    @@elijahandrews5901 Nah the mother is hoping to paint her son as a potential victim. a good person trying to be the "best he can be" gunned down. When the facts are her son would still be alive still "being the best he can be" if he didn't swing a gun around robbing people. It turned out to be airsoft but perception is 90% of guns. Fake gun or real gun if they believed their lives may be at risk from it the gun was real in that situation. Equivilant of having unloaded gun

    Self defense is one thing. He likely died after the first 4 shots and that was deserved. The extra 4 shots is a bit of grey area but that last shot was simply ensuring he was dead. If he wasn't dead, that would be an execution. He was shot 8 time and disarmed. This was extremely excessive. If you claim to uphold and support the Constitution, then this shouldn't sit right with you.

    @@eric98292 100% To many idiots love to talk about how they support the 2nd, but they are totally willing to ignore everything else. This very quickly turned from self defense to an execution and a murder. The first 4 shots were self defense, but the rest were not at all. When people think that criminals never can be victims, then you know they have totally lost all sorts of ethics and morale. We can all think that the robber might have been a proper scumbag, but that still do not defend him getting killed in that manner. If he had been shot only the 4 first shots and died from that, then it would be no problem. There are no doubts that the man killing the robber didn't only want to neutralize the robber and stop the threat. He wanted to kill him and he wanted to be totally sure that he killed him, even if he wasn't any threat to anyone anymore. If that mans gets away with it, then it shows that the justice system has zero respect for the law they are there to uphold.

    I believe that if anybody pulls out a gun (or even make believe gun) and threatens people’s lives with it they should know they are risking their own. The man thought he had a gun, and neutralized the threat. It’s easy to look at this situation slowed down and judge it, but it was probably scary for him and he was just trying to keep himself and everyone around him safe.

    I agree, with your first statement about threatening somebody with a fake gun. It's really common sense, you would think. At the same time from this video and how the quote-unquote Good Samaritan reacted. That guy should not legally own a firearm.

    Statistics show that the US prison system alters people's mindsets and is part of the reason they are repeat offenders. They truly could be turning their life around. But as you heard in the story, he was financially having a hard time. Mix that with criminal background and already having served time, he truly might not have felt as if he had any other options. But in his defense, he didn't commit that crime with a real gun so obviously his intentions, based on assumption of his actions, were not to harm anyone involved

    @@sjl9942 not at all downplaying that. I made a solo comment on this thread stating a very flat opinion that BOTH guys are at fault and the shooter needs to be charged. That wasn't the reason I commented what I did. The focus of my response on this particular comment was trying to shed some light on how someone with a prison complex in the US is more than doomed to rehabilitate because of the commonly held attitude that you're putting on clear display. It's almost impossible for singular offenders to not become repeat offenders because there isn't much done within the prison system to help rehabilitate prisoners to integrate back into civilian life nor are the civilians they integrate with forgiving of their criminal background. And that's BEFORE you factor in things like ethnicity, gender biases, etc.

The one to the head after he has secured the burgler's gun was illegal AF. He is going to be convicted or murder 2 based off that shot.

    @@chippytea.no way to know that in the moment. As long as the gun is in his hand he’s a threat. He could’ve turned around and starting shooting at any time for no reason. You never know. Once you pull out a gun on random people you are an active threat and sacrificing your privilege to live until that gun is off your person

All jokes aside, obviously you shouldn't shoot people if their "gun" is visually, and logically, not a gun. Like if someone drew a gun on a scrapped piece of paper and ran around with it. Just to be safe, why not shoot them all? My point is that there is still an ounce of common sense involved. Airsoft gun is very reasonably mistaken for a real gun. You can even argue that a nerf gun may be a real gun disguised as a nerf gun. But there are obviously some things that are obviously not guns and are physically incapable of firing a bullet.

    The nine shots were no doubt excessive. The guy started pointing the gun at innocent people eating or waiting for their meal. That is enough for someone to feel that their life is threatened and defend themselves. If he did the robbery without pointing the gun at everyone and just did what he needed to do at the register to get the money and go, he still might be alive. In that case, the only person he is really directly threatening is the person at the register and that person can defend them self or not, but it didn't go down like that.

    First , I’m an older male gun owner . I detest violence of any kind . Protecting yourself is not violence in my view . Second , when you present yourself as having a weapon and , obviously , willing to use it , establishing whether or not it is real is the last thought on anyone’s mind ! Third , I personally believe that once the perpetrator fell and dropped his weapon the threat was over and any further “defense” was uncalled for . Lastly , the man shouldn’t have taken ANY further action and remained on scene to speak with the authorities .

    Couldn’t have said it any better. I’m a younger male gun owner, and I saw the mistakes and so many things could’ve gone South if it wasn’t for the security camera. First of all, he shouldn’t have left the scene. Secondly, he should’ve never touched the criminals gun if the criminal wasn’t reaching for it.

