales though, which were in the thousands. I’m sure I can help.

As an ecommerce guy, let me explain why logging into store backend should provide verification of Tom's numbers... Every transaction will have a transaction ID along with payment verification from the credit card processor....this cannot be faked or scammed in on the backend. Billboard clearly does not want to accept information Tom & crew.

Rolling out an independent capable of numbers even remotely on the same level as huge publishers would cripple them over night. Musicians believe they have to sign to ever have a chance to be noticed. This proves that fact is nothing but a myth. Only solution is scream fake and bury it to protect their own worth. As far as the independent data collector, this is nothing but a gate keeper. They don't put the time and money into collecting data for free. Someone is paying them, and they pay very well. Wouldn't want to lose that. There is no competition, there isn't some other agency you can go through. They are totally protected. There is no way to out compete them because the wallet would never see them as legitimate. It would ruin them to allow a second source out of their control collecting any type of data. It might prove their own cash printers to be less popular than the independents. This would just result in a landslide from those who just follow whoever is most popular. This fight will be huge. It will take someone on the inside flipping. Maybe some hero will speak up. Otherwise it will take an army of independents. Tom might just be the pied piper. Ever need proof of sales, all my copies are autographed. Far better than any UPC code in my book.

You nailed it. The industry tolerates independent artists who "know their place" according to the industry. Read: small time independent artists are a novelty to have in their ranks. They will never play ball with someone like Tom for the very reason he wants to be on the charts. They are dying and they can't allow Indie artists to show them up. They are playing you Tom. You can have millions of followers on IG what you don’t have are the relationships the infrastructure of a label. Name one artist to me that has scored a top 10 hit without a label. I've never listened to Tom MacDonald, but I watched this entire video, and I am furious. It really sounds like an elite circle of people that won't participate unless they get cut in to the profits. Because you are independent no one is getting a piece of the pie, it makes rage on the inside. And this is why tons of independent artists never make it, because they don't have a parasite of a record label sucking their wallets dry. The only way i see of this getting any action, is a massive campaign with the help of "BIG BILLBOARD" artists also jumping in and supporting the cause. Best of luck my dude.

That’s correct, my friend. As an independent label, I can verify this. Most labels are owned by the big 3: Sony, Warner, Universal, and they make up >80% of streaming. Whether you like it or not, most of your money when paying for Spotify or Apple Music goes directly to them.

The problem is that Tom and other independent artists would be able to make even more sales (music as well as merchandise) if the billboards would report accurate information without bias against independent artists. I don't think it was validation at all. It was to get their message out to the entire world. By putting your name on the chart, you're getting people to look you up and see your message. The validation comes as a cherry on top.

Their music is being heard, they've been very successful at doing what they love, so how much is enough? They have fame , money success and a platform on which to make and distribute it. Their music is being heard and exchanged world-wide but it's not enough, they want cater to the old establishment. I'm no hater but 10 minutes sounding like a primadonna having a hissy fit doesn't quite fit with his message or videos.

Dude, I’ve been a musician and in music forever. The fact is, the entire industry is rigged and has been since the 1950s. It’s a money machine that benefits the record companies and the record companies alone. The artists themselves receive pennies on the dollar. The charts have all been rigged since the early days of music. Just look how the industry buys into the radio stations or at least did before streaming hit. I’m sure they have bought into the streaming services also. The Grammys, Billboard music awards, all of that stuff is a popularity contest meant to promote up-and-coming artists and make them look bigger in order to draw more people to buy more downloads, watch more videos and gas up the industry machine. Why do you think people like Michael Jackson, Prince, George Michael and how many others were trying to sue themselves out of the contract that they signed when they were kids that essentially took everything from them and made them slaves to the industry. While making record companies billions and trillions of dollars. People like you are a gremlin to the machine. Threatening to bring it down and expose just how unfairly they’ve been treating and paying the people making the music that drives their machine. Before the Internet and KZread and other ways that artist could promote themselves, there was no other recourse but to sign a contract that essentially signed your music and life away. Making artists indebted to those record companies for the life of their contracts, which unfortunately sometimes extend their entire careers. Keep doing what you’re doing, as other independent artists are doing the same… let’s bring down the machine and make the music industry fair for those who are creating. You’re a good man, keep up the good fight.

"selling out" is a thing and they do rituals and extremely immoral things to move ahead and garner more fame or connections within the industry

I agree with you, but to be fair to the music industry, most artists that they work with don't pan out. They take losses on those, lots of them. They rip off more successful artists to cover costs. However er, they make entirely too much money at the expense of these artists. Tom can be a real threat to that. I'm with him.

can someone explain to me why Tom didn't just send legal representation instead? They would have had immediate, timely responses, and they would have been able to get that stuff done instead of having a data collection company dicking around with you. I have a feeling what they did, was realize who you are, and didn't want to rock the boat by accrediting you to billboard. Cancel culture is strong in the liberal arts.
