Ashley Smith : Out of Control (2010) - the fifth estate

Ashley Smith was a troubled 19-year-old when she choked herself to death with a strip of cloth at Grand Valley Institution in Kitchener, Ontario. Her death made national headlines and led to a scathing report by Canada’s federal prison ombudsman. Now, through exclusive access to prison video exposing Ashley’s treatment in custody, the fifth estate shares the story of this young woman’s harrowing life and the circumstances surrounding her death.
Ashley Smith was barely into her teens when she was sent to a youth detention centre in her home province of New Brunswick. Her crime: she had tossed crabapples at a mailman. Smith’s one-month sentence would stretch to almost four years, served in 11 institutions in 5 provinces.
To tell Ashley’s story, the fifth estate fought for and gained access to shocking prison video, showing Smith being subdued by physical force, pepper sprayed, and cocooned in a completely restrictive body bag called “the wrap”. The longer Smith was confined to her various segregation cells, the worse her behaviour became and the more extreme, and frequent, the punishments. What she really needed was mental health assessment and treatment. She never got it.
How did a girl from a loving family die the way she did? With the prison videotapes and exclusive access to Smith’s parents, along with a fellow inmate, the fifth estate and reporter Hana Gartner expose a system that fails the many Ashley Smiths still incarcerated in Canadian institutions.

    Anyone a child that is incarcerated threatning suicide or trying to complete suicide should have a mental health assessment. And a plan for treatment put in place,

    Her parents never disciplined her, they let her get to an immense size and she was a danger to society. Her parents failed her by not raising her correctly, they only thing mentioned here was she was learning disabled. I wouldn’t want this woman walking the streets, she was out of control and HUGE! That’s a good point you make, everyone failed her.

That would turn most feral; compound it that she did have mental illness. I agree that everyone failed her from the juvenile system all the way through the corrections system!     That may be true. But the real question is what does proper treatment look like? If a psychiatrist can’t get near her because she out of control. If you have to pin her down to accept medication and she can’t safely be around other people what is the answer. Ultimately you are left with the same result. Isolation and restraint of an individual that is a harm to herself and others. If you’re going to blame the correctional officers then you need to suggest a safe alternative. What do you do if reasoning and negotiation go out the window?

    Gavin Cole I agree with both of you. There was definitely a need for mental health and behavioral issues but she was out of control. These correctional officers are not to blame really. They only do what they've been taught to do. What they are equipped to handle. If her own mother and father couldn't handle her or anyone else then how can we place blame on the officers? The girl was strangling herself repeatedly! Constantly! If my child was doing that, I'd get them some mental help and I'd tie them down too in a heartbeat if it persisted. She had some emotional issues for sure. Something does need to change though. I just don't know what and obviously others don't know either or I'd say they would be doing that instead. However, again, the officers aren't to blame. Some correctional officers are jerks but in this situation, what else could they have personally done for this particular girls who was out of control? Maybe they could've been kinder? I don't know. I just know this story saddens me but we have to place blame where it goes and that isn't on people who are just doing their jobs.

    @@gavincole9733 appears to me that she never had a chance to leave isolation that started the day she arrived. There wasn't psychiatric treatment until long after she had been in isolation. I think the isolation alone would give the most stable adult mental health problems. She was a teen with 2 minor offenses when incarcerated. I can't see how this inhumane treatment was even allowed in today's society. It's barbaric!!! The system escalated the problems and created her downward spiral. And to just stand there while she died!!! No one deserves to be treated like this. So unreal and mindboggling that this is truly happening and she wasn't the only one receiving this treatment. And it sounded like it was still being used. If you think being locked down at home during the current covid-19 crisis was hard, it's heaven compared to the treatment of a teenage child who didn't even live long enough for her brain to finish developing. You know, the frontal cortex that allows us to make rational decisions, it can take until 25 years of age to be fully functional, true for every human.

