    As a previous manager of a deli, I can tell you that most health inspectors I've dealt with are on power trips. One time, an inspector started stabbing a dishwasher thermometer into my wrapped deli meats and then had me throw them all away because they had been cross contaminated by her thermometer stabbing them. Also she fought me on the required cooking temp for pork (145 F) and had me stop serving customers until she leafed through her big book for 8 minutes only to confirm I was correct. I could go on and on. It also kills me how youre required to pour bleach on your trash so that homeless people won't eat it and potentially get sick from eating expired food. Like, bruh, they're going to eat it anyway and DEFINITELY get sick if there's bleach all over it.

    Had a guy do this at a restaurant I worked at in High School. I happened to be in the bathroom when he came into inspect. Dude had a big wad of chew in his mouth, spit on the toilet seat, then wrote the store up for "Unsanitary Restrooms".

    @@EdwardDragon96 That's why foodsharing has become this huge. Because once it's trash, it's too late. As for the thing with the homeless community... there's always a way to get the word out. When I worked at the opera, I usually took all leftover snacks with me (illegally, as they were marked for the trash) and distributed them to the homeless in the park on my way home. I always got rid of all the leftovers, and I knew all the evidence of my theft would be gone by the time anyone noticed. And my employers wanted to turn their eyes anyways. And I never felt safer walking through a park at midnight, because I knew all the faces in the dark, and knew they were cool with me. The bleach, btw is not mainly supposed to be a deterrent for homeless people, but vermin. It just happens to affect the homeless and dumpster divers.

    Don't worry Chips expired previous day or within a week is (dismissed) If you didn't have soap in the soap holder it's dismissed unless you don't have the actual holder. Test strip is dismissed cuz you have the actual test strip. Same with paper towel, you have the actual holder, therfore it's dismissed. It depends on your lawyer. Mine always dismissed these little petty violations. Only food that you must pay the fine within a day of expiration is Dairy food. Plus you can ask them, did someone complain about ? Or it's just a normal check. They should tell you. Take care, I just had an inspection today, he was great 😄 They always come Friday lol

    Would you be ok if you eat an expired chips? Why even keep them for that long. In my country processed foods are considered bad within 1 month of expiration date. Health inspectors would give fines for keeping foods that are near expiry date.

    As a health inspector myself this seems very odd. I understand writing the sanitizer and and the soap and paper towels but just correct it on site. The chips seem weird seeing as how most of those "expiration dates" are from the manufacturer who basically puts it on the package so you throw it away and buy more and for quality reasons ( this does not include baby formula or dairy products those you have to look at the dates). Failing them for something they fixed on site is kinda overkill. It's not like a rat ran across their feet. Maybe they were from one of those third party companies?

    As a person who has worked in many many kitchens across the United States, there I'd absolutely no possibility that the health department cares about anyone's health despite what you might think as an inspector. Let's make sure everyone wears toxic gloves that can't be washed like hands. Just one tiny example. I've seen so many disgusting things that made me never again eat at so many restaurants and the health department never ever did anything. Literally serving rancid food on shows like Gordon Ramsay's show which match my own experiences. People really should learn to cook for themselves.

    im a little late to this party, but we have been experiencing this issue with Ecosure at multiple locations, by different auditors. never had issues with ANY other inspectors, but idk, this company just seems to be out for blood.

    Previous inspector here. Likely that they had a quota, were close to their deadline/behind on schedule - filling their timesheets at a small sandwich shop was an easy target. Indeed some are power trips and I argue that most violations are for small, overly regulated parameters.

    I don’t know the rules and regulations in New Jersey but in my state, marking paper towels out as a failure for a health inspector can lead to your inspection history being reviewed.

    Alot of these "inspectors" go by their feelings I've noticed in general; even if everything is correct but they simply get irritated by anything; it's gonna turn into a fail. We need inspectors to inspect the "inspector" to do their actual job live on site, by facts & not feelings👍. "Simply questioning the fella, makes them feel tested, all softies"😆

    Honestly in my experience both in retail and restaurants, most health inspectors tend to take their job very seriously, which is good, but I've met a lot that take it TOO seriously. To the point where "I'm gunna have to dock you point because there's a leaf on the floor".

