    Actually the process is ask the parents or guardians since she's special needs to escorts her to their office. The police weren't necessary. They can only press charges if it's over a certain amount I think. Either way the police are there only to deal with a threat and if suspected taken to jail. But if nothing wrong they let you go. The police had no right to touch her like that. Only if they are trying to flee or a danger. .idiot cops don't deserve a badge unless they have proper training or have a different department for non criminal things like this...

    While I sympathize with the family, you have to understand that most police also have the understanding of an 8 year old. They can't be expected to understand what they're doing is wrong. You have to speak to them with the language of a child otherwise they'll get confused and have temper tantrums.

    They didn't even get that far. They just charged straight in there and shoved her to the floor. Instead of blocking off their exits and talking to the citizens calmly, they completely mismanaged the situation. It doesn't even matter that she had a mental disability, no one should be treated in this way. Here in the UK, a suspected shoplifter would get calmly taken to one side and spoken to, with their bags searched. They certainly wouldn't treat someone as if they just committed a murder by surrounding them, chucking them to the ground, and causing distress to them as well as other shoppers.

    Restriction of movement - the handcuff was used, is typically use when arresting. Portable cause is there for detain, and perhaps they refused for cops to investigate that lead to the event.

    @@craftsandstuff3349 Use the brain you were given. There are different types of investigations. Questioning suspects and/ or victims, gathering information is considered as an investigation. They was acting on the complaint by Walmart. The officers that responded may not have known she was a special needs person. Yes the 911 operator was told, that does not mean they passed the information to the officers which does happen often. Her actions could then be considered resisting without knowing her condition. Walmart asset protection was the real issue. They could have simply checked the receipt and see that the hair bands was paid for and that would have been the end of it. The911 tapes need to be checked to find out if the 911operator did or did not let the officers know of the girls condition.

    I do NOT believe it is legally required to not detain a thief. I do believe, however, that it is against SOME stores' policy. Mostly because of this very type of case, the person they thought was guilty is not and can be held liable for more than the item costed.

    @@xxanonymousbunnyxx4963 : Actually, there is a specific exemption in the law called the "shopkeeper's privilege" which allows them to detain a shoplifting suspect without civil liability if they have a reasonable basis for doing so. It may be that some stores, in an abundance if caution, choose not to detain suspects, but if that's the case, it's the exception, not the rule. Most stores are actually quite heavy-handed when it comes to shoplifting suspects.

    Approximately two weeks ago, on the afternoon of June 16th, 2019 in Lansing, Michigan I was approached/ambushed by two undercover police officers wearing plain clothes (Tee Shirt & Jeans), and in unmarked cars. It was quickly determined to be a case of mistaken identity. Yep. They thought I was someone else. I'm kind of okay with that part. What I'm not okay with & what has continued to cause me a ridiculous amount of paralyzing anxiety & insomnia is the gun that was pointed directly at my head when I was suddenly blocked in a driveway & instructed to "freeze, don't move, get your hands up, keep your hands up, and then "get outta the car NOW!" The officer had the gun aimed at me the entire time he approached me from the moment he exited his unmarked car. He was holding the gun with one hand while supporting that wrist with his other hand. I'm fairly certain his finger was on the trigger since he held it with both hands as though he was preparing to fire his service weapon. When I asked, frantically, "how does this happen?" They said "we thought you were someone else." That's it. It was over in just a few minutes. Actually I'd be over it if not for the gun aimed directly at my head. I have no idea who they were, which department they worked for, what their names are, or anything else. I would like to know what that person did for them to approach me like that but I have no way of knowing. If I would've received an apology and/or explanation via a 2 minute phonecall I'd be looking at things from a completely different perspective. Instead I've been in fear for my life, riddled with "what if's," and plagued by debilitating quandaries: ie "(What just happened to me)?" "(Could this happen again)?" "(Could this happen to one of my children or other family members/loved ones)?" For the record....I have (no) criminal record. Here's a real WTF, bonus - the one with the hyper pointer hand seemed rather kind otherwise. Tell me that wouldn't Fack with ur head a little tons. Either way ...What good is the 4th Amendment really? Seriously. What does it protect?

    To the Walmart security guard in this video: You should be ashamed of yourself for filing a false police report against a woman with a disability against her will by telling the cops you called that she stole hair ties that you know she purchased. She even had the receipt to prove to you that she bought those hair ties that you claim she stole. You should NEVER work as a security guard anywhere because you illegally detained a person with a disability and kept her away from her family.

    If it were me and that was my special needs daughter I wouldn’t have accepted the settlement. I would have let the sympathetic jury and everyone else see how pathetic and strong armed this PD was. They threw this girl to the ground over $3? They didn’t even have proof yet that she stoled anything because no one bothered to look at the receipt.

    We had an incident happen at our home with the Livonia Police. When a family friend, who was over at the time, tried to leave with a tow truck for his car, they took the car and searched it. They threw him on the ground and searched him. He won $25,000.