    ..... what type of 21st century system is this? If that had taken place at home it would have been a case of “ child abuse”.... this has shocked the living daylights out of me. 3 burley intimidating men entering a cell placing their hands around a teenagers neck pushed up against a wall with the weight of one man leaning on you let alone two or three is UNacceptable. You don’t TORMENT the mentally tormented.... you TREAT THEM!😡😡 FIX the friggin system..... IT IS BROKEN!.     @Carol Watkins .... as a child I thought what a wonderful world we live ... and in my childhood years of wonderful, I grew up to discover as an adult .... that the ‘ wonderful’ I knew as a child, wasn’t that wonderful at all. There should have been a public outcry and investigation into the treatment and death of this girl long before this footage was uploaded. I’m disgusted in the behaviour displayed by these cowards. Not one man put their job on the line to render assistant to a child’s life that was slowly slipping away in front of them .... gutless somewhat? That alone speaks volumes as to what ‘ type’ of men we can see in facilities such as this ... nothing but sadists. This facility should be completely ‘RESTAFFED’ imo. blessings ✨

    Hmmmm.. well she was not complying when they asked her to. what should they do? I work in the mental health field and some people are dangerous to themselves or others. Unless you're in the situation, you can't comment.

    This kid arrived to her adoptive parents at 5 days old. Mental health issues are impacted by social support available. Everyone who encountered that infant up until she was taken away (in her teens) for anti social/hostile/degenerate, criminal behavior should be scrutinized and held just as accountable as the prison system that was forced to deal with the mess that kid was when she entered their system. These problems for significant and severe way before she ended up being a ward of the government the lack of mental health the lack of research as to why she was so psychotic (pretty obvious that there is a huge chance that she was abused by one or multiple people for an extended period of time). I don't know how I always end up seeing videos of adoptive kids who are failed, tortured, abused but I seriously have a fear of giving up a child for adoption. Aborting first term would probably be less painful than what this girl went through before she finally ended her life.

    As her dad says she was to have a psych assessment and that never happened. I think a guard should see how long they can last in a cell with nothing and no social interaction except with the guards hands on all the time.

    There was a TV show in the UK a couple of years ago, a psychological experiment on solitary confinement. These people had a few things with them in their 'pod' to keep them occupied, and STILL quickly started to display concerning declining mental health signs. They knew they were safe and could quit at any time and it was still overwhelming for them.     Is it just me or did anyone else notice that they never said a word about her history, all they said is about puberty she started rebelling, I wonder if she was ever disciplined, if not then that explains a lot. If you never hear anyone tell you no until for 13 or 14, yeah you're going to have major issues, which is what I think has happened here.

    Yep! That’s what I keep commenting. Her own father literally said she was a brat who wanted t get her own way and if she didn’t, she lashed out. She was an over grown brat who never learned and got herself killed. The other cell mate even said she loved to mess with the guards and it was entertaining to her to make them angry. Sounds to me like a dumb kid thought she was invincible and got killed.

    Then she should have behaved herself...the guards need to keep themselves safe too ...the friend admitted she did it out of amusement and to annoy the guards ..she’s out of control and she assaulted staff she deserved what she got ...I was a difficult child and teenager but I knew right from wrong and so does she she knows what she’s doing would hurt people..she’s no victim

    That's heartbreaking to see a young girl go through so much suffering and all because she was denied the legal right for proper psychological help. The laws need to be changed and strict penalties need to be put in place for those who unlawfully engage this kind of treatment towards ppl with psych issues. It's disturbing and uncalled for.

    Ashley was definitely mentally ill and was behaving like a child, meaning a very young child. She didn’t get a diagnosis which is insane. She should never have been in a solitary confinement like a violent prison inmate. I can’t believe he said ( don’t do anything unless she isn’t breathing ) and the guards actually listen to this murderer yeah sure let’s just wait until she’s dead and make a move. Nobody had a moral compass or a sense of the wrong thing kinda voice kicking in. And The parents should have been more involved. They saw the cuts and that she didn’t see anyone to figure out the solution and that solution was definitely not being strapped in a body bag in prison in solitary.

    im in uk. i was shocked that modern Canadian did this to inmates. she shouldn't be an inmate, she shoud be treated as a patian at that time. she was seeking an attention to be treared nicely, not wrongly. they just tried to correct her behaviour with handcuff, a mask, etc like an animal. if someone does the samethimg to an animal would be arrested. i think they knew about it and wouldn't do the same thing to their own dog!! they made her behaviours difficult more and more. she needed a homey place and take some pycotherapies. what she got? just humiliations. she was demonstrating to resist to them who was so useless to help them.

