SCOTUS’s power relies on public trust. What happens when that weakens?

The Supreme Court lacks a mechanism to actually enforce its opinions, as a form of balance on the unelected status and lifetime appointments of its nine justices. Thus, the Court’s power and legitimacy rely on the trust that we, as a society, place in it. But as the Court tears down decades-old precedent in unpopular decisions that roll back long-held personal rights, and Justices Thomas and Alito face crises of credibility, that trust is crashing. When people stop believing in the systems that keep democracy running, those systems will cease to function.

    It is so weird to me that in the US the judges of the Supreme Court are called "Justices". To me, it sounds like if they were being treated as gods. In the same way was there are various Greek/Roman gods whose names are exactly what they represent like Juventas (youth) or Chronos (time).

    Some committed perjury. They would not have been confirmed unless they affirmed that Roe was stare decisis; meanwhile, you can not have attained tenure on the sharply Catholic faculty of Law at Notre Dame unless you vehemently opposed Roe.

    @randybrunet6740, three lied under oath in their confirmation hearings, two have openly accepted bribes, all nine have decided they have the right to legislate by ruling. They have denied precedent, and in the Colorado case decided to legislate rather than interpret the Constitution. EVERY court in the land, from the local magistrate to the Supreme Court MUST uphold Constitutional laws. The Colorado Supreme Court was upholding section three of the Fourteenth Amendment to the letter. The Supreme Court added the requirement of a Congressional indictment. It was not a requirement in the Fourteenth Amendment, therefore their adding it made it a legislative act, prohibited by the Constitution.

    The problem may be that SCOTUS should never have been blindly trusted in the first place. It's super interesting to learn about the founding fathers and the thought processes behind their decisions. I'm not even American. Justice free from force or will is great but I think SCOTUS should strive to be more than this. SCOTUS should represent the very heart and soul of the nation. Something to be cherished by all and fiercely protected. Protected from anyone who tries to attack it, including from within. Currently, SCOTUS is tainted, it is corrupt, it is influenced by both the force and will of a few people who are abusing the power that has been bestowed to them. As James Madison said, "The truth is that all men having power ought to be mistrusted".

    I'm old and I have always had respect for SCOTUS regardless of party. But the current justice's behavior, lack of emotional intelligence, pettiness, and disregard for precedence has destabilized the country and done great harm to many. I am afraid the blatant partisan views and desire to force 330 million people to submit to their catholic religious beliefs has caused deep distrust.

    Yes, however the ultraconservative justices aren't mainstream Catholics, and they're primarily representing the choices of the Heritage Fnd. Remember that Sotomayor and Biden are Catholics too, more consistent with the mainstream.

They are also blocking the one to end price gauging, end credit card junk fees, the lowering check overdrafts from $32.00 down to $8.00. They are blocking the windfall profits tax, IVF, birth control, the tax excessive CEO pay and they let the pass trough loophole expire. That is how 50 years of settled law is being overturned 6-3 conservative super majority Ruling only in favor of Republicans and the Courts conservative billionaire donors .. would be the end of democracy.. and the ushering in of the Oligarchy. The first three words in the Constitution are the most powerful: We the People. They declare that the Constitution derives its power not from a king or a Congress, but from the people themselves. This concept of popular sovereignty-power to the people-is the foundation upon which the entire Constitution depends. There is nothing in the Constitution that limits the size oi the SCOTUS. The Court should be expanded by 6 more Liberal Justices bringing the number to 15 justices . . Clearly the Captured Conservative 6-3 majority can't be trusted to safe guard our democracy from the Harlan Crows and the Leonard Leo's .

I know conservatives don't care about precedent, law, or moral integrity, but you need to substantiate these changes, or you run the risk of facing a violent public.

    Distrust the court might be a better option. If this period of turmoil has demonstrated anything it is that society should not blindly trust SCOTUS. The reverence and respect the court had has been shattered. So perhaps flip it on it's head. Treat every SCOTUS ruling with extreme caution.     Because they’re supposed to uphold the constitution and serve the American citizens above their own personal ideologies, and that’s no longer the case. The original court that decided Roe had a 7-2 conservative super majority and they decided to uphold women’s rights because it was the right thing to do. Trump’s put people in place that consider themselves Christians fighting for the soul of their country above all else. They now serve themselves and the billionaire’s who helped put them in power. 2/3 of all Americans have lost trust in them, and they cease to exist the moment WE say alright that’s enough, and stop taking them seriously.

    They are supposed to have an ethics code. Every other judge has strict rules to abide by. But not the Supreme Ct. in 2025 that needs to change. Dems must reform the court with strict accountability, i say strip them of the recent powergrab and strictly limit thier jobs to making neutral decisions based and supported by laws NOT theories. Add in some transparency regulation then to top it off expand the court. The GOP will be salty for generations.

