Apple River stabbing trial: Nicolae Miu's verdict read in court

The jury came back with a verdict in the Apple River stabbing trial on April 11.
Miu was initially charged with first-degree intentional homicide and multiple counts of attempted first-degree intentional homicide. The state on Tuesday said it was also seeking lesser charges related to the initial counts.

They had a hand in that young man's death and the others being stabbed.     Everyone needs to watch all of the channels and all of the witness testimony before coming to any decision. Mr. Miu was minding his own business looking for the phone when the kids began to harrass him. That is not on the video, it was before the video. Listen to the black boy, and the first witness. They made it clear that they began the harassing and the bullying...and they both regretted their actions.

What more do you think he should have let this group do to him before it was okay (in your assessment) for him to be in fear for his own life? And when would he finally be within his right to defend himself (however possible) to preserve his own life?? Btw, an important note: Several of the men testified that they felt more emboldened after the other group came over.     An aggressor cannot claim self-defense. Mui charged the kids, and assaulted them then hung around with them while they asked him to leave, then he drew his knife, then he assaulted a woman, then, when the kids retaliated, the stabbed five people, killing one.

    Same here. Everybody was at fault in this scenario. They were all drunk, including Miu. Drunk people do really stupid things, all based on emotions. The kids were scummy to the hilt, but Miu's judgement was impaired and he let his temper take over.

    Wow. Regardless of his actions after the incident, these charges were about what happened during that incident, and we have a pretty clear view of it on cell phone camera. We know what his intentions were going up to the group, we know what the groups reactions were to him coming up, and their provocation, their aggression, Nic's self defense, and the groups lying to the police after words. Yes we know Nick trying to cover it up afterward, ok, charge him with lying, not murder.

For most, this will be a traumatic event they will remember their entire life, and hopefully, it also taught them a lesson about not acting like monkeys against strangers. So while the justice system did not "make them pay", they did suffer enormously from it.

    The vast majority of comments are defensive of Miu. However, let’s consider the following. Maybe first and FOREMOST, Miu had NO, zero, injuries other than scraped knuckles and minor abrasions on his back that he, himself, stated were caused by himself falling backwards because of “bad shoes”. This according to impartial hospital staff. NO bruises, cuts, black eyes, swollen body parts, abrasions (other than backside), or ANY injuries large or small. So, to say that he was attacked by a mob, or an individual, is unfounded. Second, none of the teens had any weapons. Only Miu. Next, it was Miu who initially approached/engaged/interfered with the teens. Not the reverse. Additional information (not evidence per se) is unlike alcohol, the effects of marijuana are non-aggressive. A person under the influence tends to be mellow, non-confrontational. Miu, and his group were intoxicated. Drinking and smoking marijuana is a very common part of floating a popular river in summer months. Common amongst most everyone regardless of age for generations. Very, very similar to Fourth of July activity. It wasn’t the teenagers who approached and interfered with Miu’s group floating the river. To the contrary. And, regardless of what Miu’s motivation, when asked, then told to go away, he persisted and ignored their directives to ‘go away…walk away…get the F out of there. Name calling is NOT reason to escalate a situation to violence. Miu was the aggressor. Miu was the person who didn’t get the ef away when told to do so. Miu was the perpretator and assailant. Miu was drunk. Miu attempted to hide the weapon and lied to authorities. Miu had NO injuries according to police and hospital staff. NONE. There was no attack by a ‘mob’ of aggressive teenagers. The jury of twelve unanimously agreed. Not a court, a judge, lawyers but 12 independent jurors who listened and watched ALL the evidence presented by both the prosecution and the defense and UNANIMOUSLY agreed that Miu assaulted and murdered the teenagers. Unanimously. Had even one juror disagreed then Miu would have been set free. Twelve jurors of HIS peers. Not twelve teenage jurors. So, when you say they ‘got it wrong’, it’s more likely YOU got it wrong. Either because YOU didnt watch/listen to ALL the testimony and evidence or, you have your prejudice about teenage boys? Ask yourselves (and answer honestly) if reversed and those stabbed were middle-aged by a teen or a black man, then who would you say was the perpretator? Society will be a safer place with Miu behind bars. The jury got it right. Our judicial system worked!

    No. They shouldn’t. Lets lay it out for you. 1. His friend said he didn’t care about losing his phone, but Miu was dead set to find it. He should’ve left it alone. 2. He was asked to go away 20 times by the group. He didn’t. He should have called the authorities at that point. 3. The group started talking shit, he should’ve just walked away. They’re minors, who gives a shit. 4. A group surrounded him and he pulled his knife and smirked. He knew exactly what he was going to do. He didn’t make any attempt to warn them to get away or leave. 5. He was then punched twice, so he had a weapon out before any physical contact was made. He WAS the one who escalated the situation. 6. After the stabbings, he tried to hide the knife, his group he was with lied to the police saying that he was the wrong guy, and then he proceeded to lie to the police. He said he didn’t have a knife, said the kids had the knife, and that it wasn’t him. So now he’s obstructing justice. Simply put, he had multiple opportunities to walk away, he pulled a weapon before anything happened, and then tried lying to the police. If he felt he didn’t do anything wrong, he wouldn’t have lied. Take the time to read about the case. You clearly haven’t.

    Based on the verdit, this is what we learned: if YOU are bullied, abused and harassed, just walk away crying, go to mommy, tell the teacher... because if you defend yourself you do jail time.     I think there is some grey area between crying to mommy and stabbing everyone in reach, including someone that never laid a hand on him and was trying to stop the fight and a woman. He didn't just stab, he did so with the blade up and lifted the blade for two of the victims, including the one he killed. He gutted them. There's gray area between self defense and some regard for the safety and lives of people outside of yourself.

    He could have been killed by the assaults the kids did. He could have fallen on something or hit his head on a rock. I think he was in panic and made some decisions that may have saved his life. Yet the jury had a different perspective. I am guessing they all would have reasoned with some excessively drunk kids that are disrespectful. Feel so sorry for the hurt victims and this man who was attacked first. I don't think this man would have ever hurt anyone if they had not threatened his life.

    I do feel bad for him in many ways but he gutted that kids' stomach and his intestines spill out. Maybe he panicked, but damn, that's a serious knife wound He looks so thin now and pale and I am sorry for him probably going away the rest of his life away from his wife and all he knows Hes to old to probably survive release he will probably die in prison I hope he can go to a prison that's half way decent and maybe be allowed to work in prison and attend some classes I can't imagine going away that long and dying jail Who plans on that being their retirement?

    He should have thought about that before he pushed one of the kids of his inflatable. Keep your hands to yourself and you wont need to stab someone because you cant finish what you started.     Imagine getting up in the morning asking your wife to go rafting on a beautiful day with your best friends, drinking some beers, eating some cheese, catching some Ray's, or a bunch of young adults decide to blow off steam and one loose their life and change many, little did they know in less than 8 hours 2 people will never come home and many others life changed foreverer that's crazy!! People need to start thinking, just think you could have been one of the people involved in this hole situation, what person are you, treat people like people not content.