    Nooo I remember getting a health inspector during rush as well, and she was also oddly “out to get us.” We learned later that the health inspectors in our area are infamous for being very petty for no reason. She threw away SO much of our food even though it wasn’t expired. I think we still passed but only because the store owner had to contact the health department directly.

    That issue with the chips you mentioned is what got me fired from subway when I worked there. In my case it was a manager who found a single bag of expired chips THAT HE HAD PLANTED THERE JUST BEFORE LUNCH RUSH and blamed me for it still being there at the end of lunch rush. I was fucking furious

    You got a newbie inspector. They think they have something to prove. We had a chick whip out this "brightness" detector and tell us the kitchen wasn't "bright enough" and she took off points for it. It was literally our first inspection in a brand new building. Never in my 15 years in restaurants had I heard of anything so ridiculous. I wanted to ask her "how many fingers am I holding up?" You can guess how many I would have showed her and which one

    My dad's business had a similar thing happen during covid. We had an osha inspector come by to inspect us for covid stuff. Our business is a recreation business that also has a retail shop to accompany. We followed all covid guidelines and went above what the standards were at the time. This also meant that our recreation part of the business was closed meaning over 90 percent of revenue is just non existant. They came in on a day that the retail store wasn't even open, I was the only employee there and just restocking product with the door unlocked just in case a customer needed something on a day we weren't open. Gave them a tour of the empty building and like the whole time the two of them were within ten feet of each other while they were bringing the hammer down on our business for covid stuff. They interviewed all of our employees and "investigated" for an entire month and then fined us for things that we were already following the rules on. I get that they are "just doing their job", but they chose that job and some people enjoy their job a little too much.

    In Oregon you can charge a health inspector with harassment and criminal trespass. My aunt and mom when running their restaurants usually played ball with the health inspectors and everything was fine. But every once in a while they'd get a HI with a chip on their shoulder, long stories short, they always got the last laugh when the dust settled.

    I’ve been told that the health inspector that comes to where I work, has actually said that they will always look for at least one point of error, just to avoid a bunch of paperwork (something along the lines of this, but 100% will never give a store full points)

    It’s the same thing with OSHA. Where i work we do such a good job at keeping our areas safe that they decided to dock us points for having a stack of pallets that was too high. (Not even 20 pallets in the stack btw)

    @@bigfhtagn I used to work for subway and our owner never cared, we used to put extra, on all the subs and gave regulars discounts on their drinks, it kept customers returning. To the point that I at one point knew at least 50-60 customers orders before they even told me... Then he sold it, the new owners had us stick to regulation, profits dropped 60% in 2 months as all the regulars stopped coming and during this period all the staff quit. They were so pissed, we all got banned from store and they tried sueing the original owner saying he must of been fudging the numbers before he sold it to make it look more profitable. This was 5 years ago and I was talking to someone who works there now and they told me they were still only above breaking even every month. 🤣

    I was honestly just waiting on you to let us know that person wasn't an actual health inspector ! My mum works as a contracted health inspector (& a few other things of the same) and she ran my sister and I through a debrief once, there were many things to say about the place she checked, yet none of them could be considered major issues and most of them were more severe than your situation lol. Most of the issues were even fixed the very next week.

    "they don't do the inspection themselves, they outsource it" there is your answer right there. the third party inspection company requires a quota of failed inspection to report or they are not seen as stringent enough and will be dropped as the company does not want to later get complaints and reports that the inspection was not done properly or accused it of not being done at all.

    It's the sort of "trim the fat" processes that also see places like amazon fire a quota of employees at a regular basis. It's good until the point where you've already trimmed away the fat, at which point it starts trimming perfectly serviceable meat instead.

    When the Health Inspector comes to our place we stop serving customers immediately. We just explain to them that it’s a state official, and they usually understand. That way you can give the inspector your undivided attention. Because they need to know you’re taking it seriously. If they feel slighted or not taken seriously they will ROCK YOU. I once failed because my light fixtures weren’t putting out the correct lumens lol. Keep up the good work bud.

    Yea, this wasn't even a state/county official health inspector. This was one subcontracted out by Subway Corporate themselves to do their own separate checks. That's why Milad's Mom was able to quickly resolve this by calling their contact at Subway Corporate that they know and is familiar with how clean/consistent they run their restaurant.

