San Diego Police Officer Rapes Woman In His Custody - No Charges Allowed to Resign

For the people saying this is not rape. Rape is accomplished by force or fear, if you put a gun to a woman’s head and she consents to sex it’s rape. This cop handcuffed her, forced into a locked car, held her in the rear cage of the car and was taking away her freedom to leave. It doesn’t matter what she said, the sex was done by force or fear. It’s rape.
“Rape” is defined in California Penal Code § 261 as the use of force, threats, or fraud to have non-consensual sex with another person. A conviction is a felony usually punishable by three to eight years in prison and registration as a sex offender.

SAN DIEGO, Calif. (WKRC) - An officer resigned after locking himself in the backseat with a female detainee.
According to The New York Post, San Diego Officer Anthony Hair resigned around a month after a probe was launched into an incident in August 2023. Per the publication, it was just one day before he was scheduled with meet with investigators for a second interview regarding the matter.

    How does a resignation cancel discipline and criminal charges ? He becomes a " Gypsy Cop " now , not even much of an interruption in the pension he's accumulating. After collecting his payout for banked sick and vacation days and he won't even feel a financial blip .     You think a cop will think twice about shooting and killing you when presented the opportunity? They have the protection of their entire department and union reps. Want to sue the officer for it? sure... if you win, the tax payer pays, not the cop. The cop can also just move to another county or city that may even pay more to re-hire him. You need to remember that the Supreme Court ruled that police have no obligation to protect anyone and they can steal your money/property without probable cause (asset forfeiture). We really need to have accountability because the corruption goes all the way to the top brass and union reps.

    It's not so black and white... but at the same time, I personally don't know what the right thing to do would be. It wouldn't be right for any person to have a camera on him and recording his voice every minute of every day while at work. These people are human beings (even if I despise them myself) and it would be an injustice/tyranny to make them live with cameras recording their every movement and every word. They work together and have friendships and they speak in private all the time. If you and I are in out own vehicles for example, we have a legal Right and expectation of privacy. When cops are not on scene and are not dealing with other people, they can and should have the right to turn off their cameras. They should have the Right to have moments of privacy and moments of confidence like everyone else. They release the body cam footage with zero oversight and/or if the wear of body cameras extended PAST their time on duty for the day. Many, many jobs have the precedent that you are openly recorded for your entire work day and every aspect of your performance (both duty or personal related) is subject to review. Why do we constantly allow the police to be the “profession” in the US held to the absolute lowest standard. An Amazon warehouse employee, fast food worker, hell even a kid mowing lawns on the weekend is held to a higher standard and given less leeway when they make a mistake compared to a cop with decades working the job and countless hours of “training and experience” backed by a department with millions of solo of resources (cops are typically the largest single expense for most municipalities).

    I worked with a married Police Officer that was working undercover in narcotics and started having sex with his female confidential informant. She eventually turned on him and reported their relationship to the department. Well, it turned out that the confidential informant had HIV. The male Police Officer was tested and he had HIV and sadly, he passed HIV on to his wife. Naturally, the Police Officer wasn't fired, but his wife divorced him, and she was so upset about having HIV and her marriage being over, that she hung herself in her bedroom closet. So he raised his two small children by himself. But I wonder to this day if he ever told his children why their Mother committed suicide.

    A few years ago, a female and male Deputies met a the beach on duty in the County that I worked. They got into the back seat of a patrol vehicle to have sex and locked themselves inside. The female Deputy called my friend who was on duty from her cellphone and told him to meet her at the beach. (They had code words for places around the county to meet and hide.) When he got there, he was shocked to see two married Deputies locked in the back of a Police Vehicle. He immediately called for the Shift Sergeant because he didn't want to be a part of covering up their scandalous activity. Neither Deputy was fired because the female was "connected to people in high positions at the department." BTW, this was years before body cameras existed and there was no dash cameras or GPS in the Police Vehicles.

    Have seen several cases now where cops were caught having sex either with each other and/or with prisoners or people they were arresting or had pulled over... because they forgot to turn their body cameras off. For every case we hear about though, there has likely been many that we don't know about, because they didn't forget to turn their body cameras off. (Like that recent case/lawsuit where the one female cop was found to have had sex with nearly every single one of the male cops in her department). In the end though, I'm not sure if 24/7 body cameras would be the right thing to do. Despite their ability to turn them off (and abuse that power by doing so)... they are still human beings with private relationships and confidence. They have the RIGHT and expectation of privacy when they're alone and not dealing with citizens. As much as I despise cops/govt, they are still human beings...     Wow man. If that isn't a case for violations under the color of law, I don't know what is. (Yeah, yeah.. I understand she solicited the act. But gezzus man.) The 2nd cop didn't even ask the woman if she was alright. There's so few things I've had such profound changes of my opinions toward anything as I've had toward cops. I used to have at least a modicum of respect and leeway regarding cops. But now I have zero for them and the system which projects them, and clearly upholds a massive double standard in being held accountable for actions taken. I can't believe that this is the world we've collectively allowed to come and live under into existence. Our founding fathers aren't rolling over in their graves.     “Rape” is too strong a word. Rape is when a stranger with a knife crawls into a modest woman’s window and forces himself on her. Rape is a felony. We used to hang rapists or put them in jail for the rest of their lives. He didn’t rape her; she seduced him.     He didn’t “stop for an hour.” He was in the backseat for about 10 minutes before he called for backup to let him out cause he was locked in. It took backup an hour after that point to show up.

    People get the government they deserve and by extension the police they deserve. While it’s good to point out bad cops it’s far more important to run for office and become part of the policy making that’s going to ensure only competent and conscientious men get hired.

    If I made the laws I would make body cams locked so the cops can’t turn them off, when you clock in the camera powers on and when you clock out it powers off, what’s the point if corrupt cops have full agency over the camera. My place of business doesn’t allow me to access the cameras when I’m not in the mood to be recorded…
