Hotel owes my buddy money!

local hotel has a lift station they need pumped, but they owe my mentor $1000.00. I give them some grumpy terms, let's see if they take it.

    People fail to realize, just because 2 businesses are competitors, doesn't mean they don't talk or are even friends. Small business's talk to each other. You try to screw one over, all the others will know about it

    I work in HVAC and its basically the same thing. We are all in competition but we all know each other pretty well, if you don't pay your bills the word gets around pretty quick.

    Even more then that, with contracting jobs like this, with emergency call outs. There can be times when you are just TOO BUSY and you will throw work to your competitor. Because you know that later on the shoe will be on the other foot an they will throw some extra work to you.

    @@Zombiezrp Ya pretty much the same but they are not all on a discord, they call or email each other . The bosses also refer customers to each other for certain systems that one company specializes in more than others (hydronics, geothermal, large commercial refrigeration)

    Back in the day we did diesel repair work in the oil field and a lot of the major oil companies were known for 90 days before they would pay you. Chevron called us out one time for a rig that wouldn't start. We explained to them out front it would be cash as soon as we started the rig and they agreed. 2:00 a.m. we go out start the rig which is costing him thousands of dollars per hour in downtime. Wrote a bill for $300 and told the drill boss that we needed to check. He laughed at us and said good luck. I walked out walked over to the engine cracked a fuel line and let that Detroit suck some air in. That's all that had been wrong previously they'd run it out of fuel and Detroit's won't prime themselves so I basically put it right back the way it was. I thought the man was going to spit nails when we started to get back in the truck. He asked me what it was going to take to get it started and I explained to him he needed to add $100 to the bill I'd already given him and I would go restart it again. But this time I wasn't starting it until he had a check laying on the seat of my truck. He finally wrote the check and I started it and left. I knew if I had a check I would be good because the state I was in had some pretty strict laws on stopping payment on a legitimate debt. Lord I hated working for those big companies it was always a problem

    I've worked for companies like that before, usually 45 days to get paid. One stretched it to 90 days one time so the next repair price was doubled and took twice as long to complete. One of their big wigs decided to get involved to find out why the same repairs were costing twice as much, I told him if I had to wait twice as long to get paid, then he was getting billed for my time one way or another. From then on they had a check ready for me before I even started.

    Like SO MANY times, the richer guys are VERY OFTEN the rotten mongrels. If you ever heard about suppliers to General Electric.... they had INSANE requirements and then would screw you FOR MONTHS on payment. Burnt most of their suppliers FOR NOTHING really.

    I service septic tanks. It's my responsibilityy to bring all the equipment inside the tanks and the lids up to code prior to the transfer of ownership when a house sells. There's often a large amount of money in escrow waiting to pay all the contractors but unfortunately sometimes the money runs out before everyone gets paid. We now only work when someone is present that can write a check when my work is complete. If no one shows up then I have a short workday.

    Similar problem at my print shop. A tool manufacturer changed their policy to not pay any supplier for ninety days! We still had to pay for the paper and ink. Nothing much we could do, they were an otherwise reliable customer, and these were easy jobs that were pretty much nothing in terms of labor.

Edit - My thought process here is, he should be charging a storage fee for the pumps, because he's storing them in HIS warehouse. Repeat business isn't the problem here, because no one else will work for this hotel, and do this job. In fact, Mr. Butler could easily charge a storage fee, because he knows that some other local septic companies, are currently owed money from this hotel, and even if they got the money, they wouldn't risk that loss again.     If the pumps are easy to reuse or resell near purchase price; maybe write into the contract a void or forfeiture clause so the 5k in pumps are also collateral. (Not legal advice :)

    They burnt your friend given the chance they'll burn you too. Walk away now. Let them find someone from out of town. I had a guy call me from out of town. I recognized his name and refused. He asked why. I explained I've been to his twice before working for two different contractors and you still owe both of them money. One a couple hundred, one six thousand. He lives in a gated community with a golf course and riding stables. He is a doctor. He's not someone down on his luck. He chose not to pay his bills and that's how he rolls.