    This. They have so many ways to screw you. Honestly, if she wanted to fail you she would have. I had one guy that dinged us on a plastic cup that was jammed in a corner under a fridge. Your sanitizer issue, well if what you had out was old and failed, you failed. Doesn't matter that you poured a new bucket or sink full that was clean. No soap in the bathroom is also a no go. Yeah, you have a handwashing station back there but employees are required to wash their hands after using the restroom. It was petty, but again, not something you can argue against. Paper towels not being in the dispenser, also a no go. The expired chips are a big one though. Those should have been handled when the store was opened or closed the night before. No one is checking the dates on those bags. If she was dropping bags on the counter then how many had you already sold throughout the day? All of those issues could have been avoided if you just paid her serious attention up front. Walked around with her, and she likely would have let you fix the minor things she saw. I think the silliest one I ever dealt with We had milk in the fridge that expired the night before. Our closers Put big X's on them in perm marker so they wouldn't be used. Unfortunately we had morning call outs so no one dumped the old milk. Even more unfortunate, some people are lazy and someone brought one up front when restocking. It wasn't opened, hadn't been used, but was a fail. In our case, I feel she probably wouldn't have noticed if not for the X letting us know not to use it.

    Displaying expired products is a huge violation, because it's a public health hazard. Imagine someone would buy it, eat it and get sick. Because the manager can't manage. They failed for a reason. Displaying expired products for sale is a vile violation of food safety

    @@alwayshangrygirl463 They're not "expiration dates", they're "Best before" dates. This is the extent a product can remain "fresh". "Expiration date" is an anachronism, since food as regulated by the FDA is no longer marked for when it "expires" or begins to become a health risk but they are marked for a (ultimately arbitrary but agreed upon) threshold beyond which the product is no longer considered at its best. A point beyond which it is considered degrading in quality but still not necessarily hazardous. One day beyond its "best by" date is by no means a health hazard, least of all poisonous and it is still entirely legal to sell products beyond their best before date. You would know that if you've ever worked at any food processing/packaging plant, or had any public health certifications. Please educate yourself before wrongly condescending to others.

    Been a Chef for 25 years now and have always maintained a 90+ environment. Most recent inspector "attempted" to fail us. Throughout the inspection, I had to repeat many times. "I'm pretty sure this is not in violation, but how would you like us to do it moving forward? We are flexible." To which she would respond. "I don't know." Or have to call her supervisor. Finally we asked to speak to her supervisor and he came out the next day. He immediately tossed out her "failing" report and determined it would be a "consulting". We were re-inspected within' 30 days. Also in the middle of a busy rush. But we got that 90+ we so deserved. I'm sure they are having the same labor struggles that we are coming out of the pandemic. It could take some time before things regulate again.

    If the inspector wants to find something, they can and more importantly WILL. Some are a lot more picky than others, just be as cooperative as you can be and they'll won't linger any longer than they need to. Dispute findings on the report after it's done, butting heads with an inspector during the inspection is not advised - I did get into it a bit once, thankfully they didn't take it out on us. If they find something and you can correct it immediately, great - ahat should reflect on the report. Rules vary from state to state, but a kitchen/food prep area ideally should have its own handwash station with soap and disposable towels (as you do) because a lot can happen between a restroom and handling food. Sounds like you got a guy with a chip on his shoulder on a bad day.

    And if they can't find something, they will make stuff up and flat-out lie if they have to, like this inspector did. They didn't put on the report "paper towels not in the proper dispenser" like he tried to tell Milad was the reason. They went even further into lying territory and flat-out said "no paper towels in bathroom." They also lied on the report about the hand sanitizer supposedly failing the pH test, even though Milad re-tested the sanitizer right in front of the inspector and it actually passed with flying colors. This inspector seemed hellbent on just lying and trying to make them look bad for whatever reason.

    These heath inspectors most of the time are abusing power, as I have seen from this video and some comments. I used to work in fast food, and this health inspector literally took the soap dispenser off of the wall to “check its functionality”. 15 minutes later, they write us up for being unsanitary, for having a missing soap dispenser. Luckily the store manager was there and promptly talked some sense into them. Most of them are great. What was described in this video is very rare and completely bogus. You just know that they have it out to get you if they are TRYING to find violations in every nook and cranny, setting you up, and ignoring basic details. A good health inspector looks at all of the necessary equipment and food items (ex: the sinks, the dairy and meat products, the working conditions etc.) glad to se the regional managers and such took your side.

