No Change? No Child Support.

Mr. Thornton returns to the show after he and his ex-wife Maria agree in mediation to no child support. The child is getting in trouble and Mr. Thornton wants Maria to pay child support to pay for the child's legal fees. Will the Court order Maria to pay?

    I'm not even sure he can do that. He has to have a reason for why he's suing her for that. His son getting into trouble has nothing to do with the mom because she has no authority over him. That's the thing when you're the custodial parent. You take on the responsibilities of the child. It's his own fault that he never got child support before. Now he has to prove that there's a change in the financial circumstances. If his son is being a criminal that's on him. He has to do something about that or he should've raised him better. It's harsh but it's true. A lot of kids that turn out bad do so because of problems at home. I won't say there isn't the odd little psychopath but most likely if his son is doing these things it's because there's something he's upset about. The best he can do for him is to take him to therapy to deal with whatever is causing him to be like this. There are a number of different supports that can help with a problematic child.

    Mediation - they came to an agreement that no child support is needed .. if both agree and sign mediation doc ..it's powerful and can't be changed that easily

    @@bharathcool414 he just has to take her to civil court and charge for have the cost of damages it’s mot child support so nothing to do with her paying anything on going but as a parent even if the child does not reside with you if you have moved interstate and canceled her side of the health insurance she can be sued for part of the cost of damages and liability’s as she is still the parent of the child and the judge can make a decision with the circumstances taken into account the child is being a dropkick and any mother who moves interstate and stops paying health insurance for there child is a piece of shit in my opinion anyway :)

    That wasn't her choice though. It's not her fault that insurance companies won't cross state lines. Also, the child was double insured. Now he's just regularly insured. It doesn't make a material difference in the long run.

    Mom Quitting her job and Moving out of state and dropping the kid from her insurance is Atleast 2 different changes that you mentioned. She most likely has a different job potentially making a different amount than she was making previously. I know these are skits and I LOVE watching the you!! You are amazing!!     Technically she didn't drop the kid from her insurance. You can't insure a child across state lines. And the rest is conjecture. You don't know that she's making a different amount. The problem is that Judge Vonda can only practice Texas law. And the original agreement was made in Texas. It's always the originating state that has jurisdiction. Which means that the original agreement stays in place. The original agreement in this case was for him to not receive child support. In order for that to change he has to get her to agree to it. And no one in their right mind will agree to that. So there's really nothing that Judge Vonda could've done differently.

    @@joannstonebarger3545 Neither of those would make a difference. She didn't choose not to pay insurance. Insurance did that. And not seeing her son would work against him in this case because why should she have to pay for a son she doesn't see? Even so, he's the one who agreed not to receive child support. This could've easily gone in the opposite direction. If she moved and was paying child support, moving would not be a reason to change the order because it goes by the agreement in the originating state. He screwed himself over by agreeing to that. He should've been smarter.

    She said at the end of the video that for him to receive child support one of the things was that the other parent of the child would had to have relocated and that was considered a substantial change but when he tells her that she moved away then she says there’s no changes that can help him receive help. This case made no sense to me. And that poor man looked like he was going to cry because he is struggling with everything he’s going through with his child.

    But by law she is required to carry insurance on him court ordered. I went through the court hearings they required both of us to have insurance at all times. When it’s court ordered no matter if you lose your job you still have to carry insurance on that boy.

    Sounds like a lot of things changed!!! She isn’t taking care of son anymore. She left the State and stopped Insurance on Son. Her income has changed. She isn’t helping with court costs. So he needs to go back to court and demand she pay child support and 1/2 insurance and 1/2 court costs, and 1/2 property destruction costs.

    Uh uh no this was a terrible ruling. The needs of the child changed. Legal fees, medical bills, debt from debt manages are material changes. He said that he was probably going to be dropped from his insurance and some the mom left the state that child could now be uninsured. This was NOT in the best interest of the child judge I’m very disappointed.

    So moms loss of insurance in the dual insurance agreement and medical expenses arent significant changes the same as simple chid support. So in retrospect, mediation was a farce in this instance. No discussion of what happens if 1 parent drops or loses insurance thats agreed upon or expenses of medical bills. It sounds like he should be able to sue her for half in civil court. On one hand, this clearly illustrates the pitfalls of a mediation agreement. On the other it reveals that cooperation isnt always the best to protect ones future legal situation. One would think mediation would discuss violations of any pending agreement and how it would affect the child to protect the child once such an agreement is in place. The mom gets to skip town and skip out of her agreement to have insurance. Not surprised.

    You said that something in mums income would to have changed but I thought he said that the mum quit her job and moved overstates. Would that not be a change in income thus allowing him to file for child support? Maybe I’m confused though 😂

    It's such a shame that he's having to bear all the issues and debts yet the mother gets away with it all, surely she should be responsible for half of the debts being the child's mother!

    I must be missing something, the boy now lives with Dad, Mom hit the road. Why does Mom not have to help support the child and be responsible for his expenses?

    Some times this show confuses me. Why not a parent come back and say “ I want child support now” why mom is not responsible for this bills.? Isn’t it an expense? So hospital bill is not an expense, but basketball is?

    Just because you don’t put the other parent on child support doesn’t mean you can’t do that later though, so I’m confused. I agreed to no court ordered child support and then when my ex husband didn’t keep his end of our personal arrangement, I went back to court and the judge ordered it. So I don’t understand why here it’s like “well a few years ago you said no child support” so is the dad just screwed because he tried parenting with no financial help from the other parent before it got too overwhelming? Is this a TX law? That’s unfortunate

    The mom not liable for her parenting is irresponsible! She moving out of state so she won't be contacted for financial assistance for child support, dad should be able to alter the agreement if the child is still under 18. That's awful, putting all financial burden onto one parent!

    There's a whole lot of changes that occurred though... I'm not understanding. The mom moved out of state and left the kid with the dad, AND he is getting into trouble. THAT in and of itself proves his son has changes in his mental health for the worse. He needs help. This dad needs help.

    This was a weird ruling , the mom moved away and took her child out of her insurance … Bot only that , the kid is a criminal yes , but as a result the dad’s bills have increased … BECAUSE of the child that he needs to SUPPORT financially in order for him to rob around.

    I agree with most of your cases, you are great! And I love the show! But I think you missed on this one judge There clearly has been several substantial changes. From relocation of the mother, half of the (double) insurance is no longer in place, and now there is a substantial monetary change concerning the incident with the police and subsequent damages. The mother should also be on the hook, if the father is being held accountable for those damages.

    Great question. By law, parents split the uninsured medical expenses. That has nothing to do with child support.

    something did change - the kid resides in jail now. what would have happened if something happened to the kid requiring constant medical attention, etc?
