"Not gonna happen, buddy!" This Guy Won't Tolerate Unlawful Demands!

The crux of the incident revolves around the man's activity-photographing a transportation terminal-and the law enforcement response. The First Amendment of the U.S. Constitution guarantees the freedom of expression, which courts have interpreted to include the right to photograph public officials in public spaces.
The law enforcement officers' request for identification hinges on the man's proximity to a sensitive location. Under the Homeland Security protocols mentioned by the officers, heightened security measures are understandable, especially following a recent bomb threat. However, these measures must balance with constitutional guarantees.
The officers argue that the man's photography might pose a security threat, potentially justifying their demand for identification. Legal precedents such as Hiibel v. Sixth Judicial District Court of Nevada support the idea that officers can ask for identification if they have reasonable suspicion of criminal activity. However, the key element-reasonable suspicion-appears to be missing in this scenario. The man’s mere act of photographing from a public sidewalk does not inherently suggest criminal intent.
Additionally, the public’s right to access and document public spaces has been robustly defended in cases like Glik v. Cunniffe, where the courts held that private citizens have a right to record public officials in the course of their duties. The sidewalk, unless specifically restricted, qualifies as a public forum where such activities are protected.
The debate over whether the man briefly stepping onto terminal property constitutes trespassing introduces another legal nuance. Trespassing laws require that the person entering or remaining on property does so without authorization and after being told to depart. In this instance, the unclear demarcation between public and restricted areas complicates the application of such laws. The man's assertion that he was unaware of crossing into a restricted zone highlights the need for clear signage and communication from property authorities.
This incident serves as a microcosm of larger issues regarding public surveillance, citizen journalism, and security protocols. The legal framework allows for security measures but also staunchly protects civil liberties, necessitating a careful, case-by-case consideration. Officers, while vigilant, must also be cognizant of constitutional rights and the legal thresholds for intervention.

You are very astute, and probably more correct than you might think. A college roommate of mine wanted to become a state wildlife trooper. He graduated with honors with B.S. degrees in criminal justice and wildlife management. He also did an internship, monitoring the catch of a Greek fishing vessel, operating in U.S. waters. When he took the trooper exam, he figured he had gotten every question correct, including those of an obvious I.Q. section that he said was on a 4th to 6th grade level. He went down to the precinct office after being notified that he had failed, however, they denied his request of review his exam. After much persistence, and threat of seeking legal counsel to unseal his exam, an officer finally admitted to him that he had actually received the highest test score ever recorded, and they had a policy of denying employment to anyone who scored too high because these individuals sometimes refused to follow certain orders. I can only imagine the nature of an order that a highly intelligent person might refuse to follow.

Do you know how many videos there are of them doing exactly that? Not only do they do it, they are TRAINED how to do it. Whether or not they do it lawfully is of no consequence, because there are no consequences for them. Even when there is a lawsuit, it does not affect them at all. The taxpayers are held accountable, not them. In fact, they'll probably get a paid vacation, and a promotion.

''We don't know what you're doing here'', implies no reasonable suspicion. In fact, it is an admission that they have none.'' You might be planning to commit a crime''. Using that logic, they could say that about ANYBODY. He was caught pointing a camera, not a gun.

Never give the police your first name when you start that mess they're going to continue to press on for the second part of your name if they don't have to know your identification don't give him part of your identification. David you are a smart guy of what you were telling them and talking to them about until you mentioned your name then you started playing their game