    Her mom did not advocate for her daughter at all! Just accepted the deplorable treatment Ashley was getting! No way, no freaking way would I let my child be treated like this and she's no criminal. I would be doing everything in my power to get her the treatment she needed and deserved.     I agree that the Mum did not appear to be trying to help her daughter. After she saw the scars on her arms and realised how much weight she has lost, why did she not demand an investigation?? You cant just take your child out of prison but you can certainly kick up a stink if they arent being taken care of adequately.

    Problem with this particular documentary was the reporter. She was biased at the start. At the end, repeating the guards didn’t act when she killed herself... the girl was playing that game of strangling herself hundred of times. How come the parents didn’t act during all those years ?

    She is not in denial but if you do not know what to do or how to go about it then what do you do? These detention and prison personnel’s were and are evil. This is and was physical abuse on ALL levels. Where is the empathy, the care; they did not on occasions give her tissue or feminine towels.     This treatment is inhumane. She is a child and her metal capacity is child-like. If parents treated their children like this it would be classed as abuse.     They keep talking about efforts to "help" her, when every step from beginning to end had probably made her infinitely worse. Throwing a fourteen-year-old girl in segregation. I was frightened and isolated enough in a hospital eating disorder unit at 16, but she was "troubled" in a way that marked her for the kind of treatment you'd expect to be used on grown men. What a complete travesty.

    Agreed. Some people have suggested Ashley was Mentally Ill (Psychiatrically Ill) but the problems with Ashley started at home long before detention for throwing apples at the Postman. The Focus of this investigation should have been concentrated upon her environment at home, when she began to change her moods and her, "Cry for Help" became apparent. When a child changes her behavious suddenly at home, the authorities start their investigatoions with those with whom she is living. I am not making accusations but I would like "The Fith Estate" to explain which adults were investigated for suspected abuse of Ashley, long before she became a deliquent, by throwing the apples at the Postman.. I understand her father pays a visit to Ashley's graveside every day... Ummmmm, strange behaviour of a father wracked with guilt or simply a caring father? Maybe we'll never know. RIP Ashley

    callie. .... that's easy to say when you don't have or don't understand mental illness. I am not even going to explain it because this video covered it all but yes people like you and I would have just done as we were told but this girl didn't think like you and I because she had a mental illness. How anyone could expect her to improve her behaviours when she was continously treated as if she was subhuman mystifies me. I realise that dealing with people with complex issues is extremly difficult but surely we can do better than this.

    Seriously this was so disturbing. And she was wrapped for suicidal attempts, not for "not following the rules", if this is how you treat a suicidal person in a juvenile facility it IS torture. The helmet and everything was so incredibly excessive. I understand restraints but to let her sit in her own urine in a lit cell is awful.

