    I bought my wife a used Volkswagen Beetle convertible last year from a Toyota dealer. About a week after delivery, the top failed, the locking mechanism fried and VW wanted $2,000 to fix it. The car was as-is, I signed a waiver saying as-is. I wasn’t mad because the dealer had 0 indicators that the top would fail after delivery. But, I called the dealer, they offered to pay all but $300 to VW to fix it. I agreed. Because of that, I bought another car from them a year later and they gave me $3,500 off MSRP on a new Camry when they were sold out entirely of all new cars and selling whatever they had for MSRP

    And it's not like you HAVE to buy an As-Is used car. I bought a GM certified lease trade in Traverse once with bumper to bumper for a year included, you just pay more. Have bought many as-is cars and understand what that means. But I also paid less for those to assume the risk.

    I bought a 2017 Bolt AS-IS from a Nissan dealer. None of us noticed how bad the steering rack was. Everyone missed it. After driving home an hour away I figured it out, and they replaced it at no charge. He was happy to help me and said it's a lot easier when you come to them quickly, and not half a year later. I don't know if I'll want a new Nissan anytime, but I'll check their lot when I need to buy something.

    @@ChevyDude if you plan on repairing all repairs on all cars you sell (even after 10K miles with no warranty), then you will be out of business in no time. I suspect you won't be out of business, but instead you will not actually pay customers repair bills on non-warranty covered cars (especially ones driven 10K + miles, before it breaks down). If you are saying you "would have" covered the cost for them under this situation, then why not cover everyone's problems without them paying for a warranty?

    Aftermarket warranties will fight you on actually paying. Shops will also ignore you most of the time when they know that it's going to be paid from aftermarket warranty. I went in multiple times about a transmission issue said they didn't notice it . Strange they did after the warranty ended.

    Why anyone in the car business deals with high mileage CVT Nissans is a mystery to me. They've been known to self destruct for 7 years now. As soon as the signs of problems start popping up they send them to auction. It will be impossible to tell disaster is on the horizon unless you drive it for a couple of hours and get the trans to top temps and really give it some exercise. .

    Exactly. You're only asking for problems and Mike knowing about this, 4:45 he only brought this problem upon himself. He probably got a great deal on the Rogue and took a risk/gamble to make a very good profit...but it came back to bite him. I did hear him say in the last video that he will probably stay away from these problem vehicles in the future. He should have taken his own experience and knowledge and passed on this vehicle from the beginning...this could have all been avoided. Reputation is worth a lot more than making a few thousand dollars from selling a known problem vehicle.

    I work for a aftermarket warranty company as an adjuster and if I were you I would be very careful about saying these warranties are bumper to bumper. They state the components they cover and I urge you to read over the contracts in full with the customers. Also make sure you let them know that on an engine or trans claims they will be without their cars for weeks on end if not a month. And the rental is for 5 days max at 30.00 per day

    I would have not offered a settlement and push to shove go to court. You are right they had attorney bills so I would have waited to see how far they were willing to go. But I do understand your view point and thanks for being honest.

Doing the right thing is for honest customers who bear no fault or blame or try to regnotiate completed deals with set terms and boundaries.

    Wish my last dealership experience was with someone like you. A week and a half after signing and trading in our old vehicle to pick up our new vehicle. I receive a phone call from the salesman saying they miscalculated the 10 day payoff and I owed about 30 dollars. No big deal, I went down to pay it and went along with my day. Something didn’t sit right about that afterwards when I had time to digest and think about it. I called and once again was told the payoff was calculated wrong. Not happy with that answer I showed up in person and talked to the finance department for a while. All to finally get a different answer to as what the 30 dollars was actually for. It was for a next day transfer for funds to my bank for the payoff of the traded in vehicle. I once again talked to the salesman who did not apologies or try to make it right, instead he told me he would keep it in mind for future deals or whatever half assed excuse he gave me. To me it feels like I was being punished for a mistake they made, and I was the one who took the fit for expediting the payoff. If that was a fee that is regularly charged it should have been in the contract at the time of signing. I also tried calling and emailing the dealership to no avail. At the end of the day it is the principle of being lied to and being told one thing, only to find out it was something else entirely. Rubs me the wrong way. Thanks for listening to me rant I am still upset about this haha

    The biggest thing to get from this situation is DO NOT sell a vehicle to any person who would spend there own money to buy a Nissan. If you have someone willing to buy a Nissan they have something wrong with them. I bet they also tried to go after there insurance for this because that’s the type of person. Who gets a Nissan. But I also bet they didn’t pay there insurance as well since that’s one of the highest brands to drive uninsured as well.

