Apple River stabbing trial: Investigator testifies

St Croix Co Sheriff's Office Investigator Mitchell Schaeppi testified he took photos of Miu's knife that was found on the riverbank after the Apple River stabbing. The photos were shown in court. He then took the folding knife out of the evidence packaging and opened the blade for the jury.

    That's what lawyers tell you to say if you aren't 100% certain. I had to be deposed before in a corporate law suit and you use that statement more than you think you would, otherwise you'd be lying. It's ok and encouraged to say you don't know.

    This case should be a lesson to all. This world is full of crazies the asylum doors no longer exist and you should never feel entitled to safety EVER. Because the psychopaths are all over the place more than anyone wants to admit. If someone is being weird, making you uncomfortable GET AWAY FROM THEM. you just don’t know what they could do and it’s best to avoid. Don’t confront the freaks just get away no matter how tough and capable you think you are it’s not worth the consequences of confrontation.

    He charged at them and walked around them and grabbed onto their tubes. Allegedly he struck a woman in the face according to many witnesses there. It wasnt until after that he got hit. And before anyone had touched anybody, he had his knife out. He ran over and got into their space. The fact you could then say it was their fault is mind boggling. Yeh drunk kids tend to heckle you if you come at them into their space like he did. He also struck first according to several people there not part of the boys group.

I'm not saying what he did was acceptable but the teenagers instigated the situation. They may be young but remember it was a group of young more able-bodied men surrounding a single older man who was intoxicated.

    All of those witnesses were shown to not be credible. Some of them admitted they didn't see it, some said it was a jab, some said it was more of a hook, some said she fell down when she didn't, some said it was the left hand others said the right. They said they took photos, there are no photos. The video didn't capture it. There is a lot of good reason to doubt it even happened.

But either way there is a massive screenshot/frame of him with his knife out before anyone touched him

The person that dropped the phone in the water told Miu to not bother because it is in a waterproof case and insured. Miu CHOSE to go, he was after those kids not doubt. Not to mention, the shoving was done by another group AFTER Miu punched a woman, stabbed another individual then disemboweled another. None of which were with the teenagers. So explain how it is the teenagers fault that a total psycho stabbed and murdered several people.

    The party that was injured played their part and i highly question how they were raised. The way they treated their elders is atrocious. Did they actually think you can put your hands on a person with zero consequence? In Oklahoma we have a thing that's called stand your ground we also have a make my day law make my day laws when someone breaks into your home and you have every right to kill them stand your ground law means when you are outside of your home if someone physically assault you and you are in fear of your life and there's a mass amount of people around you hitting you and shoving you down then you have every right to use deadly force to protect your own life it's a shame that this state doesn't take that very seriously the way that the teenagers behaved well young people they may not all been teenagers but the way that they behave just highly questionable they definitely incited if not provoked and caused it completely. They show extreme lack of judgment they were high and drunk and effed around and found out in my opinion. The damage that was done was significant him leaving the scene was inappropriate he should have distanced himself and waited for the police the rest of his party should have rendered aid to the victims however the elderly gentleman was a victim himself. Goes to show that alcohol is called spirits for a reason and it's probably the most deadly drug out there aside from fentanyl there's my two cents so may not like it but I don't care

    Wisconsin doesn't have the "stand my ground law". Wisconsin has the Castle Doctrine. In Wisconsin a person who fears for his life must use every means available to them before resulting to the use of lethal force. I'm sure your state laws state the same thing. In this case Miu had the opportunity to simply walk away. Several people were telling him to leave the area. He stayed. Miu decided to use lethal force before he was in assaulted and knocked in the water. Miu is seen in the video unfolding a knife blade at his waistline. Now at this point he should have held the knife up in the air to show the group he was armed with a weapon. He didn't. Thus he is not using every method possible to save himself. At no point do you hear him call out to his group for help. Instead he hits a girl in the face in front of several young men. The girl wasn't a threat to him. Was she loud and in his face, yes. Still not a threat. The person that incited the violent, lethal part of this event is Miu. Thus he is guilty.

Those teens pushed a guy they thought would do nothing. I disagree with you. You are only seeing the outcome as a after the fact. Before the stabbing the teens had full control and would not stop.     The attorneys were told by the judge earlier that they need to give time for the court reporter to record everything. That might explain why there are so many pauses.

