Anyone can try to sell a book, point is who wants to read about you? Enough free info, you want to moonlight without using company property. That includes intellectual property, hard to stop you. Just do not tell. You steal i sue...........

That is the CEOs are the policy makers of the company. It is not from the Govt. but from the Employers these conditions of conflict of interest, Non Disclosure clauses comes. These CEOs are not doing any illegal thing in second income as they dont have any policies on them unlike employees.
Ethical or not i don't give a damn. Ethics will not pay my bills. I have 2 jobs. I am productive.

Most of the employees in India are moonlighting only for their one and only employer with no extra benefit. No overtime wages on work done at home. The employers are overloading the existing workforce so that they take home part of their daily work. This is the ground reality. Most of the employees are left with literally no time for moonlighting for others.

Not entirely true. Many of my friends have taken up second job mostly as consultant. You got to grow spine to say NO to working overtime. IT in india is booming and companies are finding hard to hold on to their employees, employees have too many options thats why resignation rate is so high.

@@dwadedunkedkobe employers will hire someone from outside with 1hr interview but won't hike existing employees who work hard. There is a reason why people choose to get 2nd job than waiting for hike. Bare minimum to keep the job.
The HR was trying to take action on my colleague, who worked in his ancestral fields on the weekend, saying that it was against the moonlighting policy. After many arguments, HR said that if the income reflects in your income tax, it's moonlighting. To which he replied," I have been working in this company for 6 years and longer still in my fields. I am yet to reach the minimum bracket to pay income tax."
Makes sense totally, considering the economic situation.

True. As freelancer I sometimes take two jobs. Because my work is on computer I can get away. The main reason is because I have a lot of downtime and I need to get all the work I can handle. It’s not optimum but you do what you need to do.

People are rich in the US... Moonlighing should not be there in US and Europe... They are bloody rich people...
Now, that is a curious case of selective burnouts. When employees were overworking without overtime pay for all these years, there were no burnout concerns from employers !

moon lighting is the result of imployers refusal to pay a living wage to employees in order to keep up with the cost of living, forcing them to hold down a second and sometimes a third job to get bye, those second and third jobs could have gone to more impoverished able bodies, if living wages were enforced.

*Indians literally INVENTED moonlighting* before it was even a word ! Every Indian Govt DOCTOR has a private practice; every TEACHER gives private tuition, every Public PROSECUTOR has own Law firms .... Hell even Indian MINISTERS moonlight (so many MPs do private businesses or legal or medical practice)... even BEGGARS in India moonlight: blind during the day - disabled at night!

In India it is made compulsary by all companies to work extra hours. It is expected to do so. Though it is not written, but one who does not put extra hours, will be fired. Moonlighting should be done.
It's India's employer mentality of considering employee as bonded labour, not providing overtime compensation which draft the rules and terms fit favourable for them. If per hour minimum wage concept applied in India , people don't need to think of moonlighting, but government/politicians don't let that happen since funding for their political parties from corporate will cease.

In most cases, low wages explain moonlighting. There is hardly any law to protect the employee. The corrupt government allows employers to make a mockery of remuneration.
The question also exists as to whether it is ethical to underpay and employee. Employers want to hold their employees to ethics. What about employers being ethical?

IT service based companies are paying 3-4 lakhs CTC for juniors. How can these folks survive in cities with such low salary ??? Please rectify these kind of disparities first. Too much of exploitation in the name of giving opportunity.

We moonlighted for almost 4 years in order to learn and implement new tech, with no frill at all.
Fascinating that people in any sector of India are prevented from having second jobs. I feel sorry for the factory workers if they're underpaid and can't afford to live from a single salary. Moonlighting absolutely shouldn't be prevented, unless there's some form of conflict of interest.

In IT companies there will be deadline usually. No matter what you will do u should complete the work within the deadline. After that anyone can do anything, i think its not offence. Company laptops usually cant be used to such type of workings bcz of policies applied on the laptops

Instead of policies for junior and mid level staff first they make policies for CEO, CTO etc who have multiple companies why don't they work for only one company, why don't they get same hike as their employees. Even conflict of interest shouldn't be an issue only data breach is valid reason and if you allow your employee to work he will never do any data breach, ow he or she may do. Also, most of the time developers work with dev environment not so very confidential data

what makes you think USA adjust salary with inflation? they don't.. in India, govt employee get salary adjusted with inflation every 6 months, its called dearness allowance and in private sector raises are most times way higher than inflation except some sectors.

I do not know why it is debatable. Employees work 2 jobs because they cannot secure a roof over their head and put food on their table with only 1 job!
What about working for the same employer for twice the hours and demand double salary ?? This also means treating the same employee as 2 workslot instead of 1. So double the benefits , double the hike. Problem is 1 day leave would be essentially 2 day leave etc...
World economic crisis and high inflation have left people with limited income but high expenses, hence people will try to earn more in as many ways as possible, corporates and govts must understand this, empathize with the employees and encourage it as well.
As long as you don't work for the competitors, not disclose confidential information, if you let your current employer know, if the employment contract does not expressly prohibit there is nothing wrong with it.