    Are you telling us the full story? Why offer them $500+detail at all? They drove 11k miles. THEN you go into not disclosing the settlement to protect them? What kind of BS is that? The settlement doesn’t dox the customer in any way. All-in-all, this is a great example of why dealerships do what they do to make money. This cost you over $3k + your time to help build your case. Now Mike your a small business, imagine larger dealership. Say your time is worth $100/hr. Say 10hrs per case = $1k. So $4k per case x 5 a year? $20k down the drain every year!!!!

    I purchased an 07 Toyota Camry earlier this year, the car had 61K miles on it and it looked and drove like it just left the show room floor, I paid $11,500 for it and it had maintenance records all the way back to when it was new. This was a single owner car and he had virtually everything done at the Toyota dealership. I was thinking about getting an after market warranty, but dad looked it over and said don't wast your money with this car, this was a nice automobile. Now dad himself purchased after market warranties on the 99 Lincoln Continental and 2004 Jeep Grand Cherokee and with both vehicles he got AAMCO rebuilt transmissions off the warranties. He's driving a 13 RAV4 he paid #14,000 for three years ago, he didn't get a warranty on that car and the only thing that car required was a valve cover gasket replacement and he found that problem the second day after he purchased it, so the dealer replaced it free. A well maintained Toyota, or Honda are almost bullet proof, Nissan's and junk, same thing with anything used from the German manufactures.

    I’ve been a mechanic for a long time. I’ve also worked in predictive maintenance and failure mode analysis. I can tell you with 100% certainty failures happen suddenly. If you look at failure mode analysis charts, failure happens suddenly and they only way to catch them early is through fluid analysis at regular intervals that will identify problems early. Also vibration analysis taken over time to get a baseline when new and over time as parts degrade. No one does this outside of large expensive industrial equipment.

Never offer anything if you have nothing to prove you did wrong in the first place or if you didn’t do anything wrong to begin with… a jury and judge will see this as a weird thing to do if you really did no wrong? They might side against you because of you offering a settlement…. The party suing you, their attorney will see this as a WIN since you offered a settlement in the first place…… you know this man! We are all routing for you!

    Wow that price for extended warranty was a better deal than what I purchased. The highest cost issue covered under the extended warranty was a new transmission failed by internal damage running at $9,500 including 2 months of rental car coverage. I'm glad that I had the warranty and that the trans failure was not of lack of maintenance.

    Nissan was a partner in JATCO Transmissions. JATCO means "Junk Another Transmission Company", and they build an awful cheap CVT transmission Nissan used for several years.

    You and your attorney handled the situation masterfully. I am an attorney and I represent car dealers. I have one particular car dealer, who is one of the most generous, understanding owners you could possibly ask for as a customer. He would always try to take care of the customer. However, in situations where he believed the customer was trying to take advantage of his dealership, he took a no holds, barred approach. I had strict instructions that he would pay me whatever it costs, but he would not pay the customer a dime. The lesson for customers is try and be reasonable and understanding. Things will happen and it is not always the dealers fault. Try and amicably work with the dealer. If it is not reciprocated and the dealer is the unreasonable one then by all means head down the litigation route.

    In the state of Indiana they have something called Goodwill warranty and you really have to be careful after the sale because they will stand up in court just a thought thank you love your videos

    I can't believe you offered a settlement. Make sure when they come back later wanting it you tell them that it's off the table. Wait for them to sue you, then start filing motions to dismiss. If it doesn't get dismissed, file a counter-suit for legal fees since they are filing a frivolous case. The sales contract dominates this "as is" sale, they have a 0% chance of winning.

    I had an oil change and spark plug change awhile back and shortly after I started having multiple issues with my Tacoma. It ended up being that bad oil change that eventually ended up requiring a whole new engine on 150,000 mile Tacoma. That is unheard of. Be careful where you get oil changes.

    lesson I learned---never offer any money as settlement if you are not liable as a court sees this as admitting some liability. As an auto repair business I have insurance for this type of situation and when it comes up I tell them to call the insurance adjuster. I never hear about it again.

    At the used car dealer, I worked at in the early 2000's any used car would be marked on the Buyer's Guide AS-IS IN TOW AWAY CONDITION in big bold letters. IN my state some customer tried tio sue then and the judge thew them out court he said that they brought it in TOW AWAY CONDITION.

    Mike trying to be the nice guy opens you up for more people who will try to take advantage of you. I also see the point that taking care of your customers helps spread your name and reputation. The thing I feel people need to do before buying a new to them vehicle is research! The buyer needs to research the vehicle they are buying to figure out what problems are most common on them. As a dealer/salesman you yourself probably have a lot of knowledge on what problems plague a lot of different vehicles. My father purchased a 2016 Focus, although he loves it, he has already had the dual clutch problem twice. The first one was at less than 65k and the second at less than 100k. The car is going strong and he will probably keep it until it's out of the extended warranty period. So the next problem is you sold it as is without any implied warranty, and your customer signed that paperwork. I really understand that you would not sell cars if you had to point out any known flaws or problems that they experience, but once again I put that on the customer research is the key. I also respect that you have the decency to go above and beyond to keep your customers happy, but you should also no when to say no. Keep up the good work at showing people that just because you have a title of car sales person doesn't mean your all bad. I know two people that have been decent upstanding guy's, and they have both went above and beyond to help me out, as well as my father.

