In this episode of Critical Mas(s), Massad Ayoob discusses the three legs that hold up the table that defines the set of circumstances in which the use of deadly force in self-defense is legally justifiable in court.

One of the most well-known and high-profile cases involving the use of deadly force in a self-defense shooting is State of Florida vs. George Zimmerman in the death of Treyvon Martin. Mas discusses the legal facts of the Zimmerman case that were examined and ultimately resulted in Zimmerman's acquittal, and apply to cases of lethal force in self-defense writ large.
The following factors are considered any time there is a shooting or application of other forms of deadly force in self-defense against an immediate, otherwise unavoidable danger of death or great bodily harm to yourself or somebody you have the right to protect: ABILITY, OPPORTUNITY, and JEOPARDY. Force of numbers, disparities in physical size, strength, or the presence of a weapon are a few examples of Ability. Opportunity to employ their intent to cause harm (within certain distances, whether there are obstacles, etc) must be present, and Jeopardy is their manifested intent, either by words or actions, that your attacker is going to carry out the threat that they pose to you.

ABOUT MASSAD AYOOB:
Massad Ayoob has been handgun editor of GUNS magazine and law enforcement columnist for AMERICAN HANDGUNNER since the 1970s, and has published thousands of articles in gun magazines, martial arts publications, and law enforcement journals. He is the author of some twenty books on firearms, self-defense, and related topics, including “In the Gravest Extreme” and “Deadly Force,” widely considered to be authoritative texts on the topic of the use of lethal force.
The winner of the Outstanding American Handgunner of the Year Award in 1998, Mas has won several state and regional handgun shooting championships. Ayoob was the first person to earn the title of Five Gun Master in the International Defensive Pistol Association. He is the current President of the Second Amendment Foundation. He served 19 years as chair of the Firearms Committee of the American Society of Law Enforcement Trainers, and several years as a member of the Advisory Board of the International Law Enforcement Educators and Trainers Association. In addition to teaching for those groups, he has also taught
for the International Association of Law Enforcement Firearms Instructors and the International Homicide Investigators seminars.
Mas has received judicial recognition as an expert witness for the courts in weapons and shooting cases since 1979, and served as a fully sworn and empowered, part time police officer for 43 years, mostly at supervisor rank. Ayoob founded the Lethal Force Institute in 1981 and served as its director until 2009, and now trains through Massad Ayoob Group. He has
appeared on CLE-TV delivering continuing legal education for attorneys, through the American Law Institute and American Bar Association, and has been retained to train attorneys to handle deadly force cases through the Armed Citizens Legal Defense Network. Ayoob served for two
years as co-vice chair of the Forensic Evidence Committee of the National Association of Criminal Defense Lawyers. He also appeared in each episode of Personal Defense TV (Sportsman’s Channel).

    In 1985 I purchased my first handgun (A Taurus PT-92-Still have it). Shortly thereafter a good friend of mine gave me a small paperback book about the general ideas and theories regarding self-defense and lethal force. I still have that book and have re-read it several times over the years. (Along with purchasing several copies for gifts to friends.) That book is "In The Gravest Extreme" by Massad Ayoob. I can think of nothing else that has had a greater impact on my outlook as to defending myself and others. While I am absolutely opposed to any form of gun control, I could agree to that being mandatory reading prior to anyone purchasing their first firearm!

    In the Gravest Extreme was originally published in 1980. Deadly Force, 2nd Edition: Understanding Your Right to Self-Defense, was published in 2014.

    @Kenneth Wilson Knife attacks are very fast and deadly, but still, if I turn around and run while drawing, my glock 19 loaded with jacketed hollowpoint would completely destroy you. But that's if I'm not in a small room. And you're getting filled with lead even if my throat is gushing blood, you know? It's kind of a suicide attack unless you're REALLY good, or the defender is either poorly trained or just completely caught off guard. No one should have to go through that kind of shit, though

    Knife is the easiest weapon to use in close proximity. Alot of people accidentally shoot them selves pulling a gun before shooting a attacker.

    I think people are missing something in this equation, the 21 foot rule is if the attacker has a knife that is drawn vs someone who has a gun that is holstered. If your gun is unholstered and the assailants knife is drawn, the person with the handgun has the advantage.