    @@fixieroy Absolutely. There needs to be a transparent body that selects justices and another body that has investigative powers. Ethics, transparency, and accountability should be at the heart of this process. Justices should never receive donations or "gifts". There should be a method of enforcing recusal as well. Too much is left to the justice's personal judgement. Politics is destroying our justice system which then destroys our society.

    Start a system of rotation of Supreme Court Justices from the 13 Circuits. Every judge who has served for 13 years would be swapped out for a Circuit court judge, taking the circuits in order. In the meantime increase the count to 13.

    Justice Scalia's judicial philosophy was based on "textualism" and "originalism," which involves interpreting the Constitution based on the original meaning of its words at the time it was written. He was not alone among justices in consistently arguing that the Constitution is "dead, dead, dead."

    The Constitution is also flawed. Flaw 1: Electoral College; Flaw 2: Lifetime appointments for Supreme Court justices; Flaw 3: not allowing women to vote; Flaw 4: "Colored" people are only counted as 3/5 of a person. These are just what I can enumerate off the top of my head. The Constitution was constructed in such a way to bamboozle the common uneducated farmer that he had a voice by vote in a "representative" democracy - which is not a pure democracy as this representation negates the popular voice, thus preventing democracy by "those who know best" (read wealthy landowners). These flaws have immense detrimental effects on our situation today: the Electoral College has prevented the peoples choice of presidential candidate in 7 of the last 8 elections; also, lifetime appointments of SCOTUS justices has led to activist judges pushing Federalist Society principles that have resulted in rights and civil rights being stripped from the populace, and since only two days ago, the rights of federal agencies to determine how to enforce the policies the American people have granted through their votes via their elected representatives. The Constitution is in dire need of a v 2.0. 225-ish years after it's ratification the world has evolved and faces challenges not dreamed of by it's wealthy framers who sought the type of monarchical control of the government similar to the government they rebelled against.     Project 25. A idea or plan that could be put in place. We have no scientifically certain evidence X (project 25 in this case) will happen. Not the first or last time this has happened in history of the United States of America. This happens on both political sides and is not subject to just a gathering of people that identify with a certain political party by definition. If just one human who identifies themselves as a (R) disagrees with what that project outlines it does not encompass a political party entirely. Thus also no longer being a scientific certainty and just how some humans who identify with said thing think. One can also find ideas or plans that opposing party had wanted to put in place. It did not encompass a entire group of people who identified with a political party nor did it happen.

    The rule of law only exists if people see that the rules are reasonable in measure, equitable in application, and relevant to the needs of the country. If the rules change on a whim, if equity becomes an absurdity, and if the laws only have relevance to those who wish to inflict pain on others... then you approach a point where the risk of damage from not following the rules is no different than the risk of damage with trying to follow the rules. The system becomes imaginary. Justice Breyer had cautioned his colleagues on strict textualism because the rules could lose on some or all of those points. In his words, you could end up with a constitution that nobody wants. And what is going on now with SCOTUS is worse than what Breyer feared. Even a conservative justice like ACB is saying as much in some of her dissents.

    All power comes from the person. Society is created when two or more people give part of their sovereignty to a common authority they agree to support and comply with. When the common authority acts against the agreed will of the people, individuals will reclaim their personal sovereignty.     That's an interesting point about the court - it's power rests only on the degree to which others listen to it - or not. Amost of the enforcement power of the government rests with the executive branch. As we saw on 1/6, Congress has little ability even to defend itself, much less anyone else. A bad faith actor like Trump could easily just ignore SCOTUS and do what he wants anyway so this immunity thing is little more than a fig leaf for him. The real damage has been done by the renegade court, undermining itself. We all listened when we believed they were impartial arbiters of the law. When they clearly become partizan hacks, the spell is broken.

    The Supreme court lacks any Constitutional mechanism to enforce its decisions. In 1832 the State of Georgia and President Andrew Jackson defied the Supreme Court and continued the forced removal of Cherokee Indians from Georgia's territory. In 1957 Governor Faubus of Arkansas defied a decision to allow nine black children to attend a segregated school. Only when President Eisenhower intervened with the power of the Executive Branch were the children allowed to attend the school. Some other instances of defiance were recorded around Roe vs. Wade when Different States imposed restrictions in defiance of the law. What happens when decisions made by the Supreme Court are deemed to undermine the structure of the Executive Power? Can they rely on the enforcement power of the Executive Branch to force itself to avoid defying the Court's decision? Some say the answer lies in the degree of Public Trust the Court may have. Public opinion alone could sway the actions of the Excutive Branch.

    No the power of the SCOTUS comes from the constitution. Sometimes rulings are going to be opposite to the public since the publics wants are not always constitutionally possible. Courts rulings are not supposed to be determined on popularity.
