From what I'm reading in comments, opinions are mixed but most people think that mentioning the tie is dirty but probably not an attempt at stolen valor.     Mitchel is going for the record in the 100% category in frivolous lawsuits. This is one of the most difficult levels where you have to convince a judge to not dismiss a case that he legally must dismiss. He tried the sucking up strats, the blaming the defendant strats, and even the "I know a celebrity" glitch. But he still failed. That's why there are so few that go for the record in this category.

    @Peasant It's perfectly comprehendible. Billy though that just by filing a law suit with big scary numbers that TG would just give in and fold like how others did before. But TG/Jace hall didn't budge. I doubt Billy thought it would ever make it this far and was caught with his pants down as a result. The video is him trying to scramble a defense.

Katy Perry won her plagiarism/copyright case (Dark Horse) because her lawyers asked for the case to be dismissed prior to the trial or something, which was something that Robin Thicke, T.I. and Pharrell's lawyers did not do (Blurred Lines) in their lawsuit.

    Third generation US service member here, USAF. That West Point tie is not “stolen valor.” Military colleges, like Annapolis, West Point, or the AF Academy, sell tons of merchandise, just like any other collegiate institution. Billy is just trying to score any sort of brown nosing points with the judge by showing false support for the judge’s personal affiliation for that school. Stolen valor only comes into play when the only discernible reason for the service related comment or projection is to make those around them think they themselves serve(d) in the military. As much as I hate Billy, he wasn’t guilty of this.

    My son is a Corporal in the US Marine Corps, and I often wear a USMC hat to support him. If anyone asks me about it I tell them that. It's OK. Stolen Valor (in the US) is defined as lying about service or award received for the purpose of obtaining monetary or other tangible benefit. It's fine to wear signs that support the military as long as you don't claim (for example) you were a bad ass Navy Seal with two silver stars and a purple heart, but now have PTSD and need money to pay the rent. It's a bit like wearing apparel with your favorite football team on it. just because you wear the jersey, no one is going to assume you play for Manchester United.

    The West Point tie is not stolen valor. Stolen valor is a specific crime that requires specific criteria to be met. He’s wearing the tie and pointing it out to try and manipulate the judge, but it is not stolen valor. Stolen valor refers to fraudulently claiming certain valor awards for a tangible benefit or financial gain. The list is specific and does not include wearing a West Point tie.

    The simple fact of the matter is that Mitchell seems unaware of here is that the hearing is, at that point, a formality. The only possible outcome is that the case will be dismissed for lack of prosecution. The time to present facts has long since passed. If he really wanted to pursue the case, the excuse that the defendant was unreachable would have needed to be made when the original order to show cause was filed. That all aside, many states require business entities to have an agency that accepts legal documents on their behalf by a process server. Which is to say that all he would have needed to do was provide receipt of service to Twin Galaxies. Then the onus would have been on TG to reply to the summons, file their answer, etc. 😒
