I'm amazed at the number of people on DJAudits KZread channel that are praising him and encouraging him to keep doing what he's doing. It used to be that these people just stood around with a camera and filmed a building until they got someone's attention. Now they have to drag drones into it and ruin another hobby for millions, even the ones that use drones for legitimate business work.

@@taffman1 Logical fallacy. The guard approached, knowing full well that there was a flight in place and with the clear intention of interfering. DJ WAS operating in a safe manner, it was the guard who intentionally entered the area and caused a hazard. @@stuartvale2901 There is nothing in the Air Navigation Act requiring the guard to keep away, the onus in the Act is for the drone operator to fly safely, also, DJ may be in breach of ANO 241, i.e not to cause a nuisance, by continuing to fly over the property after being asked not, he could possibly be committing a nuisance, but that would be for the CAA to decide.

Interested in your opinion on this. Section 76 of the Civil Aviation Act states ‘No action shall lie in respect of trespass or in respect of nuisance, by reason only of the flight of an aircraft over any property at a height above the ground which, having regard to wind, weather and all the circumstances of the case is reasonable, or the ordinary incidents of such flight, so long as the provisions of any Air Navigation Order and of any orders under section 62 above have been duly complied with’. Now, DJ isn’t flying over - he’s hanging around filming. Therefore, in my view, he’s in breach of this act and as such is liable to civil prosecution for trespass. Certainly agree that as a business he’s subject to the GDPR regulations, and sooner or later he’ll get his backside sued. Can’t wait1

Thankfully for those of us that wish to live in a relatively free country I believe you are very wrong in your analysis. The organisations that would want to protect the rights of DJ Audits, I believe, would have bigger legal departments than those that would want him taken down. If profiting from exercising your rights becomes unlawful, then we have a lot more to worry about than DJ Audits. Companies like Google (street view) has excellent legal departments, as does all those media companies (BBC). I’ve been watching auditing videos from around the world including the UK for the past 15 years. Over that time, I’ve seen a positive change in the way the police and the courts treat public photography and data protection. The law is very simple, members of the public do not need a permit, licence or permission to take photographs or videos in a public place and the police do not have a general power to stop you from doing so. You're free to take photographs for personal and commercial use so long as you're not causing an obstruction to other person. DJ Audits owns the copyright to all his videos and is free to upload it to KZread and collect advertising revenue. This should not be confused with using someone’s image to sell or promote a product, which is clearly very different. Journalists are, to a certain extent, exempted from the application of the GDPR. Does DJ Audits video contain a message, an opinion or an idea worthwhile to be communicated to the public: that is the question? Your very video analysis of DJ Audits and this comments section would be in support of him being a journalist. I see the BBC published a story on DJ Audits when he was arrested, it has his image, full name and town of residence. The same law that protects the BBC, is the same law that protects DJ Audits. Someone distracting a drone pilot or allowing yourself to be distracted by a member of the public in a public place, may not be the fault of the person causing the disturbance. However, much like a passenger grabbing a steering wheel while you are driving, physically touching a drone pilot while they’re operating a drone, could see you being held liable for any damage that ensues. No one is taking our rights away any time soon. Journalism and public photography are here to stay. Maybe instead of funding a legal department these companies should pay their staff to attend regular public relations courses. Looking at the current price of lawyers, it would probably work out much cheaper.

DJ Audits sometimes goes too far like pushing an old guy who was just doing his job, and that’s not right. If he spoke politely, maybe things would go south. Also, when the police are doing their job being nice and speaking to audits, all the Police are doing is being nice and auditors just attacking them… allow it.

What if that person is deaf and cant hear it? Its not always as simple as it may seem from the outside. It ALWAYS the operators responsibility, just like the driver of a vehicle, the onus is on the driver/rider/pilot etc, and so it should be. Members of the public aren't in control of these machines so how can they be held responsible if the operator CHOOSES to continue to drive/fly/ride etc and harms them in any way and that includes distress or harassment etc, meaning no contact has to even be made. Just the fear of looking up and seeing a drone decending is more than enough. Most drone operators are responsible people, but it only take a few to spoil it for everyone, and most of those appear to be 'auditors' out for likes and clicks. The CAA have already begun to change what can and can't be done with regards drones, and it's only going to get worse. The Govt are being helped to erode our way of life by these types of 'auditors', which lets not forget was to see how PUBLIC money was being spent, not how members of the public or PRIVATE companies operated. Thanks to these 'auditors' our way of life is changing and not for the better, that is an unarguable fact, and that why so many people hate them. Anyone with a camera can be a 'Citizen Journalist' as DJ calls himself these days, but we dont all go around doing what he does do we tho eh. With that amount of followers it could be argued (in court) he is now a 'public figure' and as such should hold himself to a higher standard than us low life mortals, then when the judge sees his channel decides to take his freedom away, something he and any one who has any large number of followers seems to have overlooked. His 'provocation' channel should be deleted, it has little to do with 'auditing' in the real sense of the word, and never really has imo.

