Discussion | Jacob Zuma to spend first night in jail

Mzwanele Manyi, Jacob Zuma Foundation spokesperson, maintains the state capture commission has been unfair to Jacob Zuma. The former president is finally in police custody. He's been found guilty of contempt of court and sentenced to 15 months behind bars for refusing to testify at the state capture commission.     Just to be clear. Jacob Zuma was arrested for being in contempt of the court. What this guy is arguing here has nothing to do with him going to jail. He should have gone to the commission to discuss this there. When you are summoned by the courts, you go. If you don't, you are in contempt and a warrant of arrest is issued. Even for a traffic ticket. I know, I have had a few. What is this guy talking about?

    Zuma never ran away from appearing to Zondo commission. He was ready to go to appear. But he felt that Raymond Zondo was not the suitable person to question him in the Commission because they had their personal issues. Zondo would be biased. But Raymond Zondo refused to recuse himself , why ? Why didnt he give the public benefit of the doubt to agree to recuse himself to see if Zuma wouldnt appear ? It was not about Raymond Zondo and his ego or status. It was about the public getting information from Zuma during the interrogation. Zondo was wrong and he would never be forgiven to have refused to recuse himself. Zuma's crime was to ask for Raymond Zondo to release himself as a Chair person.

    Manyi is crying and can't help himself...if Zondo went to any other lower court it would have served Zuma's strategy of delaying and wasting time. It was good of Zondo to just go to where there will be no room to play a hide and seek. Zuma beaten in his own game for the first time, I am certain he is shocked. MZWANDILE is clutching on straws. I have said it over the whole weekend that Zuma should have just sent his sizes to correctional services for prison uniform instead of all the twisting and turning he was doing.

    What Mr Manyi does not understand is that, Contemp of Court is a default judgment, no trial is needed, because the individual who does not choose to appear in court, denies himself a trial and therefore chooses himself to be incarcerated. He keeps on saying Zuma has gone to jail without being tried, it was Zuma's own choice. And a Contempt of Court judgment is available to all courts, not only criminal courts.

    Zuma is guilty of corruption, but I think he is pleading the 5th Amendment and refusing to incriminate himself at the commission. Legally aside whether he is guilty or not, the legal process wasn’t followed through.

JJ is right, this way the only way zuma was goin to jail, as his strategy was to appeal and stall cases until he dies.. the only mistake his lawyer made was actually telling Zondo and treatening zondo that they will appeal forever, so zondo said, ok, let me go straight to the apex court then
