Both were NFT media projects that to different extents promised rewards to investors and have now settled with the SEC. Stoner Cats was a Mila Kunis project that featured Ashton Kutcher and Chris Rock as actors.

    RE: music industry. Royalties are negotiated. Most people who work on music, like those in the film industry, are paid flat rate for what they do. Studio staff, etc. For small artists royalties usually amount to fuck-all and pretty much everyone involved minus the act will work for hourly rates or one-off payments + credit (guest slots on tracks, studio production, etc, even songwriting sometimes). Artists who sell more will tend to have more powerful contributors who are able to negotiate percentage points on royalties - producers, etc.

    I wonder why they (Stoner Cats) didn't just do a regulation crowdfunding registration? Maybe they didn't even think to look into it; but seems like that would cost less than the fine. The cynic in me says the SEC is at fault here for not releasing a Guidance document that lays out when an NFT would qualify as an investment contract so creators have something to point to. FinCEN did this with the Crypto companies that need to register with them, so what is so hard for the SEC to do the same.

    Cas is making no sense here, Royalties for infinitely copyable creative works are not the same as buying NFTs, as an investment, an investor gets return on investment from total profit.