    I only had to deal with 2 health inspectors when I worked in a restaurant. 1 was cool the other was kind of a bitch. She was complaining to me about various things unrelated to our store including that she "wasn't important enough to have her own office"

    Seems like an easy one to me, if she was complaining about things outside of the store i'd have just agreed with her and mimicked the amount of distain she had for each unrelated thing. I've always found people like that to be easy to manipulate. A perfect score tends to be impossible no matter the circumstances though.

    Was this Steritech? If it was then it’s a Subway inspection not the health Department. They are known for this. When you fail they charge you $125 to reinspect you. Ask Mom. Your store looks great- it wouldn’t fail a health inspection. 👍

Cause imagine if this guy ignored that minor stuff and gave the store a perfect rating but then possibly (pretty rarely) if a superior checks on that store and finds some noticeable big problem, the inspector who gave them full points will suffer. So they'll just give low points and find faults so this doesn't happen

    When i was a chef in a local small restaurant, we never failed an inspection either. Whenever we were about to get new equipment/methods/practices etc, i always contacted the health dept. to see what sort of sanitation they would be looking at for that aprticular item/practice. This way, i was always on top of procedures and had a good reputation with the inspectors. They knew i was proactive and concerned about safety. One day, a new inspector comes in, takes literally 5 minutes and writes us up for 1: not having a lid on the back trash can by the back door. But get this, the dishwasher was currently taking out the trash to the dumpster and hadn't refilled with a new bag yet. it was open, and empty. 2nd, the grout in the back storage room was "unacceptable". We looked at it together, and it has just began to crack at 2 of the tile edges near the wall. They claimed that tiny hairline crack would allow mice and insects into the store and was unsafe. Nothing else to show for the inspection. everything else was perfect. When asked they stated we had 2 weeks to fix the issues or we would be shut down. So i called the head of the health department and talked with them. Basically, nobody gets a perfect score, they HAVE to write something down to improve and cannot leave until they find some sort of trivial thing to make us "improve", even if it goes against another inspectors;' idea of what needs done. After that, I just saw inspections as just another way to pay to play since, when we got another 2 locations, we paid to "upgrade" our capabilities and they let SO much more crap slide at the other locations that we never could get away with before. Now I work with manufacturing and the FDA and found the FDA more reasonable. (never thought i would utter those words)

    I feel this. I used to work for Starbucks and I kept having the health inspector lady saying my store was "not up to standard" when I was the only supervisor that kiosk had ever had that actually cleaned the ice machine every month like it was supposed to be. The only person who dusted too. Then she got on me for "not washing my hands correctly." I had so many people question that one cause I was one of the few people at that kiosk that washed my hands every time I handled money. So, I get it! There are some people who just want to catch you doing something wrong and lord over you because they have just enough power to ruin your day. And for whatever reason health inspectors seem like they always want to make everyone miserable. I work at a different type of coffee bar now and boy-howdy...it's a private business so the health standards aren't "code" by any means compared to Starbucks. When I first worked for the private business I got yelled at for being too slow cause I was too focused on keeping the kiosk clean as I worked. Supposedly I'm too slow. Customer service is hard. I can't wait until I can get out of it...

    I’m a regular customer at Subway and I can’t tell if this is a good or a bad thing lol. From a customers point of view it just gives me a sense that Subway truly cares about their customers and they have a certain degree which they must meet which seems strict by the story lol. I say that because certain fast food places don’t care about being clean and as a customer that’s eating the food well that’s really important to me. However, from an employee point of view knowing what goes on behind the scenes I’d probably feel the same way Milad did it just seemed like he was finding any reason to fail you guys. Regardless I’m sorry you guys had to deal with that, love your videos man thank you for slowly getting me into Subway lol before your videos I didn’t even know how to order a sandwich and now I do my personal favorite is a steak and cheese! Anyways thank you for the video and giving your followers the inside edition of a Subway worker!