    Most people don't understand how fast or deadly any attack can be. A lot of range trained guys like to talk about what they can/can't do with a firearm, the same way academics like to talk about how real/unreal the danger a subject is in, the reality of the situation is unless you're trained to hold off you're attacker while you draw, that pistol on your hip is largely decorative, and if you're the one with the gun you're likely going to be considered the "bad guy" by a vocal majority.

    When a man gets in 6 feet of you with a knife ,he now has equal chance to kill you with a knife as you have with a gun to kill him. Deadly force is not shooting him in the leg. You should not own a gun if you say this.

    As a former LEO let me add that if the Police persist in demanding a statement simply grab your chest area and tell them you are feeling a tightness and pain and need to go to the hospital NOW and want an ambulance NOW!! No Police Officer who values their job / pension will deny your going to the hospital for a possible heart attack. This buys you time to call or have someone call your attorney (IF you carry you better have an attorneys phone number) and guide you through your statement.

    A couple weeks back I was attacked by a drunk. He apparently thought I was someone else and grabbed me by my throat. I lifted him off the ground and then threw him to the ground. I do carry 24/7 but I felt he was done after him hitting the ground. I maintained eye contact while walking away. I did have a second of thought of pulling my 357 magnum and shooting him in the face but I did not want to have a death on my heart. I will use deadly force if no other option is available. I pray he gets help for his alcoholism issues.

    Even though you might have been just in return deadly force, you might have been caught up in jail and court systems for years. If deadly force isn’t necessary, like 100% necessary, then don’t use it. Good choice in the end.

    Your means of escaping a deadly situation are much hindered compared to a non disabled person. That is where it is important that justice is blind. What I could escape from maybe you couldn’t and every case needs to be decided on the merits of the individual case.

    In Texas, if a 'criminal trial' was found to be a "good shoot", civil lawsuits are not permitted. We also have very strong 'Castle Doctrine' and 'Stand Your Ground' laws.

    When you are armed and you go to the supermarket oh, my thought is this my only advantage of being here is that if somebody starts killing people I can stop them oh, I might be able to save a life, when you're in the supermarket and it's being robbed you are it and you may be the only person between life and death for innocent civilian, if you're thinking is right, you could save a life,

    Some situations you may be harmed and there's a robbery in the store in the suspect has a gun and he's pointing at somebody and instead of drawing your weapon and taking them out with you know you can do you could hit him in the head with a 12 16 oz soup can, if you're thinking properly this is how you win the situation

    Yet another fantastic video. It really does behoove all of us who carry to realize the tremendous importance of the phrase, "With power comes responsibility." Likewise, something I also say when I'm teaching, is that with knowledge comes responsibility. I spent 22 years in the military, and one thing we were always taught was situational awareness. Quite often, there are visual clues that we can pick up on that indicate bad intentions by others. Not always, of course, but a keen eye can catch things that seem a bit off. At that point, it's best to get out of the situation immediately, if possible. When it's not possible, this triangle that Massad shares with us should be running through our minds if we find ourselves in a situation where we may have to draw our weapon. I honestly hope I never have to draw my weapon on another person, but it's ignorant to think life is a bed of roses with no people around with bad intentions. Be safe. Be observant. Be vigilant. Thanks again, Massad.

    I paid less than $200 for a legal protection insurance policy just in case I'm ever in a situation when I may need to defend myself or my loved ones. Why can't everybody insure themselves and spread the cost of defense among ourselves? After all, the chances of any one of us having to use our handguns to defend ourselves is so small, the chance will probably never happen in our lifetimes. So why not purchase an insurance policy that will pay ALL of your legal fees in the unlikely event that you will need this insurance? You won't go broke for a few hundred bucks if you buy insurance for something you should never likely need to use. IMHO of course.

    I love Massad Ayoob. The man is a wealth of knowledge and is someone that I have learned a tremendous amount from. There are not a lot of other people out there, who have the same, if not more, wisdom, insight and knowledge concerning self defense both with and without a weapon as well as firearms knowledge and firearms instructor skills. He has always done a great job of breaking down both what is and what is not any justification in a deadly force encounter.

