    Not quite the same thing. Buying cocaine is illegal, paying hush money to a porn star is not illegal. So there isn’t correctly a parallel there. This isn’t an easy one to get a clear route to convict on it seems to me. It seems remarkable that Michael Cohen was convicted and served time on this same issue and Trump was more or less identified as a co conspirator at that time and yet it seems difficult to convict him. What will be really interesting is what will happen now if they fail to get a conviction for Trump, will Cohen then go back and sue on the basis of a wrongful conviction, it would seem he would be justified.

    Furthermore the post of "personal attorney" putting Cohen on something disguised as legal retainer is simply to hide the crime showing intent. Trump's disclosed to a court "reimbursements to Cohen" in civil legal case with Stormy Daniels which she confirmed on stand and Trump described it as reimbursement too. Falsely describing the payment incurred tax liability causing grossing up, so the finance department also have to be incompetent and Trump willing to over pay, when he jumped on the word finance for friend David. Simple explanation is Trump over paid Cohen BECAUSE it was a crime and he was buying silence.

The prosecution is alleging that the mislabeling is in furtherance of a second crime. Though the prosecution has not stated what the second crime is. That is why this was not prosecuted by the former DA.

    You should definitely work for the IRS because they actually accepted and declined to audit the 1099’s that named the payments legal services. They actually were taking into account a letter from Michael Cohens attorney that explicitly stated the payments were legit.

    He signed them in 2017. This case hinges on him paying money to influence the 2016 election, other wise the “fraudulent” business records are a misdemeanor and past their statute of limitations.     The supposed crime is interfering in the presidential election of 2016. Here are the problems: NY has no federal authority to investigate or prosecute a federal election case. They must prove the case they don’t have the authority to prosecute in order to magically extend the statute of limitations on the misdemeanors. Furthermore, the payments weren’t even made until 2017. How can they influence the 2016 election? Even the most basic logic test destroys this case. It really is an embarrassment for NY and all the Trump haters.
