    just because we don't have gender neutral marriage laws in the country and women take advantage of it/misuse it to take money from their husbands doesn't mean women shouldn't get equal pay and equal rights. Those are basic rights that the feminist movement stands for and an anomaly of the justice system cannot undermine its importance. Please understand these are two very separate issues, just because they both relate to women and finances doesn't make them similar. Making such a statement is not very different from the logic that since parents don't give their children freedom of speech and expression in the house, they shouldn't ask for the right to freedom of speech and expression from the court. Try to think about it. The lack of stringent gender neutral marriage laws leads to women taking advantage of it, correct; but does this mean women don't deserve rights and payment for the work they do? Its like taking rights away from citizens because one of them committed murder. I hope I could make my point.

    These laws are there to protect uneducated , unemployed , dependant housewifes who gets abused by their in laws.... Which is a big majority in this country...     My ex wife asked me 50000 for her everymonth, I gave her 5lakh rupees and settled it at once . Now I am happy and she must be broke😂. Chaen ki neend aur sakoon se din dono कट jate hain। My pro tip: one time settlement, that's it.     @@nagarat7308 bro, I dint filled for divorce ,she did. Selfish would be a very small word for her . She just wanted everything done in name of her and disregard my parents. So jub parents ka izzat nahi aur sub kuch issi ke naam kardo toh bhai ,esse acha toh Tata bye bye. After 10 years she filled dowry case which later she admitted in court that it was false and it was mentioned in my final draft. If you have any issue I will be ready to help

    @@nagarat7308 bro, see , if your case in not in the court yet or even if it is ,you can ask the court to transfer it to meditation center and then you sort it out. What I did was the same and then she asked for 50lakhs and a house but I negotiated it to 5lakhs, started from one lakh and ended it on 5 laks. In meditation center very nominal fees is required,ipaid 2000 per meeting and a few thousand in paper work, btw where you from??

    @@devilback8871 And you fool don't know that there are judgement where court have rejected maintenance to such woman who leaves job deliberately to claim alimony. In such case, husband's lawyer cross examined her and asked her what was reason of leaving job. She said she wanted to take of his kids. Then Husband simply showed resignation letter of wife as evidence which exposed her lies. She quit her job before maintenance case because the date of resignation is mentioned on that letter. I can give you that judgement.

    @@tribikramdas2181 I just thought of the most simplest of loopholes that can be used, the complexities can be added to make the case for the women, the law is biased for women for good reason but smart women misuse it frequently and their are many such cases were the women accuses the husbands family of harassment(mental/physical). So dont act like numbnuts here, I support women rights however talking about these loopholes and improving them will only make the system better but the problem is people like you dont even want to acknowledge that the problem is there. Yes, there are loopholes no doubt but that doesn't mean that husband should fighting false cases of 498a/DV merely because the law is biased for woman. Loopholes are there no doubt, but it is the victim which expose those loopholes through evidence. Like I said in my previous comments.

    @@pickachu3739 In western countries, divorce rate is 50%, does 50% people die in swimming? I think there is more likelihood to come back alive in swimming than marriage. In India, it is said that divorce rate is 1% but many people don’t get divorced for society, kids and many other reasons, doesn’t mean they are happy. Divorce rate is still higher in urban areas in India, especially metro cities.

    Court should ban 498a and dv till atleast 5 years of marriage or till child is not there.if a women complains of harassment during this period divorce should be granted with no alimony.

    No bcz, the girl leaves her parents house and comes to stay with you. The moment you are getting married your wife is half the owner of your property as you forced her to leave her parents. So now after divorce the court says give the wife 'her' share of property. If you want to change the rules then change it from the beginning where the girl will not leave her parents house.

    What system? The system is different in Australia compared to India. In Australia, the wife can get 50% of all property brought by couple during the marriage. So let's say the man bought a house when married. When divorce occurs then the house value must be split and given to wife. Obviously in reality the house can't be physically spilt so it's sold and half of the money goes to the ex wife. Technically, if the wife bought the house and divorce occurs then 50% will have to go to the ex husband. In India, the cap is ⅓ of salary. There is no house selling. Which is better? Paying ⅕-⅓ of salary - which would go to supporting your children if any or selling off house?

    Indian court says Marriage is not a contract according to Hinduism and is a 7 janmo ka bandhan and not hold prenuptials valid but grants divorces with supersonic speed ordering men for alimony... Why... You are the one who said marrige is not a contract... Now why are tou granting a divorce and then also granting making alimony. Now in India getting employment is very difficult..... Idealistically I think one should be able to get job with mba degree but reality is that leaving job ( out of workforce) for more than 2 years reduce your value in the market.... Company will not accept you with more than 2 years of break......... So it is difficult for housewife to get job after marriage....

    My sister in law claims that she is strong and independent women. And she always used to say me that i am not dependent on my husband. After separtion demanding half of his salary income and showing that she is jobless. She so conveniently turned or switched into strong independent women to abla nari.     Prenuptials don't hold in India as courts don't acknowledge marriage as a contract according to Hinduism (as oppose to in the western countries where it is).     ​@@uwu63786jfyou will still be recieving money from some source, even if it's from the trust or parents as long as YOU receive it court will see it as your income and you will have to pay her maintenance. Only way out of this is if your wife earns nearly as much as you.

    From 2011 - 2015 I was fighting divorce. I am from Kolkata she filed from her native place North Bengal. There were 9+ cases. I had to either take leave travel with laptop overnight on diff dates. This went on for few yrs. I was jailed under 498A, lost job, awarded 60%+ of salary as maintenance. Finally, out of court settlement. She took my son when he was 4yrs back in 2011.

    ​@@sutanukaadhya1401that's the tradition. A women can leave her parents house because in MOST cases the women is not the one earning for their parent, typically it's her brother or the dad has some other sources. But the same cannot be said for a guy, his parent in old age only have him.