    I am a CPL instructor in Michigan, and also a former Neighborhood Watch Organizer as well as a US Army Veteran. Here is my take on the Trayvon Martin vs Zimmerman situation: Zimmerman was wrong for even exiting his vehicle. His duty as a neighborhood watchman is to observe and report. If he had never exited gis vehicle, contacted the police, and only kept his distance, he would not have ever been in the situation that would necessitate lethal force. In fact, according to the video that was released recently: *"An auto insurance claim is less expensive than a lawyer on retainer"* Zimmerman was a trigger happy numb skull who should be as far away from a gun, than the earth is from the sun.

    Dahell!? What was the charge? I had someone come in an open door into my foyer, the weather was great and sunny, airing out the house. I said "Hello" as I was getting to my walker. Half a head peeked, it looked like the neighborhood delinquent, I knew he would beat the shit out of me if it got hand to hand. I dialed 911, put it on speaker, stuck it in my shirt pocket, talking to them, pistol in my strong hand, moving slowly toward the foyer/him. Saw him twice more partially, before I heard him bolt. Went and shut the door, and sat down on the couch and reholstered. Bam, bam, bam, I got up and yelled it's unlocked, Deputies came right in two of them, one went around north side, one went around the south side. lol 4 deputies in total. They did ask if I was armed, yes, they asked me to take it off while they scouted the woods and up and down the street. Okay, I had a paddle holster, took the whole thing off. Filed a report stating what I knew and who I thought it was, then they left. Mind you I had spoken with one a few times, which was about the kid I thought it was. Arrest you? Again *_DAHELL?_*

    Mr. Ayoob, I have watched your channel with Wilson Combat for a long time now, and had intended to write you regarding my background with your reputation. In the early 80 s, I spent three years in College in Davenport, IA. Upon moving to North Carolina I took up shooting, and had some good teachers. I read lots of books and magazines. I came upon your regular articles in one of the top gun magazines. I was particularly impressed by your analysis of a shootout between two groups, which in conclusion you revealed as the gunfight at the OK corral. To the point, in following months I began reading your description of an officer using his weapon to defend himself from a dangerous attacker, who was trying to take his service gun, and having to shoot the attacker, and the backlash of charges leveled at this officer. Imagine my surprise, when I saw the name Off. Randy Willems of Davenport. His wife worked as manager assistant with mine, and they were friends with whom we cooked out together at times. I was shocked, but amazed by your involvement in two trials which restored his job and reputation, even though it came at a high cost for Randy. And interestingly enough, I find myself adding this part which involves myself being attacked and threatened to be killed, and in self defense, finding Myself being charged due to the assailant lying about the situation, and bizarre handling by police. Having faced life threatening assault is traumatic enough, now facing court with charges of my own. It's real, and is happening to me.

    Thank you for the Video and mentioning the DAV, I’ve been following you and your articles for Decades and I’ve learned so much. I worry about using Lethal Force here in Virginia , my 2 Sons are active Duty and I watch my Grandchildren quite often and I’m always on Guard with the way things are going in the States now and being Disabled and Physically Broken from Spine issues protecting my Little ones. I of course would act and react immediately without thoughts of consequences but I stay proactive so it never happens but the Laws in Virginia are tailored to the Criminals rights unlike Florida where I lived for a few years with the Castle Doctrine.     Nothing in my 6 years of firearms training really prepared me for a 1974 gunfight w/three armed robbery suspects (you authored an article in a 2016 edition of American Handgunner). Our training had mostly been bulls eye w/our revolvers, and putting the empty brass in your pocket when reloading. All our range training changed after my experience that night and we began to learn to fight w/a gun, as opposed to get a good bully eye score and move on.That said, if you’re going to get formal training find an instructor that will teach you how to fight w/your gun. Mas Ayoob, or Clint Smith @ Thunder Ranch, come to mind.

    @AL It should work fine, as would any service caliber, but your best bet is to find out what the local police carry and get that. One shot stops are a myth, shot placement is what carries the day.