    In my 60 years of watching court proceedings either in person or on News & various other forms. This is the slowest and most discombobulated process of determining line of questioning I've seen. By all parties including the Judge. I have no idea what anyone is trying to get at. This defendant should receive an Appeal on this basis alone which in my opinion speaks volumes as to our criminal injustice system here in the United States. 😮

    "Guilty until proven innocent". Its mainly because America has garbage media laws. News channels have way to much bias and no one tells the truth anymore, that gets passed on to its citizens.     I disagree, the defense was very prepared ironically.. I am usually not “for” the defense in most trials I watch, but in this case I am. What surprises me is how little prosecution brings up poor Issac. They are there to fight FOR HIM! Who is fighting for ISSAC?! so sorry this young man was taken so young..     He already had the knife in his right hand when they were both speaking to him. There is a snapshot of this. Also one witness who was filming said he grabbed her hair first. In order to pull of this feat without stabbing her he would have had to grab her lefthanded(he is right handed) then with that same left hand punch her as she comes in with momentum. He also would had to do this while not making her drop her phone or beer in either hand. She was also wearing sunglasses so that "punch or slap" couldnt have knocked those off either. Its clear that that the punch they are referring to is when they he stabbed her friend as thats when the video recorder first mentioned a women being hit. They thought it was a punch too or merged the two together in the mind. And that is what has solidified in their memory. (This is if you believe they were not all giving coaching to say thay he punched her even). Thing is even if they know he didnt punch her first, they have to stand by this or else the whole narrative falls apart.

    The kids weren't attacking him, they were taunting and teasing him. I think he was a little intimidated but: 1. He threw the first punch and at a woman no less, 2. He could have just left but his he-man pride made him stay, not the kids, 3. He used deadly force when it was not needed, 3. Looking at that one boy's wound, how Nic not only stabbed but also brought the knife up to gut him was a deliberately deadly act. He tried to dispose of the weapon, which shows he knew he had done something wrong and serious.

    He was definitely not scared, or he would have called for his friends to come help him! He also would have made some move to back away from the threat he was so afraid of! He did none of that, but acted guilty by changing his appearance, ditching the knife, & lying to police! He didn't turn himself in, they had to catch him!     Imo, it would have been effective if the state had asked the investigator to hold up the knife with its blade open and walk in front of the jury so they could have a close-up view of the murder weapon.

    I don’t think that girl he may have slapped or punched had an injury. The group clearly thought he harmed her. I don’t think the defense has gotten rid of that fact. Is there an assault charge for Maddy or whatever that girls name is? The video showed the girls in his face yelling at him both with their hands on him prior. Not sure what this is about unless there is an assault charge. The moment set off the rest but I think it is more relevant the group thought he hit her then there being an injury

    He already had the knife in his right hand when they were both speaking to him. There is a snapshot of this. Also one witness said he grabbed her hair first. In order to pull of this feat without stabbing her he would have had to grab her lefthanded(he is right handed) then with that same left hand punch her as she comes in. He also would had to do this while not making her drop her phone or beer in either hand. She was also wearing sunglasses so that "punch or slap" couldnt have knocked those off either. Its clear that that the punch they are referring to is when they he stabbed her friend as thats when the video recorder first mentioned a women being hit. They thought it was a punch too. And that is what has solidified in their memory. (This is if you believe they were not all giving coaching to say this). Thing is even if they know he didnt punch her first, they have to stand by this or else the whole narrative falls apart

    Nic wasnt scared, he was amused! You can see him smiling thru most of the video! He refused to answer when they asked what he was doing, except to say he was "looking for little girls." He never called for help, never appeared scared or worried. He never tried to leave, nor was he stopped from trying to get away. Indeed, they were encouraging him to go! Instead, he pulled a knife and killed a young man, because he thought he could get away with it! No one hurt him!But look at the horrific wounds he inflicted on 4 young people (who didn't even hurt him,) KILLING one! If you don't like the names kids are calling you, walk away!     I've smiled in a similar situation too, not because I was enjoying it but because I was nervous. When he said he was "looking for little girls", he was simply being ironic in response to what they were accusing him of, being ironic is not a crime. Also, he did try to get away and yes, he was indeed being blocked from walking away safely. Did you even watch the video? Put yourself in his shoes or imagine your mother or father in that situation.