When someone goes into a used car dealer they have to know what THEY are talking about. mutual distrust is a great equalizer, NO ONE trusts anyone so that paperwork is KEY, and as a friend of mine used to say " Hey this is the car business, get over it" Great video

    I have had relatively good experiences buying cars except one that sold me a car that he passed state inspection by patching the muffler instead of replacing it. I was POed and he made it right with a proper muffler replacement. The only time I got burned was when I bought a car private from a friend.

    My wife and I bought a used mini cooper, and a month after we bought it, we put about 3k worth of parts into it… but we bought a used car… we knew what we were getting into… we still love the car at almost 200k miles!!! You buy a used car, expect something to break. Budget for it people.

    Yeah, the Nissan CVT’s used to notorious for failure. Perhaps, regular CVT oil changes could have prevented this but you never know the true maintenance history of a car unless you have the records.

    @@ChevyDude Right. I know your trying to do clean business, or at least claim to I don't know I'm nowhere near you. But I did briefly work in used car sales and doc fees and warranties are never favorable to the customer. Took half hour/45 mins to do all the paperwork and the place I was at charged $399. The warranties are available directly to a customer outside the dealer for far less. I just couldn't get behind the business model because they seemed like unnecessary add ons. There's certain states that have set doc fees ($75 in Washington state if I remember right). I felt like I was stealing, I lasted 2 weeks. Didn't matter, it was a retirement job.

    Not as bad as an old customer rings me last week and wants their cctv system repaired under warranty 😮. Only thing is, I installed it in 2018😂 so it’s way out of warranty. The customer said “I’m sure it’s got 5 years warranty” 😂. Never accept what someone says, bring receipts

    Mike while your definitely aren't liable for this. Don't you feel a moral obligation moving forward to not buy cars with major recalls such as the Nissan transmission or the kia engine recall or the Ford transmission recall. I purposely will not sell these cars to my customers because someone is going to be caught holding the bag and it's either us or them.

    I think it's on the consumer to simply l search "carmanu carmodel pattern failures" and to reach out to a dealer for any open recalls and TSB's based on the VIN#. My dad was looking at a used Forerunner and doing those two things yielded that the transmission lines were ran into the radiator and often failed resulting in a ruined transmission and that the frames were susceptible to rot (not good in NE Ohio).

    If the vehicle was serviced at four different locations,was it just oil changes or ,did they also have the transmission fluid changed or even worse, flushed? If they did,there is a very strong chance that was the cause of the transmission failure.

    Yes, Nissan tranny's are very fragile. They require regular interval changes just like an engine oil change even though it's nearly 25.00 a qt. I had '13 Altima CVT replacement, in '18. It was 3500 then for a remanufactured CVT. So now I do a partial CVT oil change every 10k. Did the first one at 30k. It takes about 3.75 qts and the procedure to check level is not that difficult once you understand the concept. It's refreshing to see open and honest used car salesman, even though you still sound like a used car salesman.

    It's amazing that when you're at a used car dealer, the salespeople will say 100 thousand miles isn't that big of a deal! However, if you have any issues with a car after you purchased it ,all of a sudden, 100 thousand miles becomes a thing ! They immediately say ,"Well, of course you have issues because it has over 100 thousand miles on it!" Lol! The bottom line is never ever trust a car salesman and never ever buy a high mileage car! You're only asking for problems if you do.

    Years ago I did retail in a computer business. This was when you could build a system and still make money. To tell you how far back that was let me say this.. "You got mail" was a big deal at that time. We had a customer come in and we built a machine and did not hear from them for over 7 months. Then we get a letter in the mail saying the company was being sued for false advertisement and theft. They wanted the cost of the machine + 25% for their lost time. Found out the person that purchased the computer had a relative that had just passed the bar and they were suing anyone and everybody they had made purchases from. Luckily the owner of the company had a sister that was an attorney and she handled it. Not only did we not pay but we found out later that the new lawyer in the family was sanctioned by the court for bringing frivolous lawsuits. The attorney that we had filed those motions after getting all the info on all the lawsuits filed by that lawyer that were all filed within 2 days, totaling 47 lawsuits. Sometimes karma does work!

    Damage to the transmission, lines, cooler, wiring, etc could have been caused when that lower cover was damaged and depending on the damage done could cause transmission failure at a later time. e.g transmission line gets partially restricted from being pinched could slowly starve a transmission of fluid and cause excessive heat due to the restriction of flow to/from the cooler.
