How to win Civil Appeals
(This is NOT the same as the Federal Court Leave Application. This is different.
This is PURE APPEAL TECHNIQUE).
Are there sure-fire techniques that make it easier to succeed in Civil Appeals? Yes, there are.
If appellate counsel don’t practise the Rules of Minimalism, Detachment, or do not ask the right Questions of Law, they will fail.
If they burden an appeal court with a blunderbuss, they will fail - because they shoot at every target, with everything they have.
Here are some techniques that might give you a shot in the arm.

    I always re listen to this video with excellent tips and reminder whenever an appeal is coming up. Thank you Sir GK! By the way, is there more videos on the topic of How to Resist an Appeal? Sometimes we have a good case but unfortunately the judgement was not well written. And if the Appellant raises like 20 grounds of appeal, do we have to deal with each and everyone of them in our written submission? Some grounds, or I say mostly, are ‘boiler plate’ grounds

    Yes, they will work there too. Not only there but the entire British Commonwealth of 50 over countries. The Malaysian model is entirely based on the common law system. The UK and the US follow the common system very closely.

    I am filing and appeal on a civil matter and I was wondering if I should keep the brief short and concise. My brief is 98 words I was thinking the judges don't want to read and entire book before you get to the point. Your examples are excellent thanks for the video!

    I have a situation here I am buying a house and hire a lawyer for the memorandum of transfer process. In which after all the restrictions is released by the seller , the lawyer have 90 days to prepare and submit all the documents for bank (I am doing loan) to release all the payment to the seller. However, the lawyer failed to prepare and submit the documents within the stipulated time. As results, I need to pay late interest fee for every single day that are late. In this case is the lawyer is considered as misconduct? Can I sue the lawyer for negligence bcs she failed to meet the deadline? Please help.

    Hi. We are not allowed to practice in those jurisdiction. To the extent that these nations implement common law systems, we may be able to render advise only. Even then you have to double check that with a qualified advocate in your country so that you have a sound bearing on what course of action you have to take. Good luck. We hope you succeed.     great techniques .. best ever ,, 1. now how do i amend my statement of claim to reflect the loss of my home and rental income in order to regain them both back ? at the time the mortgage was us dollars $ 145,000.00 in 2008 in 2017 it was 350,000.00 being unable to work from spinal stenosis neck injuries and back injuries . 2. how do i amend $120,000.00 dollars of 4 lost life insurance payments to my statement of claim since the accident in a personal injury claim to recover my lost premiums after being unable to work and keep up the insurance policies.

    It depends on Civil Procedure of your state: you also need to study the insurance policy terms and see if there are clauses that can save the policy. If you are in doubt whether an item is claimable, plead and file. Later on you can either discard or embellish your pleadings. But you can’t spring a surprise an opponent with it. I suggest you talk to an attorney. And best of luck, Mr. Ferguson.

    Thank you for posting your Wisdom of Court Stratgies, it is Food beyond Thoights; I am using your Strategies, as I appeal in Small Claims Court by Submitting an SC108 form due to Procedure Error. I am the plaintiff as a Tenant against my ex landlord. She never gave me my $2500 Deposit back, neither in 21 days by law did I ever receive an itemized statement of any deduction, if any for damages. The Pro Tem Attorney ( lawyer) ruled on her behalf, unconstitutionally. This time I'm going to see a real Judgej. My Question to you is. Is a Declaration the same thing as a brief?