    @@roscoeshepard : simple thing to do. Go to small claims court and put a lien on his property. Unfortunately, the contractor is out his time. The lien is the big thing. A lot of things stop until that’s cleared. Usually no new loans even potential wage garnishment.

    A couple of months ago, My employer asked me to pick up a supply item from another company in another city, so I drove to the supply company to pick up the part arrived and said I was here to pick up X part for my employer and asked if I needed to sign anything for their carbon copy receipt, their part employee said I didn't need to sign anything as my employer has always paid their bill and is in good standing. That definitely made me glad to work for my employer!!

    I would explain to him about the pumps. Have him pay for the backup pumps and keep them at his property in case they are needed. I had my own business for 40 years and simply refused to work for shady people. But it's your call. There's a reason no one else will work for this guy. Good luck

    Hopefully he pays his former service company the $1000 and they will work with him. Knowing how business works, as long as it is cash on the barrel head and the debt is paid the old company would probably work with him. As James said, this work isn't something he usually does and doesn't seem to mind if they don't contract with his company. The hotel would be better served paying their bills and using a company that does this work routinely and would keep the pumps in stock anyway. If they are running up bills like that and not paying them the hotel is about to close and fail anyway, as a retired accounting professor and consultant that knows how this works I have heard about stories like this time and time again.

    Worked for a waste water treatment facility for 3 years, we were over lift stations for several different businesses. Out of all of them McDonald's was the worst for grease. Pumps were pulled almost weekly. Would honestly like to exchange some stories sometime with you if have the time

    The thing is, James is pragmatic. He’ll respect you and you best respect him. Almost all of us are like that. Damage that trust and it’s gonna cost you. The other thing is, there are some people you think you can screw with. The person that removes waste from your location is not one of them.

    Two words brother. "dedicated" and "stock". They can buy the pumps up front and you will store them at your shop without even charging a storage fee. Because you're awesome and that's how you service a customer.

    Your right I live in England and own my own business delivering stuff for other companies and I've found its usually the bigger companies that make it hard to get your money or refuse to pay you for work you've already done I'm in the middle of a court battle with a very big company over here in the UK cause they owe me close to £10,000 will probably be closer to £15,000 after lawyer fees and court costs hopefully when I win they have to pay for that as well I'm only doing it just to show they can't keep fucking with smaller companies cause there's loads of others who can't afford to take them to court over it there's me and another 2 people that are involved in the court ive helped them out by paying for it and they'll pay me back when we win which we will I can honestly say I didnt do anything wrong when I did the jobs I'm literally paid to pick stuff up and drop it off somewhere else nothing was broken or damaged they just think cause a lot of smaller businesses don't have the money to take them to court they can do as they please but they fucked with the wrong one this time

    Here in Australia, the government ones are the GOOD ones because they ALWAYS pay. It's on their 90 day thing regardless of how your business runs but they ALWAYS pay.

    I'm in commerical HVAC and we have a couple customers who know they have some older water source heat pumps and if a compressor dies it's better to replace the unit. They are being proactive about it because it is time critical to change a bad unit. They paid for us to keep some units and materials stocked ready for them if they need it. It is so nice working with someone who values being prepared and having a good relationship with their contractors because it effects their bottom line when things go wrong.

    We do the same thing in IT Infrastructure Management; we buy spares to swap into a production environment when their Server/PC/Printer/Wifi, etc fails physically. Customers just don't get it when you want $10K to begin working when them. Good on you for doing it this way!

    I’ve seen some comments suggesting this customer should hold the pumps on site, which sounds like a good idea, except I have a feeling that this customer is so tight for capital that they would go “missing”. Then they’d still be expecting the broken pump be replaced “right now”.