    There's a McDonalds in Ann Arbor that I refused to ever eat at because the floors were absolutely disgusting. My shoes practically stuck to them, they were so sticky and nasty. I turned around and walked out. I understand being busy and understaffed, but this was beyond the pale. If the floors are that gross, imagine what goes on behind the scenes. Shudders.

    Chips have a shelf life of years. One day is stupid. A grocery store just has to replace the item whereas a subway fails? BS. The paper towel one is more reasonable, but considering that's only necessary for customers in this case (given the dedicated washing station), it's not nearly as bad as staff being unable to properly clean.

    I had a health inspection at my work last year, and they guy failed us for having dents in our freezer (this has nothing to do with anything but age of the store), he also marked us for a small scratch on our bathroom mirror, and other small cosmetic stuff just to fail us. Our food safety was like a 97, but since he was in a bad mood he marked us for cosmetic stuff and failed us. Our store is almost 20 years old.

Our store is like 20 years old so there is some broken stuff like the floor starting to come up or dents in the freezer or scratches on mirrors. Just stuff like that. I get the guy was going through some stuff, but failing our store for no reason other than he is going through some stuff was bull. He came back a few weeks later and explained what was going on, but either way it looked really bad to our owner until we explained everything.

    You will definitely get a few of those inspectors every few years, they rarely are around for long because of the trouble they cause from the businesses. A few calls always make it back to them and a pattern is established which leads to their removal. There is one thing about being by the book and then there is just malicious compliance.

    I had a health inspector come into the Rocky Mountain Chocolate Factory I worked at right after the opening procedures. Those include restocking the chocolate cases and making some of the handmade items that are low. Naturally, little bits of dry chocolate fly allover the place. Some on the counter and some on the floor. So the health inspector comes right as I'm finishing making the last items, just before I am about to sweep, looks at the tiny flecks of dark chocolate on the floor and throws a fit. She says the floor is unsanitary. I tell her that it's small chunks of chocolate from restocking and she says "I don't know that. I wasnt here to see you make anything, so they could be rat droppings!" I stared at her for a sec, picked up some chunks off of the floor, and ate them while staring at her. Some people get too caught up in their job titles and they lose their basic ability to observe and think logically.

    I have a small butcher shop I’ve owned for about 20 years I have a federal inspector everyday. Grocery stores have them twice a year. And onece a year a state inspector / health inspector comes in and I have no respect for them or they have no jurisdiction and even guys or gals have been there for 30 + years I correct them on what is and isn’t acceptable Most of my employee have been with me well over a decade but we had a newer guy that worked in restaraunts and feared the state guy. They’re just bullies who are used to nobody knowing the ins and outs and they can’t do anything if you know haacp and statutes they really can’t do anything and will just get themselves in a mess.

    It's like they thought they were Gordon Ramsay or something, lol. I've seen him pull that move in Kitchen Nightmares when he finds super old stuff rotting back in the kitchen storage, throwing the old food onto a table out where the customers are eating and being like "THIS is what they are serving you here! Stop eating now! This place is shut down before anyone gets sick and dies!" *One* day old chips certainly aren't going to make anyone sick though, so even Gordon wouldn't pull that move with just that alone. When I saw him do that it was at some Mexican place with like 3 month old refried beans that were clearly moldy, lol.

    I worked in healthcare foodservice in a hospital for 11 years. I’ve been through so many inspections, I could be an inspector. Yes, even though you have hand soap at the hand wash station behind your station, you still need hand soap in the bathroom In PA at least, probably other states, you are required to wash your hands before leaving the restroom and again when you get to your station before handling food. She is right about that and also the paper towels not in the holder, they’ll get you for that. In PA, the actual state dept of health sends state inspectors and we have municipal health inspectors.

    We had a serious rating impact one time on an inspection because our dish washing diagram showed the sink order going right to left, with the leftmost sink being the sanitizer water. But we had it setup the other way around, which made sense, because our dish drying cart/rack was on the right side of the sink. Hence, the rightmost side was the sanitizer water. They cleared that up pretty quickly though.

    You are legally allowed to ask the health inspector to leave if they are purposefully slowing/harming your business. They would have to come back another time with a supervisor, but you can only do this if you are CERTAIN they are actually slowing your business for literally no critical reason. And you can only do this once, when the supervisor comes it usually next day and they will do the inspection then, no exceptions. Source - Chef for over 15 years.

