Labour Court offers hope to job seekers with criminal records

Some good news for South Africans with a criminal past. The Labour Court recently upheld the rights of individuals with criminal records to seek employment without having to worry about outdated convictions.
The court ordered an employer to reinstate an employee, ruling that the person's criminal history was irrelevant to the job requirements.

    The ruling was not rational and should be set aside. You cannot correlate the type of crime committed with the type of job being applied for. The fact that a record exists (regardless of the nature) indicates that the applicant has demonstrated the willingness to break the country's laws and there is no rational reason why an employ should have the same safety confidence in an applicant that has a record compared to another applicant who has been a law abider from birth.

    well its not a right to have a job - employers just simply just don't employ them from the start - why the f should they - just don't hire them or interview from the start- just hire someone else with reason that they are better qualified- simple - its not that hard honestly!

    The media is spreading misinformation about this recent case. The only reason the company was forced to rehire that applicant is because the company already AGREED to hire him even though he had informed them of his record. They then told him they change their minds (this is the part that is illegal). The company was allowed to reject from the start, but not allowed to agree and then later change their mind.