She was clearly never hit. And that’s a big problem for the prosecution, because Mui was on video walking away from the group initially - and then the girls run up and get “in his face” according to witness testimony. And then one of the guys starts shouting about hitting a woman, probably the same guy who was shouting “raper/p3do”. These kids are fucking liars.

    I've watched the defense opening argument again after watching a lot of testimony of the young men & others. It's really grievous to see the comments people are making. I can see the defendant's perspective, & believe at this moment that he possibly should not have even been charged & most likely ought to be acquitted. At WORST, involuntary manslaughter. I believe the young people ought to be charged as well. The young man who died actually put his hand around Mr. Miu's throat! They all said they had 2-3 beers, yet the BAC of the decedent was .22% or something, which means he was drunk. Moreover, in statements, apparently the others said he was the least intoxicated of them all. Hey, at first blush, I thought this was unnecessary injuries & death as well, but as I've considered the evidence & the context of everything... there's no way I would vote to send this man away for murder of any degree. These boys have lied, & I don't believe he said he was "looking for little girls" at all, nor do I believe he actually punched this woman either. He possibly slapped her, but given the information, she was extremely aggressive & things had escalated greatly. It's unfortunate he threw the knife... he was traumatized by the entire incident at the time. It was one thing he could do to help manage his emotions & cope w/ what had happened.

    This prosecutor is so terrible. My guess is he got a law degree from a local community College in some rural area. This also must be his first trial case. Painful to watch. If this doesn't end in a conviction, it'll be the prosecutor who's to be blamed. Seems to me like an open and shut case.

    I'd say it was a little bit of both, He yelled for help to his friends . You don't do that when you're not scared. I don't personally know him and you don't either you wasn't there so you can't say if he was scared or not for certain. In my opinion he will be found not guilty. He may catch a time served charge for cutting the two that tried to help. But he didn't know they were there to help.

    Yeah I've been river tubing plenty of times and saw others around me and nobody ever needed to carry a knife. Miu had the knife on him the whole time. It's obvious why he carried the knife. Then, when he first pulled it out while talking to the 3 females, he had thos look on his face like he was pumping himself up to get ready to start attacking. He's allegedly from Romania and fled during the cold War so I'm assuming he might've been involved in violent situations back in red Europe back in the 70s

    Nope. There are very important little details that most people are missing. Look at the first few seconds of the video that’s on Fox9, recorded by the black kid. Niu runs at the black kid and the girl next to him, who are sitting in their tubes, and grabs them. That right there is assault under the law. After that, when the kids start their little humiliation ritual, instead of getting out of there, he stops, faces them, and pulls a knife on them. Only AFTER that, he gets pushed, and then slapped. You can’t claim you killed someone and injured another 3 in self-defense when you assaulted them before they started fighting back. Really Niu’s only hope is that the prosecutor really is as lackluster as he seems. The other possibility is that he feels pretty confident and wants to let the evidence speak for itself.

He doesn't grab them, either, but he does reach for their tubes and touches them as a result. I'm not excusing what he did because I absolutely think they should find this man guilty, but when you're pointing out that details are missing and you're also missing details, I had to speak up.

    Imagine your Isaac’s mom (the kid who died) and you’re already dealing with the earth shattering pain of losing your child, only to later see the video and see how his “friends” contributed to the events leading up to Isaac’s death. Jawahn then says "he hit a girl?" as a question as though he hadn't seen anything despite the fact that in court he testified that he saw Miu punch the blonde.

    The attorney never asked for this investigator’s CV ! He never asked this investigator about his educational background, nor his specific knowledge or experience in his field. Why? The nurses and doctors have to go through their CVs and explain their credentials to be considered credible. Why not this guy ? Asking for a friend.