Yeah, but not like I’d hoped. The CAA has launched a consultation which looks likely to remove the sub250g drone exemption because of ‘privacy and safety’ concerns. That’s a real shame as even though it will stop ‘auditors’ overflying without additional training and permission being granted by the CAA it will also affect the vast majority of other drone flyers too. The whole point of this video was to highlight where I think some are already breaking the rules and we don’t need more of the rules! There’s more info on the CAA consultation on my channel

I bet when they put in a civil claim they don’t identify as auditors They manipulate and flex the interpretation of the law so their activities fit in. As for attitude well that’s a whole new conversation entirely Definitely not auditors full stop an auditor has the qualifications and authority to assess a field and whilst unannounced they identify themselves and are transparent in their purpose. This type of activity should either be illegal or they should be forced to be commercialised and subject to regulation. The most entertaining part for me is when they get told to get back in their box and they are challenged by the police. Too much disrespect for the police, security and mod of whom they would be the first to criticise if they didn’t challenge or act on a concern that could have avoided an incident.

I get it may look suspicious to companies but DJ mostly tells them what he is doing and not to worry. But what right does the owner or a worker at a company have to tell him to stop filming and say it is not allowed when clearly it is? The best thing companies can do is what someone suggested below, do not engage with him or others and the videos will not be worth watching coz that is the only reason I watch them, for the reaction and for DJ to put some of the arrogant clowns in there place and educate them. The police know this and that is why they hardly ever turn up and when they do they educate the clowns.

When quoting laws such as 'Air Navigation Order Article 241 you need to read what it says and not what you think it says. “A person must not recklessly or negligently cause or permit an aircraft to endanger any person or property”. DJ did not recklessly or negligently cause or permit, he did everything in his power to do the complete opposite. No one can foresee the actions of an idiot interfering with a lawful activity. Deliberately walking into a drone operator mid-flight is not maybe an assault, it is an assault. As for your opinion that DJ was negligent, you are entitled to your opinion even though you’re wrong. As for the dog incident, it should have been on a lead, its owner did not have control of the animal and should be held responsible for any damage caused. Again ‘in your opinion’ DJ Audits is the most hated auditor in the UK. In my opinion, he’s the best auditor in the UK and a competent drone flyer.

It seems the only logical way around this, and to limit what people like DJ Audits does, is for landowners who actively don’t want drones flying over their properties to implement geo fences around their properties. That way they can choose who does and doesn’t fly. Anything outside that fence in public areas people can fly as they wish according to the law. DJ Audits rials people for a living. There’s nothing more to it really. Other than displaying his knowledge of drone laws to security guards who aren’t as knowledgable, his videos serve no useful purpose journalistically. They know they have to engage with someone to make the video remotely watchable. They show no respect for most of the people the encounter that are just trying to do their jobs. If a factory manager says there is sensitive work going on at their premises then surely that should respected and not reply to with well im definitely going to put my drone over now, or well you should cover it up then and create privacy. Complete clowns most of these fake auditors and should be banned asap. A simple change in the law would stop this auditing,. It serves no purpose anyway.

PTTP and TLA are deluded morons. Trespassing photo baiters who haven't a clue about their true rights. They go out to annoy and antagonize people to feed their own deficient personalities. Polite auditors..!!!! When..did that happen? Auditors don't share knowledge, they share myths and fairytales, and false legalities. Watch this vid, there's a prime example - "It's a criminal offence to interrupt a drone operator" . DJ started that a few years back at Thorne in Doncaster if I remember rightly. Others picked up on it, and started using it. As usual, they don't have the intelligence to ACTUALLY check its validity before repeating it verbatim. And when you point out that they're wrong, you become a troll, hater, sausage, muppet, or whatever...I've been called them all. There IS a place for "proper" auditing, but most auditors simply use it as an anti establishment vehicle to vent their frustrations.

Solicitors have no real knowledge on drone law, unless you go to a specialist who will give an expert opinion. I don’t know what lengths auditions go to in their research, but it seems a fair few have a misunderstand like DJ does (and some of the drone community too) around the ANO article 240. I have knowledge about drones and the law around them having trained to GVC level. I feel confident the Air Navigation Order was broken in the video, and that’s my ‘expert opinion’ of course this is just an opinion until it’s tested in a court of law. The GDPR is what I’ve been led to believe from the information commissioners office

  • @markw1915

The CAA has already begun changing the rules due to 'auditors', and all of them are considered companies if earning from it. Therefore, subject to GDPR rules and regs, which they often say they aren't. DJ also collects the personal details of people to 'send them a keyring', this is in itself a GDPR issue and needs looking into further, and quickly too. Time is of the essence Mr Plod. The hate for auditors is growing daily and it wont be long before the public takes action against them, probably by a hacker putting CP on their pcs or whatever, try denying all that evidence right there on your pc DJ and that goes for the rest of the so called 'auditing' promoter crowd. It only a matter of time before our rights become even more eroded due to these idiots and the Govt are lapping it up. Not all auditors are idiots dont get me wrong, but those that are haven't thought about the long term effect of eroding our rights as citizens, something they hide behind is the 'I have the right' etc and yes currently they do, but for how long? And what right does a criminal have, esp when CP is found on their personal pcs and phones etc, things are bad enough as it is without them helping the Gov't to erode our way of life even further... all for cash and likes, hope its been worth it DJ and the like. Spending years in jail for CP and possibly tax fraud isnt my idea of a good way to earn a buck or two thats for sure. Lets not forget this 'auditing' originally began to take a closer look at how PUBLIC money was being spent, something I agree with, but when it turned into harassment and aggressive behaviour, all the usual stuff we see on social media to PRIVATE companies for likes and cash my support totally ended for them. Eroding the publics way of life wont go down well for any of them, not now, not ever, but they are blinded by fame and fortune so csnr see yhe long term implications of their abhorrent behaviour.