    It wasn't a public health official (i.e. state/county inspector.) It was from a third party company Subway Corporate themselves outsources to do their own independent, separate checks. Milad mentions in the video it was someone Subway outsources to, which is why Milad's Mom was able to quickly clear up the issue after calling their contact at Subway Corporate.

    Hey man, I am also a health inspector, sucks that you had a bad interaction with yours. Idk where you are and it will be different for each state, but here's my thoughts. They do generally want us to come during busy times, because they want us to see how the place actually runs. If we're there at 8:00am, its going to be a much more sanitized view than if we were there at 12:30. I know it must suck to have us poking around, but I always try to be really conscientious of that and let the employee go help clear out customers when I'm doing an inspection. The chip thing is wild to me. Again, it differs by state, but in my state we don't even check expiration dates on stuff like chips. Those dates are for quality not for safety, if you eat one past that date it might be stale, but it won't get you sick, so we don't bother with it. It is normal to start pulling out expired stuff and put it on the counter for you, so a customer doesn't get it without noticing, but that's more for stuff like milk, eggs, cut fruit, etc. The soap and paper towel thing also is kinda unneccesarily strict, if it was there and just not in the holder, as long as it can be used and isn't some weird container that HAS to be in the dispenser to be able to get to it, I'll let it go, and usually if I see them correct it while I'm there don't bother writing it at all. Sounds like the guy was maybe just having a bad day, try not to let it get to you.

    So this wasn't even the actual health department? But the 3rd party inspectors that Subway hires to make sure you are up to snuff? We have that where I work and the 3rd party inspectors come once a month, but they usually score us, and like guide us on corrective actions or fixes if needed. I think we just have a good inspector, who wants to see us do well rather than fail us and walk out. It also helps that it's the same person over and over.

    Sometimes you get an inspector who is cool, understanding, and just a down to earth person who cares about the job just enough to make sure nothing major is being violated and that no one is going to get ill from your food. But then you get the person who thinks it’s their lifes mission to follow all the codes and rules to a T. Ive heard my grandpa talk of people like this back in his day. I believe he called them Nazis, but i might be wrong. At any rate, keep up the good work: good vidoes and banging subs

    At Tim Horton's we also have very strict inspections (they call them Audits) that are done by 3rd party inspection companies and they are ridiculously strict as well, can't even imagine getting one of them on a bad day LOL, glad you got it sorted out

    Gotta learn to look into more than just headlines bapa. Like what was the reason for the failed inspection, was it the sanitary conditions of food storage areas or the food itself? Failing for not having paper towels in the bathroom will have no effect on your sandwich

    OSHA rules are very strict in Vegas, they expect everything on the shelves be up to date with all foods. Also in the bathrooms the paper towels, had to be in the proper place they can't be left out. Soaps and sanitizers had to be filled too. No matter how busy the day is. They need an extra worker on hand to do the job. On a busy day being understaffed isn't good for the customers and for the employees. Poor management happened in this Case.

    Reminds me of when at a pizza place I worked at, we failed an inspection because the light in the walk-in fridge was too dim lol. None of us have ever had a problem finding stuff in the fridge because of the supposed dim light.

    The health inspector in your subway was a joke he failed you for hand sanatizer and the paper towels normally health inspectors only fail you for out of date food or drink being served to customers and unhygienic work space.

    Health inspectors have an important job, but I want you to realize that even though I respect that, I also hate people who use their importance and authority and then abuse it to hell for no other reason (presumably) than to feel the thrill of controlling another person's life, or to feel like you did a good job at the expense of others. If a health inspector ever reads this, please. Please for the love of god, put humility in to the people around you who you KNOW do this. honestly, this message can go for anyone really, but just... ugh, don't let people get away with acting high and mighty.

    At my workplace, we usually have health inspection on the 3rd week of each month. My rule of thumb is, if they don’t show up between 9-10am, they aren’t coming. Word will always go around the store before they show up so everyone can catch up to not fail. Such as changing sanitizer, logging everything, making sure food labels are correct and the expiration date isn’t suppose to be today/yesterday. Seeing this is kind of weird that you had to experience it. I thought it was serious, but seeing that your health inspector wanted to dox your store over something like chips tells me he/she was making it personal.