    As someone actually turning their life around, it's never once occurred to me to include armed robbery as part of this process. Being sober for ten years, finally getting a job worth a fuck, and holding myself accountable for thjngs and not blaming others are much more constructive than eating a glock mag because I tried to rob a restaurant with a fake gun. I guess sometimes people find it hard to accept some people are just too ego driven, stupid, and selfish to not end up filtered out by their own actions. The CCW guy did nothing wrong.

    You are the real mvp my guy. I’ve been sober for 6 years now and that’s a struggle a lot of people will never understand. Hardest thing I ever had to do was get sober and I didn’t have a cake childhood. You manned up and changed your ways for the betterment of yourself and our society. Whereas the guy in the video is just a selfish asshole taking shortcuts and robbing other hard working people of their money. The world is literally a better place.

    @@adroitone8911until you have been in such situations you have no room to tell others anything. I was 15 when I was in a shooting and the person who got shot survived thank god but you always make sure they are no longer a threat and while I agree that the head shot was probably not necessary when you see a gun getting waived in your face you don’t care about the person doing it and you do what you gotta do to protect yourself and others . Until you feel the fear you have no right to judge someone who had a millionth of a second to detect, interpret, plan and act when life is on the line or the rush of adrenaline from it. I have carried a gun for over 20 years since legally being allowed to and by the grace of god I have never had to use it but if it is my life , family or other innocent people on the line I will gladly lay down my life to protect them and myself and if I die from it so be it .

I’m pretty confident in that situation I wouldn’t shoot someone who’s face down with four bullet holes in them and their weapon a meter away, and then flee the scene.     As a corrections officer, we had a saying... When you have to use force on an inmate, get all you want (or can) the first time around, you get to go back for seconds. To me, although the criminal got what was rightfully his, when the guy shot him in the back, that was wrong, he went too far. When he shot the guy in the head while on the ground, he definitely crossed a line.

    Once you pull a gun on people to commit ANY type of criminal act, then ALL bets are off. Just know that here in TEXAS, if you commit a crime with a gun then your life is in just as much danger as you are putting your victims in. And if you get shot in the criminal act that you started, then that is on you.

    Some guns are so realistic they can have interchangable parts! Like there are mags converted from real mags. Stocks usually for some bolties and some use standard m4 buffer tube stocks and pistol grips can ve interchangable in some cases

    That's actually crazy. I know that living in another, safer country (Poland) I have different perspective, and I almose never carry a concealed gun, except when I actually go to the shooting range. Not defending the perpetrator, he took the risk, but from the perspective of our law this would be clearly a murder - first 4 shots justified, self-defence (yet I would face the court to check if it wasn't excessive), but shooting unarmed person on the ground, finishing him with a headshot, and then LEAVING THE SCENE would certainly put me in prison for years.

    Correct, the 26 is the subcompact, 19 compact, and the 17 the full size for 9mm. For .40 it's 27, 23, and 22 respectively. The same exact frames, just different sized barrels.

    I spent 22 years as a court reporting hearing all sorts of cases. Knowing a little about the law - not enough to practice law, however - my experience tells me that the definition of defensive shooting is basically to only do enough to disable the threat. Four quick shots, the perpetrator fell to the ground and released his grip on the gun. Then when the defensive shooter grabbed the bad guy’s gun, and saw that the bad guy was not moving, that constituted the definition of a “disabled perpetrator.” It is at that point that the defensive shooter should have stopped. The defensive shooter should have then stepped back from the body, called 911, and kept his gun pointed at the perpetrator lest the perpetrator gets back up to attack again. The defensive shooter should have kept that position of defense-at-ready until law enforcement arrived, at which time the defensive shooter would lay down his gun at his feet, put his hands up and indicate to the police that he was a defensive shooter who stopped a robbery and possible attempted murder by the bad guy.     Nice little head canon you got there. My grandpa was a police chief, my mom worked in IID and my brother is currently a Sheriff my entire family has been in law enforcement since Texas encompassed Oklahoma and New Mexico. They'll all tell you, empty your clip into them or only stop shooting until the guy is dead. The only thing that is morally ambiguous is that final headshot but I doubt he'll get charges pressed on him.

    It is likely that if he had stopped after the first 4, they would not even try and prosecute. At that point his court costs would be pretty much non-existent. However, that doesn't mean family won't try and go after him in civil court.

    If the four original shots were fatal it probably won't make a difference criminally regards how distasteful it might be. People need to use their brains and not allow their emotions to get the better of them. Agree his life will probably be ruined financially unless his income is protected from civil litigation like Social Security and even if not look at what he was driving, what are they going to get?