Many people do more than one job in the US.
When companies have right to work with multiple clients at the same time then why not employees have the right to work with multiple clients at the same time. Anyway Indian IT companies, specially Indian IT companies have been exploiting people for a very very long time it’s time we tell them who is the boss. Employees need to make sure that they find a second job outside and should work because renumeration in India is so so low that you don’t save anything at the end of the month. But property prices are almost at par with Western countries, specially in cities like Mumbai Delhi Bangalore et cetera. But salaries are still one third or one fourth of what US employees get so what should we do, How do we as employee survive and at least save something? And this problem exist at the bottom of the employee pyramid higher level employees like CTO and CXO band people are almost equal to US level. So if companies can come forward and resolve this issue than moonlighting will not happen but if they just want to preach about it is being unethical and all that shit nobody is going to listen. Frankly speaking Palki has got it wrong again, she’s basically speaking from the side of the employer not employee. This was her second attempt and she again got it wrong. Many IT companies like EClerx do not offer nightshift allowance or late shift allowance so they have been exploiting people for a very long time.
I work as an engineer but i feel we humans can do multiple things and thats why i also started youtube channel although i dont have enough subscribers but i have the hope to grow and every single person must have the same hope. This is huge in the US. Alot of people have what they call a "side hustle."
In America a lot of people pick up extra hours to make the extra income to pay their bills. If a company does not want it's employees to take up extra hours elsewhere, then that company should pay their employees more. I know people who work 8 hours a day in their permanent job and drive Uber as part-time. There shouldn't be any laws against it. People do it for survival.
Moonlighting occurs due to helplessness due to major financial issues.. Passion is the last reason for working after your regular job
Employer(founder) can be a board member of multiple companies, can be a guest lecturer in university but employees can not do anything outside

In India unemployment is largely a political debate & issue. Common people just get influenced by whoever ...whatever makes the most noise. What Unemployment truly is , is dependent on multiple factors which is overlooked in all the political noise. Baseline, massive reforms in the Educational system are needed to address unemployment at its root cause

Indian law doesn’t say anything regarding moonlighting because there is nothing such law present
good analysis with perspective from both sides, except following catches : 1) Factories Act 1948 is for workers safety and hence was applied on factory workers wherein the physical overwork at multiple places can jeopardize their life. This act also regulates strict working hours and safety standards. Factory job is well timed - infact in large factories still there is a siren regulating their strict hours including lunch hours. In law the intent of the law if primary and wording secondary. Anyhow, the Factories Act is now subsumed in Occupational Safety, Health and Working Conditions Code 2020. An IT job is not normally physically precarious, and IT job has also been kept out of the purview of the Factories Act - which has been mainly due to the efforts of the IT employers like Infosys, Wipro, TCS, tech Mahindra, Satyam Computers, etc so that they can be kept out of the strict regulations promulgated by the Fcatories Act. Now, when they (employers) vie support from Factories Act to defend their stance against moonlighting its double standards and hypocricy. 2) 2) Clause in the contract restricting the employement to only one employer and Non-Compete Clause, each of them individually violate Article 19(1)(g) of the Constitution and Section 27 of the Indian Contract Act, and are void ab-initio. What it means is that these clauses even if present in the contract are held to be non-existent, so cannot be breached at all since they are held not to exist at first place. Law strictly prohibits contracting out of law - section 24 of the Indian Contract Act. Hence, in each litigation between employer and employee they have been stuck down by the High Courts (HCs) and the Supreme Court (SC) of India. Note that the judgement of the SC forms teh common law in the country. In the “context of this debate”, the exception which SC has allowed is for high positions, where Non-Compete has been upheld but with restrictions liek duration of not more than 1-2 years, limit to very niche industry segment and so on. Moreover, during this period, the employer enforcing non-compete has to pay full-scale salary to the employee on whom it is being enforced. 3) Non-Solicitation clause has however been universally upheld to protect employer. 4) Now the ethical part: if the work assignment doesn't result in Conflict of Interest (CoI), does not hamper the productivity of the employee (in working hours - not w.r.t to "expected" 12-18 hours a day 6-7 days a week by the managers), and employee complies with Non-Disclosure (NDA) and Non-Solicitation (NSA), it is ethical. If employee's productivity comes down in routine work hours then its unethical, and for other CoI-NDA-NSA violation its illegal and employer can sue the employee to recover damages. Much of the debate resulted from ignorance of the law worsened by the arrogance, corruption and incompetence of the HR and Senior Mangers like Mr. Rishad Premji.

@@fredrickprice2037 Taxation is bit high though. But that 's how it is.
I did 2 jobs at the same time. Domestic and International I was making 28k a month.