    14 months ago I was doing laundry before work when I noticed a large man picking on a little lady I moved in to defuse the situation and he began to bully me I tried walking away and he followed me and started touching me he then went after the lady as she exited the establishment yelling at her and hitting her window with his fist and cursing her as she drove away he then came back at me again and I kept telling him to stop and not to come near me but he kept getting closer, drooling, and snarling, with more hate, and anger than i've ever seen before in my life. I stood there, yelling at him to go away, and when he got arms distance from me I punched him three times in his face. the man was twice my size and I was very concerned for not only my own safety, but that of others as well. I let him get up and he called the police I was charged with Mayhem and assault with a deadly weapon I plead not guilty and waited in jail for 5 months.the judge suggested that I not testify on my own behalf so I did as he suggested and did not testify they refused my character witness and used my mother without my permission or consent they instructed my mother not to say anything about the fact I've never been arrested before and that I've been a security guard for the past 7 years I was convicted of assault inflicting great bodily injury and sentenced to two years in State Prison I did 9 months and I just got out on good behavior and I still don't see why they would want to ruin my life over this when I was just trying to help. Im glad that im alive, and everyone is ok i still feel so super violated by the system. It's insane.

    Succinct, accurate and sensible, even for New Zealand where I live. Here, self defence is a bit harder to prove if you use a gun because the law says that if you are not at the range, then the gun must be locked away, unless it is under your immediate supervision 'within the curtilage of your dwelling'. The police don't like that bit because it gives us the freedom, in fact, to be armed to some extent at home, and even if one's use of a firearm is justified self defence and the court agrees, they will try to prosecute under the storage laws and take your guns and licence. They even tried it in the case of an incident in a gun shop.....that one got thrown out....

    Great info! I just learn something very valuable from this video about self defense and WHEN can you use deadly force. Only when your life is hanging in the balance between just barely breathing to completely dead.

    1) im no proponent to BLM. 2) I, however do believe police reform needs to be addressed. ive seen on video of police officers knocking the crap and taking them to the pavement hard an [sometimes even elderly] unarmed person simply b/c the person barely touched them. by touching them, the officers use he/she did simple assault on me. --------------- if the person barely wiggles while being crushed from under their jackboots, they keep saying "quit resisting arrest", when the fact of the matter is they are pretty much torturing the poor hapless person. make no mistake, being a police officer is no easy task given the abundance of dregs out on the streets, but there are police out there that are truly evil powerr hungry sadistic scumbags who enjoy inflicting bodily harm on others for their respective "power addiction fix".

    The police have one difference between them, and everyone else. The police, by their duty, are REQUIRED to seek out, and confront malefactors and bring them to justice. Turning a blind eye, or walking away, is NOT on the menu of options a cop has. We private citizens, on the other hand, CAN walk away or turn a blind eye, in order to keep ourselves out of a dangerous situation. We are under NO duty to 'confront' the danger. We can just leave it alone. What goes with that... is a lot more training on a police officer's part, and a requirement to follow the procedures put forth by their agency, and by the government of the state they're certified in. The rules that apply to police use of force, include reviews of deadly force encounters, not just by the prosecutors and grand juries... but also by the police department's internal affairs unit and police administration. A cop who legally shoots a suspect and is found harmless by the justice system, CAN still LOSE THEIR JOB, or be subject to OTHER disciplinary action by their own police department, if it is found that the officer didn't follow proper procedures. Not to mention, they CAN be sued to the hilt... By the time all is said and done in an officer involved shooting situation... the police officer endures MORE and MORE IN DEPTH REVIEWS of their actions in those harrowing moments of violence... than ANY citizen who has to shoot someone, is.

    I learned in Universal Kempo just how fast someone can cover 15 feet with a knife in their hand. I'm a disabled veteran and my disabilities will no longer allow me to fight. Thus, I must carry. Thanks for this video - if I learned anything, it reemphasized that there's allot more to this than just carrying a gun. Once the lead leaves the barrel you can't take it back. Training is key to staying out of prison for defending yourself.

    Thank You, Sir. That was an excellent description of what is required to use lethal force. I'm a former Deputy Sheriff in Texas. This is what the general public needs to know. As a young Peace Officer, this realization of the presence of lethal force, in any encounter with a citizen, was the single, most important thought in the back of my mind. Observe, direct, and command, in a criminal contact. I would apologize later, if I seemed rude to anyone whom I found to be, shall I say, in the wrong place at the wrong time. I was sworn to my duty, and took that duty very seriously. Thank You again, Sir.
