Intentionally Underemployed? No Problem (Continued)

Stephen appears in court after being served with the court paperwork. He did not take the DNA test as ordered and did not bring any proof of income or documentation of his school enrollment. Stephen just didn't care. What does this mean for Christle getting child support?

You guys mad at the Judge ! When the guy intentionally didn't show up for the DNA and also quit a good playing job when the baby was born. I totally agree with the judges choice. He's a deadbeat person.

100%. If a father refuses to take a DNA test when he is ordered to by the court then the court goes by what the mom says. The mom said there wasn't anyone else who could've been the father so that means he's the father. People don't seem to get that when you make a statement in court that the other party has to prove you wrong. If he had taken the DNA test and it came back negative, that would've been proof. If he had provided proof that she was with other men, that would've been proof. He didn't do that so the judge can go by what is being said by the mom. And she's right that it's suspicious that the child is 5 months old and 4 months ago is when he went down to a much-less paying job. He's doing that on purpose so he pays no or less child support. Don't ever underemploy yourself because not only will the judge refuse to use the lesser amount but now you don't have the extra income to be able to pay the higher amount. It's a stupid move. His biggest mistake was not showing up to the first appearance. He would've had more leeway if he had done that. But he's obviously trying to avoid his obligation.

He didn't get tested because he knew he could be the father. He was thinking "if there ain't proof, then they can't say it's mine". That ain't how this works, sweet pea.😂

Philip Marz He has to put in $1,200 put she probably barely makes that. It’s always on the man to be responsible but put a woman on child support and she doesn’t pay no problem. If a woman can’t support a child by herself then she has no business having a child. Women have way too many options not to have for them to be getting pregnant. A man doesn’t have to have sex with a woman, she just has to obtain his seed. So that whole it takes two to tango is bull. In fact he doesn’t have to have relations with that man at all. Then you have the fact that you are married to a woman and she gets pregnant by some other guy and you still get named the dad even with DNA. No woman is ever forced to work but a man is. Even if a woman has 10 different baby daddies she still has no requirements to work. And people say slavery doesn’t exist.

@@jasonfelton7883 a woman shouldn’t have to take care of a child by herself though. Unless she conceived through a sperm donor and chose that for herself, it’s the father’s responsibility to also help raise the child. A lot of women who are on assistance, aren’t getting a fair amount of help (or any at all) from the father of their children. Also, if you think the state will just let somebody stay home without working and receive assistance long term, then you’ve clearly been drinking the sour koolaid. Every state is different, but I know for many of them, you have to at least be working part time and meet other criteria to qualify, unless you have a disability or something that genuinely prevents you from working. Yes, some ppl do fraud, but those are far and few between and they eventually get caught and sentenced to prison for it. The vast majority of ppl on welfare are working class Americans who have jobs, but simply can’t afford to make ends meet because we live in an ass backwards world.

Code § 154.066(a) states that if you are INTENTIONALLY underemployed/unemployed to evade child support you can and will be charged your earning potential and or what you made at your previous higher paying job. Courts have and will continue to enforce this law, as it is a valid law. Nothing fake about it, you really should delete your comment to avoid further embarrassment. You're actually incorrect. It has nothing to do with her personal feelings. There was a previous episode to this where he didn't show up at all. In that episode the mom specifically said that he was the father and there was no possibility of anyone else. When you make a statement in a court of law, the other party has to prove you wrong. His opportunity to do that was the DNA test and he refused to take it. Without proof that he's not the father, the court goes by what is stated. As for the income, HE stated what his income was both when he made more money and now. The timing is convenient because his child was born 5 months prior to this video and 4 months prior to the video he left his high-paying job for a lower one. Judges are allowed to infer that he is voluntarily underemployed in order to avoid paying child support. This is further supported by the fact that he is avoiding finding out if he is the father. He never gave a reason on why he quit. If he had another legitimate reason for quitting, why wouldn't he say so? Because he knows that he did it to avoid paying child support. And when it comes to child support, no it is not his decision. Your decisions cannot negatively affect another human being. Otherwise, a person could kill another person and not be punished for it because it was their decision to do so. Judges make decisions for people all the time. It's ludicrous to say that it's not the judge's decision. She has the right to make a judgment based on the information she is given. And she did. Just because it's not a decision he (or you) likes doesn't mean she can't make that decision. The law gives her the right to.