    What I find suspicious is...the father, the one who owns the bar, stated that Maddies Mother sent him a pic of Maddies injury, at a later time! Why hasn't that picture surfaced as evidence? Maybe it will, maybe that's one that got deleted. I think all of their phones need to be investigated. The first officer she approached stated he saw no visible injuries, nor did she stop walking to allow him to take pictures for evidence. I'm now leaning towards Making false statement involving a criminal act. Self infliction, or co-conspirator to stage a criminal act to cover up the truth. If so, she should be charged with numerous crimes and face jail time. As well as the others involved. The man needs to be set free.

    That's what I think. There's definitely some lying going on tho with a few of the witnesses, embellishing certain things. For one, the black dude I think is lying about hearing the accused making a comment "looking for girls". I think these drunken idiots were too busy harassing him than to even hear the guy say "looking for phone/snorkel". This is a f'ed up case for sure.

    This is a really unfortunate situation that happened. I hope and pray parents use this as a teaching moment for their own children. You never know how crazy somebody might be. There are people out there that are just itching for a reason to snap on somebody and when the opportunity finds them…. This is the result. 😕 People need to realize that you can’t just go around slinging accusations, getting argumentative and threatening to physically harm someone. I can see all sides of this case but at the end of the day, I think he was well within his right to defend himself. From what I could tell in the video, the only people that were injured were the people that put hands on him. With all that said, I do think his actions after the fact were sketchy. I think he should serve time for not contacting emergency services for the kids he hurt, not trying to render aid, etc.

    If you look in the picture of the group, most of them had their cell phones in waterproof cases around their necks. So, it's possible the wife dropped her phone in the water as she testified in court. Miu decided to snorkel for the missing phone. The apple river has quite a bit of current. The reason why so many people like to tube the river. The phone being in a waterproof case could have tumbled quite a way downstream. Thus, the reason Miu was so far from his group. Miu could also have thought the teens had the cell phone. Alcohol makes you do so stupid things.

    In the video as Mr Miu approaches the raft someone called him a "cracker" which is a racial slur against a white person. I can't imagine who might've said that. So someone introduced a racial component to this incident. Also, as the person filming the video knows, the more crazy you can get someone to act the more views you will get so he had an incentive to keep egging on his friends and harassing Mr. Miu. Also, the videographer never stopped recording to help his friend who was bleeding and dying in the water, it was more important to get a good video and record his dramatic reaction then actually help his friends.

    He said he started recording because of the interactions leading up to the event (that weren't on video). They were teenage boys, drunk and high, so it doesn't shock me that they acted like this and kept hyping each other up and saying dumb stuff. That's intoxicated teens for you. Is this a harsh lesson to learn? Yeah, sure, but no one deserves to die over it. I'd hold a 52 year old man to higher standards for de-escalating a situation that he literally walked himself into.

He's a guy in his mid 50s, poor health, had quadruple bypass surgery, had been punched and knocked down into the water where he could've drowned or had another heart attack. He was surrounded by around 8 physically fit people and was in fear for his life, that's why he defended himself. A tragedy but they started it and wouldn't let up on him.

In the video as I've said before it shows Miu opening a folding knife at his waistline. This is before he strikes the girl. He's not calling out to his group for help. He not trying to walk away, back up out of their reach. He isn't even trying to tell them to back away. Nope he just opens the knife blade. Why? Is this what a rational person would do. He doesn't even hold the knife up and yell for the people to back away. No, instead he punches the girl in the face. This is not self-defense. Any rational person would know this would cause a negative reaction from the group. You just don't hit a woman. The teens and the group from across the river react to defend the girl. As for drowning, they're in like 12 inches or less of water. As for his heart condition. If he has one. Why confront the teens at all. He had to know there were 6 of them. Miu tried to snorkel under their tubes. Bad idea. This led to the teens calling him a pedophile.

I don't know, a lot of men have very fragile egos and masculinity so it doesn't shock me that this guy reacted in the moment and escalated the situation further. He's an adult, so he should know better. The teens were 1) 17 years old, therefore minors, 2) drunk and high, 3) under the assumption that he was being a weird creep. It doesn't seem like Miu made any effort to clear that up. Maybe other people don't think about this, but I feel like it's common sense to explain why you're snorkeling in 3 feet of water near a group of teenagers. I don't know why you're so bent on defending a 52 year old man who should have known better and should be held to higher standards regarding de-escalation and behavior.
