"Not gonna happen, buddy!" This Guy Won't Tolerate Unlawful Demands!
The crux of the incident revolves around the man's activity-photographing a transportation terminal-and the law enforcement response. The First Amendment of the U.S. Constitution guarantees the freedom of expression, which courts have interpreted to include the right to photograph public officials in public spaces.
The law enforcement officers' request for identification hinges on the man's proximity to a sensitive location. Under the Homeland Security protocols mentioned by the officers, heightened security measures are understandable, especially following a recent bomb threat. However, these measures must balance with constitutional guarantees.
The officers argue that the man's photography might pose a security threat, potentially justifying their demand for identification. Legal precedents such as Hiibel v. Sixth Judicial District Court of Nevada support the idea that officers can ask for identification if they have reasonable suspicion of criminal activity. However, the key element-reasonable suspicion-appears to be missing in this scenario. The man’s mere act of photographing from a public sidewalk does not inherently suggest criminal intent.
Additionally, the public’s right to access and document public spaces has been robustly defended in cases like Glik v. Cunniffe, where the courts held that private citizens have a right to record public officials in the course of their duties. The sidewalk, unless specifically restricted, qualifies as a public forum where such activities are protected.
The debate over whether the man briefly stepping onto terminal property constitutes trespassing introduces another legal nuance. Trespassing laws require that the person entering or remaining on property does so without authorization and after being told to depart. In this instance, the unclear demarcation between public and restricted areas complicates the application of such laws. The man's assertion that he was unaware of crossing into a restricted zone highlights the need for clear signage and communication from property authorities.
This incident serves as a microcosm of larger issues regarding public surveillance, citizen journalism, and security protocols. The legal framework allows for security measures but also staunchly protects civil liberties, necessitating a careful, case-by-case consideration. Officers, while vigilant, must also be cognizant of constitutional rights and the legal thresholds for intervention.

You are very astute, and probably more correct than you might think. A college roommate of mine wanted to become a state wildlife trooper. He graduated with honors with B.S. degrees in criminal justice and wildlife management. He also did an internship, monitoring the catch of a Greek fishing vessel, operating in U.S. waters. When he took the trooper exam, he figured he had gotten every question correct, including those of an obvious I.Q. section that he said was on a 4th to 6th grade level. He went down to the precinct office after being notified that he had failed, however, they denied his request of review his exam. After much persistence, and threat of seeking legal counsel to unseal his exam, an officer finally admitted to him that he had actually received the highest test score ever recorded, and they had a policy of denying employment to anyone who scored too high because these individuals sometimes refused to follow certain orders. I can only imagine the nature of an order that a highly intelligent person might refuse to follow.

Even if there was a bomb threat last week that does not invalidate the fourth amendment.
No matter your position as a law enforcement officer, you cannot turn a First Amendment-protected right into a crime.

Do you know how many videos there are of them doing exactly that? Not only do they do it, they are TRAINED how to do it. Whether or not they do it lawfully is of no consequence, because there are no consequences for them. Even when there is a lawsuit, it does not affect them at all. The taxpayers are held accountable, not them. In fact, they'll probably get a paid vacation, and a promotion.

I love when the psycho looking cop says; "For all we know you were the one who called last night." The cop could have been the one who called. Anybody could have called if there ever was a call. Why does camera make these people think that way?
Can we all agree to STOP calling them "Law Enforcement"? The last time I checked, We the People did not consent to being FORCED TO COMPLY AND OBEY!
They are trying to justify themselves, he said that himself. These two clowns are so full of themselves. They crossed the street away from the facility that they are protecting.
talking to someone makes you a criminal today by these criminals with badges and guns
After you tell them 10 times what you are doing they still say "I`m trying to figure out what`s going on".
Are we still living in America ? No body can accuse any body of anything from public side walks period. If those tyrant cops don’t like to acknowledge that the us constitution exists then can also move to North Korea, Cuba,China and Russia.
Just in case something happens? Do they ask EVERYONE that happens to walk by, in case something happens later?
That cop is a complete asshole & he has no business working in law enforcement or in any other position that serves the people. He didn’t just ask for ID which is acceptable, he continuously pestered, harassed & tried to bully the man for his ID by getting worked up, constantly cutting him off, talking over him & using other various intimidation tactics.