    On the face of it, the last five shots do seem inappropriate, certainly the 9th shot does. However, you cannot kill a person twice. If the first or any of the first four shots were fatal, the next five are irrelevant to a murder charge. At most, the next five shots might be considered desecration of a corpse. This topic was not mentioned in your video. Until the ME discloses which bullet killed him, there is no point in having a discussion about the legality of this event.

    Criminal charges would most likely be filed against the defensive shooter. The reason why is because that headshot is considered as deliberate murder because the suspect not able to do do do anything to harm anyone else at that moment. The shooter was disabled after the 4 rounds to the back and therefore the shooter was deemed disabled.

    I think the head shot is what is freaking many (IDK their positions) people out. I can only guess that when confronted by a real threat to your life. It’s automatic! You fire till there are no more bullets! I once overheard retired LE say that when the Beretta 92 was issued in 1985 it gave LE 9 more rounds (15) than the traditional 6 on revolvers. I’ve done a combat challenge with a revolver. It’s not fun having to reload every other station Vs every three or four with a semi automatic. John Brownings HP 35 came out with 13 rounds in 1935. European LEs grabbed them immediately for double the normal capacity. It took the US fifty years to figure out what everybody already knew! Put more rounds down range to stop a threat…Any threat!

I’m paraphrasing. “When you discharge your weapon causing a death place it (unloaded) down on the ground away from you or anyone else!     Of course the head shot was excessive, but so were the 4 shots after the armed robber was on the ground and no longer in control of his weapon. If this were a CSI show, the decision of whether or not to file charges against the defensive shooter would depend on which shot was the kill shot.

    Before I got a badge, the rule is, when the threat stops, so does the shooting. When the actor and the gun are separated, the threat ended. You take control of the weapon, and stand down. Remain vigilant in the event the actor has an accomplice. Wait for help to arrive.

    What’s the “jail system”? I thought people went to jail as punishment for a crime. Are you saying jail should include mandatory rehabilitation?     The shots after the first 4 were not necessary after the bad guy was down and no longer had control of the weapon. The only conceivable reason I could see him giving for leaving is the propensity for mob retribution that has been rampant for quite a while could occur quickly. If he feared that, he should have driven directly to a nearby police station and reported what happened.

    I totally agree. The moment he continued to shoot in the back of the robber after he fell to the floor, it changed from self defense to murder. And the last shot in the head, totally confirmed it was murder and not self defense anymore. Not justified at all. Letting the man getting away with it, is just mocking the law, no matter how much we might think that the robber deserved it.

    I don't think he should go to prison. Criminals too often get leniency even when most don't agree. This guy did society a favor and saved them a lot of money. The criminal recently got released from prison and quickly got involved in committing a robbery and I believe most of these type of felons do until caught. The criminal caused the circumstances that arose from his actions. Hopefully this case does go to trial and the jury don't find him guilty. We need a win for the good guys.

    @@advertslaxxor you dont, but sadly in most stand your ground states, unless they reach for said secondary weapon, if they are doing their best rag doll impersonation, and you keep shooting, yer considered the aggressor now. kicking the dudes gun away and standing watch incase he did something stupid is literally the only reason indiana didnt put my butt in jail also after a similar situation.

    He hasn’t even been arrested. He turned himself in a few days later and the cops questioned him and released him.

    @@pacoviedo6304 Wie gesagt, ich kenne die Gesetzeslage in Texas nicht. Im Deutschen Strafgesetzbuch steht unter § 33 StGB: " Überschreitet der Angegriffene die Grenzen der Notwehr aus Verwirrung, Furcht oder Schrecken, so wird er nicht bestraft". Wenn Dich jemand z.B. - Gott behüte - mit einem Messer angreift und Du Dich mit einem Hammer zur Wehr setzt und dabei aus lauter Angst oder Panik heraus vielleicht zweimal mehr zuschlägst als medizinisch zur Gefahrenabwehr nötig gewesen wäre, würdest Du straffrei bleiben. Und verstehe mich bitte richtig: es ist nicht so, dass ich dieses Vorgehen hier im Video grundsätzlich GUT finde oder Selbstjustiz großzügig unter "dumm gelaufen" befürworte - einen Menschen zu töten, auch wenn es in Notwehr geschieht, ist immer extrem furchtbar. Aber objektiv kann ich nicht umhin, dem Opfer hier eine erhebliche leichtsinnige Mitschuld zuzusprechen. Grüße GDN

    The first 4 shots were justified You do what you must to eliminate danger However once the guy was on the floor no more shots were nessisary

    The guy was down and dying by the time he hit the floor. You lose the angle of "self defense" when you walk up to a neutralized threat and take pot shots at their head. This guy ain't a hero, he's an idiot with a massive ego.