The main issue I have found is between 'filming' and 'publishing'. We all know it is perfectly legal to film anyone and anything in a public place with very few exceptions. However, publishing images of people without their informed consent can have problems. For example: Auditor films security guard who is on private land and has come up to him to ask why he is filming. The auditor then says "I am filming for personal use". This gives the security guard the option to then walk away. If he doesn't walk away then he has indirectly given the auditor informed consent to film him, even though the guard is on private land. If, however, the auditor then goes on to publish that film on a platform like KZread then this is not covered as 'personal use' and the guard is then able to not only have the film taken down by the rules of KZread itself, but also under UK law... both under a breach of privacy ruling. Obviously, if the auditor tells the guard that he is filming for his KZread channel then the guard again has the option of staying or walking away. If he doesn't then he has again given informed consent to not only film but to be published on KZread. So, you see, it is not the filming of people that is the burr under the saddle for auditors, it is the privacy rules and gaining informed consent.

If you don't want to make anyone's "life a hell", as you mentioned in the video, you could just have refrained from mentioning the whole thing entirely. The stupid thing here is that this auditing isn't done to prove anything or record anything interesting or of note, it's done to get a reaction and to make money on line. I've been photographing industrial sites all over the UK recording British Industry for 40 years not to make money or cause sh@t but to make a social record of the changing UK industrial landscapes. Now many of my friends have started using drones etc, but here's the thing, why would anyone want to film or photograph an innocuous uninteresting dull modern business premise on a typically boring and dull industrial estate unless of course just to cause an issue... genuinely interested folk such as myself know there is nowt to film of any real interest there so wouldn't waste the camera battery let alone a drone flight, now some ginormous chemical plant, opencast mine, quarry, steelworks etc etc its a different matter. I've had run ins a plenty with misinformed security people over the years who wrongly think they can tell me what I can and can't do in public with a camera, and I will argue until the cows come home as I believe our right to photograph has never been more threatened, these situations usually sort themselves out by remaining calm and explaining, mostly they never develop as there's a stand off, and in 40 years I guess I've had police interaction probably 10 times which has always gone the same way... nothing to talk about here!!! The problem with all these so called 'interested auditors' that actually don't give a flying doodah for the subject is that they'll screw it up for everyone as it will force a law change over drone flying or street photography, they won't care as they'll move onto the next attention seeking project leaving those of us with a genuine interest screwed over by the position they created to get extra 'likes'. If someone is genuinely interested in flying over a company with a drone/photographing stuff they should just do it as not illegal in public (as long as its non restricted air space or a restricted area in law), don't go out the way to cause anxt by trying to be clever and creating a situation by inviting trouble before you start by walking up and announcing yourself, if you get challenged during or after just give your point of view and walk away, trying to give people a lecture who don't understand the law on drones or photography achieves nothing especially if you just spent 40 mins being clever. Better to seek forgiveness than approval!!! Just as an aside I've also been approached many a time and been asked what I was doing resulting in a very friendly invite to come in and see the factory, or to be able to go back with friends for an official tour.... its called being pleasant and genuinely interested.

I showed em the pic and said gimme an email and I'll send you a copy.... we also had a great chat about the works.... I ended up mailing the pic and got an invite from their factory for a visit... result. I've had run ins with security threatening police at powerstations too, again I'll politely argue and walk away but because its deescalated I've never had anyone trying to lay hands on me... I just don't see a need to ever ask permission if I'm sure its within the law, if they choose to argue then thats all it is an argument... not a fight, not a police issue just a disagreement...

It's only a matter of time before there's a big incident and someone actually gets really hurt. It could be a drone losing power and dropping onto the head of a forklift driver, it could be an all out brawl between a group of auditors and employees on a site, it could be a drone pilot physically getting seriously injured while on private property and an ensuing legal battle. But one way or the other, something will go very wrong and it'll finally attract the attention of legislators. And we can only hope the legislation is tightened up significantly to protect the rights of business owners, and not just these public nuisances on the streets. The current laws are ludicrous. And anyone who tries to be 'chummy' with these guys, just because of social media, is a fool. They need to be rebuked and shut down at every opportunity. They're clearly just making money off views by going around upsetting people, disrupting businesses, and eliciting confrontations, under the guise of "educating people about drone and public photography laws". And on top of that they behave as if they're untouchable. They're self-entitled, rude, arrogant, condescending, public nuisances. They absolutely give the drone flying community a bad name.