    If the customer purchases the pump and then hocks it off for some spare cash, then if the pump is needed - it is a HOTEL OWNER issue!!!! . If you turn up and the pump has been hocked off, then wish them a nice day and ask them to get back when the pump has arrived. . If they scream that the pump be replaced "right now" then just become another company that will not deal with them. . SO - Request that the hotel purchases and stores the spare pumps on their property. If the pump ever requires replacement then stock is at hand. If you lose the client then you will not be stuck with the pumps. The pumps are an important requirement of THEIR business. They need the pumps to be ready to be used. You do not need this client. Demand CASH. This client is not to be trusted,.

    Could offer to let him hold his own spare pumps/parts. As a homeowner who's basement is always wet, I keep a spare submersible pump for my sump system on hand at all times.

    That is better for every one in the end. He knows where the pumps are. No need to transport them when there is a problem. Faster repair times. Him keeping the parts on site is a win-win for everyone.

    Consigned parts are normal with many companies. Normally, that means you buy it and keep it on hand, they pay if they use it. With these payments issues, you should have them buy the pumps, and buy new ones when they get used. Plus get a lawyer to draw up an iron clad contract

    IMO, James did the right thing - cash up front, plus, perhaps a premium fee. Reminds me of my wife’s story when she worked at an accounting firm. And like James said, small companies talk to each other. The story: new client calls and wants to switch accounting firms. A call is made to their old firm and, yep, a dead beat customer. My wife’s firm quotes a higher price because they really don’t want to deal with this client. Point being the higher cost is because we really don’t want to deal with you but if you want to pay that amount, ok. This happens more than some people realize. Morale of the story: treat people nice and pay your bills on time and your life will go easier.

    Lift station maintenance is expensive. I used to do it for an EPA compliance agency. A deposit of half the cost of the lift station with a minimum to replace 1 pump, 1float and halft the circuit box was required to even open a contract.

    I once had a customer that had me purchase new locks, special keys, did all this work, and he left before I got finished to pay. I left a bill but, long story short 3 years and no payment. This year I get a call to rekey a building and the name was sounding alarms in my brain. It finally clicked it was that guy. (Hes an investment banker so he isn't exactly broke) So I show up and as he walks me through, I get his quote together and he's blown away at the cost. I show him the previous invoice and all my emails trying to collect and let him know it also includes the previous balance. His new office is set to open the next morning so he REALLY needs it done right away and I let him know I won't touch a thing without being paid in full. It took me 3 years but I finally got my only overdue account settled. I took myself to a steak dinner to celebrate that day. I absolutely get why you're doing it this way! I have other Locksmith friends and in your situation, I'd likely do the very same thing. Small businesses need to stick together!

    My worst customer ever , as far as getting paid, was a doctor. I always had the "chase the money ". I finally charged extra and then eventually quit working for him. I have customers that are poor and they always pay me. It just goes to show that just because you have a wealthy client, they aren't always reliable when it comes to their money. (Electrician)

    The poor people know how hard it is when you don't get paid. For the rich people, at worst it's a mild inconvenience. As someone who's worked tipped jobs, poor people generally tip heavily while rich people often don't at all.

    I used to work for a sewer cleaner that did municipal services. we did all the water and sewer maintenance for a township they had 12 lift stations. every lift station had a different pump and they weren't compatible. The price is ranged from $1,200 a pump to $7,000 a pump it took us 5 years to switch them over to the same pump. Each one of those pumps was $3,500 we had to have four of them in the warehouse.

    My dad owned an electric motor sales and repair business when I was a kid. He had a really good business as we lived in a farming area that also had some industries. Dad often did work for other businesses and then mail them an invoice. He had done several hundred dollars in work for one farm that raised beef cattle, butchered, packed, and sold their own beef. After months of getting the run around from the business and not receiving payment he came up with a solution. Dad called them from home and ordered a lot of beef and had it delivered to the house. When the delivery person presented dad with the bill, dad handed him the invoice for what they owed him. Dad wrote on his invoice to them, paid in full with beef. I'll never forget what he told the delivery person, if his boss had a problem with it to feel free to call, and in the future call another company for their electric motor problems. We ate some fine cuts of meat for a long time.