The FIRST question to ask "Ofc. Reed" is: "Are you versed in FEDERAL law?"
Say I want a lawyer as I will not speak until one is present. Then clam up.
They just wouldn't back down off their EGO
Don't tell me this cop just say he is home Land security ,so now you got a cop impersonating as a federal officer, that he can be charged for impersonating a federal officer
Ask for supervisor they are in over their heads
Why are these cops so insistent on enforcing non existent laws? Stupidity is so embarrassing.
Lets make this simple..."Piss off"
What really blows my mind 🤯 is the fact that there is so much uneducated and corrupt officers that there are so many videos of it and yet it still happens and how they try to correct the issue is to try and make it illegal to film instead of them changing their actions 🤨
They accuse but do not observe . Clueless to the law they swore to uphold.
Cop - "We are trying to justify ourselves.". ??? Trying to justify them selves in their own mind. The problem is, Department of Homeland Security has placed the requirement to REPORT suspicious incidents upon the OPERATORS of critical infrastructure. That doesn't give authority to local police to force anyone to identify.
LIES LIES Reed needs to move on.
The whole insanity of ‘’lemme get your I.D. just in case.. for the future’’ is SCARY… Because not only is that NOT when they can lawfully demand your I.D. BUT.. the OBVIOUSNESS of IF some crime happened in the future, whether the citizen was there or not the 🇺🇸 Government could, would, will & CERTAINLY HAVE pressed charges against the citizen who gave I.D. for this future crime, even IF the citizen had NOTHING to do with it ❗ Thank you for sharing this but also for actually LINKING the original content creator ⬇- Good Guy Activism.
That first guy could be charged with impersonating a homeland security officer by his comments at first.
He don't have to show you ID, RAS
Cops weren’t horrible but they tried to be slick
They use that BS for everything - just because someone made a call. 🤦🏼♀️
All they have is hearsay, to dumb to to figure what's going going on ,when they see with there own eyes. You told them no the shock too much for their egos to handle. Gotta have that little I.D. fix
It’s amazing how petty police can be.
A federal terminal, whoopty-doo!!!!

They admitted to wanting identification "In case something happens later." That's the worst attempt at coercion I can think of... It's literally "I want to know who you are and where you live in case a crime occurs here any time in the future so you can be the first suspect and we can find you easily." What dumbass would agree to that?
wow, the ignorance of these cops is Epic... shame. File Complaints
Nothing more than badge wearing revenue generating domestic extortion experts.
He doesn't know the law and he doesn't know what to do.
So 2 years ago 17 years ago 23 years ago EVERYBODY has to get the fact that 23 years ago a car got broken into/murder occurred/ and we ALL HAVE to show i.d BECAUSE...,? What about when people start spouting when cops killed people for NO reason, found guilty and everything, does that GIVE people NOT to give up their name/ address/telephone number/wife/children to an office JUST BECAUSE..?
This is how a police state starts.
He seemed like he was choking on shit while trying to talk tough. They all try to intimidate.... kudos bro
"I'm trying to figure out what's going on and if you give me your ID that will solve the crime that we are investigating but we explain what it is" Real good quality policing.
Ignorance and ego coupled with blue privilege will always gift us (the public) with this shit.
FYI : These cops now have to wear body cams. They demanded to get paid extra for wearing the cams and the county caved in so now they get over 3 thousand dollars a year to wear the cameras. In addition the people who are in the station house also get this money even though they dont have the cams. Any wonder why they abuse their powers ???
That old Cop was ready to have a stroke.
VIOLATION OF 1ST and4 and 5th amendment rights lawsuit time.
Just another fishing expedition ! These thugs are way out of line .

Like identifying yourself as a police officer is going above and beyond their responsibility
What other reasons can they use to bar you from their business?
Dude just invoke your rights geez
How as a country have we gotten so low as to hire these types of individuals into positions of authority 13:03
It was a disgruntled employee who probably made the ph call. 😅
He said someone called in a bomb threat last week that has nothing to do with this man that they are questioning 😡🤬😠
Claiming to be a Federal Agent is a Felony!
Way over reached! and now they can assume everybody is violent, from other threats!! Ego Maniacs
Two cops on a power trip.
If something happens later on, why would anyone make themselves a suspect by providing i.d..
out numbered 3 to.1.these bozo's, love to double team the public. they never play fair.
