Finally, a citizen pointed out (after being initially challenged) that *you DON'T have to be under arrest* to then be magically "awarded" the right to remain silent, per 5th Amendment. Normally, when a cops says "No, you have to be under arrest for that" that just blows citizens' minds and completely derails their argument. ...Police learn and accumulate those tricks, BTW. They learn which line of script shuts people down, and they add it to their verbal tool bag. Now this cop has finally encountered, probably for the first time ever, someone with the wherewithal to swat down his silly line about how breaking laws is what wins your Fifth Amendment rights.

I don’t answer questions because there’s a 5th amendment saying I don’t have to.. Not sure why you think a charge has to be made before rights are invoked.

This guy messed up this encounter, and is lucky he didn't end up in jail. Saying "I don't answer questions" is not invoking your fifth amendment right, and the supreme court has ruled that cops can use this as evidence that the suspect is hiding information from them. He also invoked his fifth amendment right, then kept chatting with the cops. The supreme court has ruled that if you invoke your fifth, but then continue talking with cops, it changes the encounter back to a consensual conversation, and nullified your invoking the fifth.

If you're on a walking trail how do you keep from not following someone ahead of you on the trail ? Oh, wait I know you have to always run ahead of everyone else so no one can accuse you of following them.

I don't know why he comments on the name. The person the vehicle is registered to doesn't necessarily have to be him, he could have borrowed it. They can't be sure it is his identity.

You would expect them to describe the person standing in front of them, but that doesn't mean it wasn't a similar person belonging to one of the other vehicles who's tag they don't seem to want to run, just because you are the only person there when they arrive doesn't make it you, the lack of real "investigation" is ridiculous.I wouldn't let them take a picture, you aren't being charged so they don't need a mugshot for their records.

It would take 5 minutes to clear this up with the accuser and a picture. All else is a BS waste of time.

They didn’t identify you. They just identified the truck owner. You may not be the truck owner. They don’t know who you are. Don’t say you’re the same person as the owner of the truck. You may be the truck owners brother. You may be the truck owners best friend who let you borrow his truck. Just because they identify an owner of a vehicle doesn’t necessarily mean the driver of that vehicle is the owner of that vehicle so they have not obtained your identification. So never admit to your ID unless you are under arrest.