Absolutely you can. Otherwise people would get underemployed all the time in order to avoid paying child support. That law was important for custodial parents who had deadbeat non-custodial parents who tried to cheat them out of paying for their children. If a person has the ability to make more money than they do and don't have a legitimate reason not to, then absolutely the courts can make you pay the higher amount. And he's responsible for the child's entire medical because it's one of the few expenses that are mandatory in the US. A lot of custodial parents don't get even half of what they spend on their children due to child support being tied to income and not to the actual expenses paid out. The courts give the custodial parent a break because first of all they often don't get enough from the non-custodial parents even with child support. And also because their emotional and psychological health suffers having to be mostly responsible for the child and they always have higher levels of stress. It has to do with that if the expenses become too high for the custodial parent at the very least the health insurance will get paid by the non-custodial parent.

Incorrect. I had 3 part-time jobs while I was in full-time college. It's difficult but not impossible. There are many students with full-time jobs. You're only in school for roughly 3-4 years. You suffer a little for those years before making a lot of money. Non-custodial parents don't have the excuse that they have to watch a kid on top of all of that. A lot of custodial parents work jobs at the same time as raising their child. And that's for 18 years, not 3-4 years. Anyone who claims they can't work full-time because they're in school is either lazy or trying to avoid paying for something.

That is not out of spite. He was given a month to take a dna test and refused to take it therefor he is automatically deemed the father. They are presumed the father because they are dodging efforts to be named/proven to be the father therefor the presumption is that they know they are the father and are trying to avoid child support. It's a default judgement. The lesson is follow court orders and show up to court when you are served. He clearly and unequivocally said he did not take it because he could not be bothered. Dude is the most unprepared for court I've ever seen. You can tell he thinks he's the father by his actions. Doesn't show up for DNA testing and intentionally went to a lower paying job to pay less. Peice of work he is

First I want to start off by saying I love this judge.. I love the show love it. when she puts them in their place. That is exactly what he did quit his job. Just so he wouldn't have to pay that much child support. My sister went through the same crap with her first husband. He was an engineer on a dredge. And he made great money and of course the more money you make the more child support you're going to have to pay. But the sad part about their situation is he had somebody through the court system they knew their whole family and he done some fragical activities and lied and said that he wasn't no longer working at one point when he truly was. But nevertheless the reason this gentleman done that was because he didn't want to have to pay her child support that's why a lot of people do that don't want to pay. And at the end of the day that is sad as hell specially if that's truly your blood child you should want nothing but the best for your child regardless if you're with the mother or the father. But we all know what he done in this case. I hope that lady and her child are doing great.

Spoiler he shoots her in the face. Equal rights til she wants to keep a baby he doesn't, and now he has to pay to raise a crotch goblin he didn't even want with a female who was obviously looking for a check after a month of the baby being born and doing it alone. You know alone like making the choice to keep a kid a partner didn't want. Good job judge, I'm sure you require her to show the money is being used on the child and not nails. Oh wait probably not

What? Sounding like a male in your comment that is not very well educated in the Game of Life. When you make a baby, take a DNA test then pay support. That baby might be yours for 18 years to life. Don't want to make a baby, abstain from the sex. Easy peasy.

Refuse all you want, until the child support bureau takes it from your paycheck, plus arrears until back child support is satisfied. Even your income tax gets hooked for the arrears. Some states even jail you for contempt. Lol

@@trekgirl65 True. It's 21 in most states if the child goes to college from high school. It ends if the kid drops out of school, becomes emancipated, or decides on not going to college. I heard it can even be up to 24, but under special circumstances.