    My nephew died in a jail cell alone he was only 18 years old. He's how it happened. His family grew concerned about him. He suffers from mental illness his mom's side of the family have alot of the family members that suffer from this illness. So his dad and his sister took him to the hospital get him evaluated to get him into the mental hospital. So the whole day was for them to tell the family they would need them to take him to the crisis response center to get him help. Well when they took him it's getting harder into the day. They started to ask questions. Well they told them the truth that he did have a warrant for traffic violations. So they called for the cops to take him to jail. To the crisis response center it was easier then doing there job to get him into a mental hospital. Well there's video that shows how they treated my nephew. They stripped him naked and then put the suicide best thing on him. Then they threw him into a padded sell for suicide watch. Well after only 8 days they found him dead. But they thought he had finally went to sleep becouse in those 8 days he didn't eat or drink any thing or sleep in the whole 8 days ge was there. When he was going though the manic episodes. He couldn't do anything for himself whats so ever. But they found him in his own urine and crap on him. They knew he was mentally ill and they didn't help him in anyway. They basically killed him. When they did the autopsy they found out he had lost 40 pound becouse they weighted him when he was put into jail. The messed up part no one got in trouble for his death. Like I said you can look up this case. My nephew came is Marc Anthony Moreno this happened on March 11, 2016 im Washington state in Benton county. This has news videos and more details about everything. But if you or I would had left him to die, we would be charged for murder and in Marc case no one has been held accountable for his death. I'm still so angry over his death. I feel everyone that was involved with running the jail That was supposed to be watching my nephew suffer should have to pay for his. And they should be put in jail for what they've done to my nephew. I feel so sad that this young girl went though the horrific situation. Jails need to change how there able to treat people like animals and get away with how cruel they treat inmates. Yes they have done something to be put in jail but that shouldn't give the guards the right to treat them like animals in the pound. They are humans and animals shouldn't be treated cruel either. Just wanted to make that clear to. RIP this young girl and Marc. They suffered horrible deaths but now they are free to fly and be happy in a better place. God bless everyone.

    TheKumba I think one way he was right too cause Ashley kept fooling these guards like a 100 times. So the man who said that thought it was her trick again. One of her bully trick cause her for this. Usually kids of her age locked up even for two months would correct them self. Who would want to sit between walls with no friends and all types of dresses to wear or have a phone. In this case they even video taped her behaviour how rude she was she guards. They even saw no changes since beginning she was scaring everyone of them of committing suicide she even tried plenty times. No one can help with what happened to her but helped her self she was 19 not a 12 yr old kid to behave like how she behaved. She would have shown some changes or even been a bit sweet with everyone around her then may be she would have got put of prison by now. But she tried all new frixks everyday new tricks. Why would she even hide glass pieces in her hair and other places? No one is counting on how she was but they all accusing of these innocent officers of killing her. It's a risky job for guards tho with someone like Ashley cause she attacked few of the guards. May be she needed a vacation or new environment sometimes family fail to understand. Parents to be blamed as they had difficulty with Ashley. So imagine guards. Ashley had in mind may be that she would teach these guards a lesson so she did what she did. This is my view though.

    @Vixen Feline I never said I agreed with their methods, obviously there are more effective ways but you also have to ask yourself what was different between her an some of the other girls there. the parents themselves said she was out of control, it's not just throwing the apple thing at the mail person. Her behavior itself on some of the tapes were evidences that something was wrong with her. My statement about mixed feelings is not saying either was right just that there's a reason she was there

No matter how old your kids get they are still your child and a prison lock down is the last thing you would ever want to see your kids in. I believe the mother could have done much more.

At 12 years old I had such anger issues I was a threat to seriously harm anyone around me. I'm sure it was heartbreaking for the mother but I'm sure there were no other options

    Well good to know your ok now. Her mom didnot put her there it was jail for a minor crime but because of her issues she remained there for years. Somebody should have had her on medication and in a pych hospital. No jail is equipped to handle the mental problems she had. Maybe the mother did her best who knows, i am thinking that she could have tried harder though and seemed a bit cold and detached.

    I'm totally disgusted in the way they did this young women. Instead of the "special treatment" of ignoring the choking, how about they realized she needed one on one real help, love, and care by professionals. She was different but not alone in her self destructive behavior. If you constantly treat someone as though they are nothing what is their reaction expected to be? I realize no one is perfect not the staff or Ashley. But I pray that you folks are looking at other measures for ppl like this in the future. She won't be the last to have problems.

    I do think antagonize the guards because you're bored does mean a person bares some responsibility. I mean, she was purposely acting like she was going to hang herself many times. In some ways she put herself in these situations. Also, her parents weren't concerned that a one month sentence turned into over 3 years???