    This happened to us in Giant supermarket on Morrisville pa by store manager and two other staff members . we were completely humiliated in front of everyone saying I was video . I showed my recipt and they still didn't want hear it. Smh ppl don't have no respect and the cops are bullies wearing badges.

    My daughter is also special needs. I’m more scared of a police interaction then any bully. There is no way my daughter would stop if commanded. You have to know her name and use it if you want her attention. You have to verbally prime every command. They can be complex, you you have to prime her.

    Why would Walmart even call the police in the first place?? They knew she was special needs, and the item was less then $4.00! Even if she did take the hair ties, the Prosecutor would of never issued a warrant or pursued the case due to her being special needs. Thee is a lot of fault here, however it started at Walmart.

    I'm guessing the US has different rules. In the UK you must exit the shop to be accused of anything, no matter where you may have stashed any goods on your person in the shop.

    +jeff hubbard In the US it's not required that you actually exit the building, so it's less limiting in that respect. In the US you only have to have gone past the last possible point that you could legally purchase something. On the other hand though, US law is much more limiting in certain respects. Since the US constitution provides a constitutional protection against unreasonable searches and seizures, laws that allow shopkeepers to detain people they suspect of shoplifting are an exception to that protection and carry more of a burden than such laws in other places without such a protection. In the US it's not legal to detain someone simply on suspicion that they stole something. In order for a shoplifting detainment to be legal it requires that a single representative of the store personally witnessed the entire shoplifting process from start to finish. They must have seen the person pick up the item(s), conceal the item(s) and then proceed past the last possible point of purchase without paying for the item(s). And it cannot be multiple people that witnessed different portions of that process. And all of those observations have to have been made continuously without losing sight of the suspect.

    Why aren't you pressing this issue!? In no way should the officers that were involved that day not have some sort of repercussion. As for the one that threw her down, that officer should no longer work as a police officer. Period. There is everything wrong with how they handled this interaction and they need to be dealt with accordingly.

    I was there this morning and getting undue scrutiny from the lady manning the self check out in spite of having two whole items and bagging them and taking my receipt. It ended with no incident but I was tempted to ask her if she needed something. They seem to assume you're a shoplifter until you can prove otherwise.

    Lawyers will get most of it. Unionized cops and city government don't care - it's taxpayer money, and their salaries and pensions are safe. No apology, nothing will change. Voters will keep voting for the same corrupt politicians because they can't be bothered. They just vote for a single party (although this is a problem for all parties) or for the one with the most yard signs, paid for by people who want their money back from the corrupt-o-rama.

    According to the city lawyer, they settled because he felt the jury would side with the plaintiff based on sympathy? No Mr City Lawyer, you settled with them because your city cops cuffed and tackled a woman who literately broke no laws or violation. The city paid out 120,000, you better believe walmart ponied up quite a bit more since they are the ones who made the false claim in the first place.

    File a complaint against the officers involved with the Michigan Commission On Law Enforcement Standards and seek the revocation of their certifications. They cannot legally work as police officers without a state certification. You can also complain to the state attorney general. They are empowered to act as both police and prosecutors.

    We have investigated ourselves and found that we have done nothing wrong. The officers reacted within department policy guidelines.This incident was reviewed administratively and determined all policies were followed.

    That Livonia Walmart I am familiar with it. 4 or 5 months ago there were two black school teachers who had purchase some items there and we're profiled as thieves walking out of Walmart with their bill of sale and their items. They were brought back in and held hostages for about 2 hours while Walmart officials and police interrogated them claiming that the bill of sale was fake. A Manager was finally called in and said that the bill of sale was in fact real and not a fake. They both received no apology. So Walmart saying that this would never happen again apparently it is not true

    I'm surprised WalMart didn't trespass and ban her. That's what they usually do to people that they falsely accused of shoplifting. No discipline for the false accuser but punishment for the innocent.

    The problem is, training will do nothing for the police. They have already decided the slightest bit of non-compliance - for whatever reason - cannot be tolerated.

    They were correct in assuming a jury would have awarded the family a sum of money more in line with the crime the cops committed.

    take away their side arms for a week. Mind you , let them keep their shot guns in their vehicles, you will see how they (the cops) will change thwi thinking. the "only reason" they have the "upper" hand is because they come up to your car window with a gun in their hand. it is basically carjacking...

    Just seen this and it makes me glad for my parents watching out for me cause this could happen to me... I've had panic/ptsd attacks in walmart/other stores, act kind of like her when my autism and/or bipolar acts up. It makes it worse cause despite being 33, i have to at least use a cane (or electric cart, in walmart - bad days, I use a rollaitor) yet I look 'normal'. I'm lucky stores are kind enough that I can take items with me like stuffed animals I buy for myself after my dad pays. It's scary though.