    Asking for money upfront is fine but you have to warn the customer of possible extra bills. Also, good thing you have the option to refuse.

    That would be a CASH only and upfront agreement in writing, WITH a stipulation that two months costs will be owed and the pumps are your property if they break contract.

    Be thankful you can know to avoid him as a customer. When you make a customer go on pre-pay for a good reason, you're better off when they don't want you to do the job.

    Thats how business works. I used to make to deliveries to butchers and fast food restaurants . We had to get cash on delivery because of credit risk.

    That's completely reasonable. They should cover the backup pumps and paying your buddy off before you will do anything. It makes complete sense to me, I'd do the same thing :)

    ive wired up a few of these . they were called blenders. i always called them poopy grinders. these would mix water and poop and pump it up to the sewer. good stuff.

    Don't forget they all do training courses and seminars together they get to know each other some of them have work together some of them just went to classes together when you're in an industry long enough you get to know people

    It’s just like in my business…I’m a nurse case manager at a hospital. If we try to place someone at a nursing home, they call us and say Mr. Jones owes ABC nursing home $10,000. If he wants to come here, he will need to give us a deposit before we can take him. They all talk to each other. If you or your family is a pain in the ass, every other facility will know about it.

    Yes sir exactly! It is a HOTEL..and they aren't PAYING. I'm not stereotyping. In fact I said nothing like that did I?! Lol! There is definitely a cultural aspect to them not paying. I had performed work for a customer. He watched me perform the entire repair. I have no problem with that. I showed the issue, fixed the problem, but then his dad's shows up and says 'it's not working'. I tried to show the guy how to operate the machine but he then went on to change settings and run it then complain it wasn't working. I had already given the son the bad part, tested it to show it was malfunctioning, and new one installed?! I already knew what to expect so I had already collected first. The dad stopped arguing when he found out I had collected first! LOL! Some are the kindest but some do look down on blue collar workers/work. Some will argue the price AFTER the job or just not pay you sometimes. I learned this working for a much larger company in the past in the big city. I told ....this type....of business the last business owner that, 'I collect first' . He said, 'why do you collect first do you have a problem with people paying you'. I said, 'no because we collect first'.lol!

    I've done work for hotels, they usually have terrible money management. Only 1 that I've done work with I continue to do work with. The others, I cancelled contracts due to non payment.

    This sounds more trouble than it’s worth. Make sure you are paid upfront for everything and paid generously. Maybe you should ring round all your competitors and ask them if they are owed money by this hotel. And then make it a condition that they are all paid in full, plus late fees, before you will touch it.

    Lemoine, based out of Louisiana, can be a bit like this at times. They love to compile tedious checklists in order to delay and/or reduce the payments they owe to outsourced construction outfits. I can understand that, but it's honestly their lack of initiative/work ethic that annoys me. They milk jobs and work about as fast as any State Department does. (ie: THEY'RE SLOW AF)

    Check into a Mechanics lien. It is used if work on a property is not paid. It attaches to the property. Whenever the owner decides to get financing, the lien shows on title and has to be paid.

    There is also getting a state court judgement, doing till taps and bank account garnishments, seizing assets like cars, expensive office equipment, at least for hotels probably beds, televisions, other miscellaneous furniture and whatever else valuable that (in Michigan) the process server can find (there may be other names for the people in other states) and in rare cases even teaming up with other creditors and forcing a bankruptcy in federal court (that option is rarely productive but in rare cases if the amount is ridiculously high it is an option -- your company and other debtors may end up with possession of the business out of the deal, though). Note that I am from the United States, laws are different in other jurisdictions -- even Canada has different laws.

    I do large commercial HVAC work for a big theatre company. We have our own mini warehouse of compressors, motors, and other common parts for the trade. Nothing like having immediate access to parts.