    It's aggravating on both sides. Guards have to deal with this kid doing stupid stuff to herself, on purpose, and she has to deal with the mistreatment from them.     She needed a doctor AND a personal advocate!! Even as an adult, she was unable to advocate for herself!! Upping the ante every time she acts out is counter-intuitive and, as is evident, it only causes further trauma and harm. People don't understand that these behaviours often begin as an inability to communicate. . . Ashley COULD have been helped as a child. It is heartbreaking that this situation snowballed and kept building; her parents must be heartbroken. Once Ashley was "in the system", the onus was on the "specialists" who knew better, and, unlike her parents, were trained to manage, and help, people like Ashley.

    The mother also had the expectation that her daughter would be coming home. It was probably done as a surprise for her release. Sometimes there isn't more to certain aspects of a situation, it is just what it is.

    She needed a comprehensive physical evaluation: - genetic testing: shows nutritional weak areas where the body needs supportive supplementation (ie: B vitamins and magnesium for the brain) - organic acids testing: to assess toxicities due to heavy metals, molds, candida (all these can cause inflammation in the brain, which obviously won't allow it to function optimally) - detailed blood testing (assessing nutritional aspects - deficiencies and imbalances) After nutritional/hormonal/neurotransmitter testing helps achieve homeostasis within the body, only then can a patient begin to participate fully in counseling. It doesn't mean you can begin counseling sooner (with more mundain strategies), but too much change at once is indeed stressful, which can create/add to brain inflammation. Anyway. Just pointing out that there **are** strategies to help someone, but not all practitioners are trained in these (functional medicine) strategies.

    The psychologist failed to diagnose her and just said it was behavioural, not psychological. They should have referred her to a shrink for a chemical diagnosis, but the healthcare sucks. And she was not criminally aggressive until they locked a child up in isolation for five days.

    Even from the few short clips of her where we see her behavior, it’s clear to me that she has the mental capacity of a 7 or 8 year old. She’s obviously mentally ill, and/or mentally handicapped..it’s insane that she was treated as a criminal for behavior she likely couldn’t help or control 😔💔

    Poor, poor criminals...I HAVE NO COMPASSION!!! All inmates ate given written: rules, regulations, list of violations/offences and action/charges taken for violations, schedules, any forms needed to submit, instructions, etc.- It is the size of a dictionary! There is STRICT protocol for ANY use of force. I.R.s must be completed and entries are made in shift logs. Her in-house records transferred with her. To many of my family in gray have been mutilated and/or died at the hands of these monsters!!!Civilians could not stomach working a shift in an actual corrections facility!

    Parts of this paints Ashley in a bad light. She refused to do as she was told and the guards had to use force. She proved time and time again she was at risk of harming herself. It is so sad that she died and how she died. She needed a different kind of help.

    Peggy Hill she got 1 month for the assault on the postman. She remained incarcerated because, as her friend said, she assaulted the officers every time she interacted with them. She was coming at them with shards of glass. THAT is why she stayed there.

    I don't think that the Mom wanted her any longer. Her sentence was one month and then goes to almost 5 years? I think that the parents refused her back into their home...it's very sad though, because at the end of the day, Ashely was just a child, a child that was in pain.

    When a prisoner is in segregation they don't get visits and make store. That's here in Louisiana I'm sure most prisons are the same. Visitation is a privilege and if u getting written up as much as she did her parents wouldn't be able to.

    If her parents noticed "unfit mental behaviour" they should have taken her to the psychiatric ward of a hospital where she could be examined by a team of professionals and receive medication. It's sad to say, but jail is jail and guards don't care about whether you're guilty, innocent, sane, insane ect. Their job is to react to an inmate's behaviour. It's sad but the jail should have done more to ensure her mental wellbeing, but it must have been difficult when the perpetrator or a crime must face the concequences but also needs additional assistance.

    A mother..... a mother who says she lost track of where her daughter was? I’m honestly not trying to judge but did the mom really deeply care as much as she said she did?