    That hotel is desperate, they have screwed over everybody that was gonna work with them in good faith and now they only have left people that are going to protect themselves first cause they know that the business has already screwed over two of their other competitors.

    My father was the general manager of the local lumberyard, and I worked Saturday and summers. There was one contractor who is building a new subdivision, and like your personal man stiffed several other companies. My father said I was to go with the driver with his load of lumber. I was to stop at the office. I was to go in while the driver stood with the truck and tell them we need cash or we will be will not deliver the lumber. The contractor in the office was really mad and said well what are you gonna do with it and that’s it. I was told to take it back to the yard and unload the truck. Which we did. I don’t know where they got his number but it wasn’t for anyone in town.

    I’d offer to sell the prospect a pump that they can store on site as a cold spare. If their pump fails they already have one on hand. I don’t want to store their spare. Otherwise they either pay to open the supply house on a night/weekend (if yours even offers that service) or wait until the supplier is able to deliver. Contract maintenance/managed services jobs are great dependable income.

    Unfortunately this isnt rare, especially in south florida where i started my business. Did work for a former miami dolphins player that turned into a nightmare, and come to find out, they had "issues" with every contractor they used. The part that really pisses me off is that it usually has nothing to do with their financial situation, especially when dealing with commercial accts, as net 30/45 terms are typical

    If customer comes across with the cash up front, he should also be charged storage fees for the lift pumps. However save yourself the stress & don't do business with someone who has no integrity.

    I’m tired of doing business with folks like this, the fiduciary responsibility isn’t worth the risk of adopting a bad client. I’m in a different trade, but the same rules apply. They don’t ever pay. Let ‘em drown in their own sewage and the problems they created.

    Yeah show me the money or I’ll pump that shit into the hotel lobby, i used to take care of a whole huge subdivision that had individual grinder pump stations and I used to have to keep 4-5 pumps on hand for the weekend if they went out. It ain’t cheap We just do big pumps and lift stations now just put in and maintain towns lift stations now but we still gotta wait 90 days to get paid but they always pay lol or I should say since it’s tax payers money we always pay 🤣good video brother👊

    I have to say as someone who's had to find companies on the other side of this for similar things it actually sounds like a lot of money but that's not at all unreasonable I mean it's fairly standard to expect to have to drop thousands of dollars to get a new maintenance company for anything. I mean I don't remember having to get from the international head approved a pre-purchase of a new cooling unit for $250,000 for the day when eventually are cooling unit broke and needed to be replaced like immediately so basically like we had to buy a part for the day it breaks at some point in the future for maintenance company it's not like we had to give them all this money then buy it when it happened but you know it could have been 6 months ago to the end of being you know 6 years

    When I was in the computer industry, we used to pre-charge clients for staged parts all the time. The faster you wanted a response time, the more you paid. It’s an easy no-brainer…

    There is a charge for after hours work in many industries. I once paid the local gas company double time to get a critical part repaired immediately at two in the morning!

    There is a company in the harmonica business like this. They have a history of suddenly stopping delivering products for months at a time. They are also pretty cagey with how they claim to be made in America (they use Chinese parts, which is fine, they are from a good company, but they misrepresent it.) Thing is, people like their harmonicas. I have a policy whenever anyone asks about them... I say it's fine to buy their harps, but only if you do it through a middleman. Buy them from a store that has them in stock already, not from the manufacturer. That will fix the issue with the delivery problems. I personally don't like the owner for other reasons, but hey, can't like everyone. Reminds me of this though. The middleman isn't exactly the same thing as cash on the barrelhead, but it's pretty close. You pay someone you can trust to make sure you get what you paid for.

    Well, just goes to show that it's a small world. People that work in the field, and parallel fields as well, talk to each other. So when you mess with one guy's business, it will taint any business relationships from that point on. Your word is your bond, if you say you're going to do something, follow through. Otherwise you might be up to your hips in crap. Sorry, couldn't resist the terrible dad joke.
