Angry judge erupts during sentencing of convicted murderer

If a judge could throw the book at a woman, he managed to do so on Wednesday.
Not physically, but certainly by his stinging words. He had a lot of words for 31-year-old Camia Gamet, the woman convicted of killing her boyfriend Marcel Hill in March. Gamet claimed it was self defense and showed no remorse.
A First Degree murder conviction by law meant she would get life behind bars. Still, while family members spoke she would only roll her eyes and laugh, but Jackson County Circuit Court Judge John McBain would have none of it.
"You're gonna shut your mouth or I'm going to have some duct tape put on it," said Judge McBain.
A jury convicted Gamet for stabbing and beating to death Hill. Her lawyer argued she acted in self defense, because she claimed she killed an unknown attacker in a dark room. The judge wasn't buying that and called it the worst cold-blooded murder he's ever seen.
The prosecutor argued Gamet's actions were premeditated and deliberate. She stabbed Hill 11 times and had a history of violence against him.
Hill told police in March of 2013 she hit him in the head with a hammer.
Family members say justice was served and they hope a lesson was learned about how abuse can come in all forms no matter the gender.

    Self aware in that she knew she was facing serious consequences so she had to feign the victim by saying that mostly lies are what lead to her conviction. But not self aware enough to show any empathy towards her victim or his family. I'm no mental health professional, but I get the impression this killer is very high along the narcississm spectrum.

    That’s the interesting thing about good defense lawyers. When it comes to clear cases like this, they really dread their job. They defend people because they stand for fairness in the American court- everyone deserves the right to let their voice be heard. But once a decision is final, they don’t B&M over it. They let the judge have at it since their duty’s now done.

    I don’t know for sure about this as I’m unfamiliar with our legal systems regards towards court hearings, however if the person feels they weren’t represented to the best of the lawyer’s abilities can’t they redo the trial or something? I don’t remember exactly what it is they can do, but I remember hearing something along those lines. Someone correct me if I’m wrong please

    @@skellie4580 that’s correct but it has to be proven that the lawyer was either neglectful or incompetent. If they’re able to show some reasonable evidence as part of the defense, even if it’s unsuccessful in changing the courts opinion, then a retrial is unlikely. Basically if they had any reasonable argument formed for their defendant then they’re considered competent.

    I respect him for that. Disgusting how remorseless she was. It proved to be a flimsy shield for her guilt. I bet she thought if she owned the idea that she wasn't guilty, then she wouldn't be charged as such. Glad she's locked up for life without parole. A good lawyer could use that outburst to file for a mis trial on the basis the judge showed bias against the defendant and have her conviction thrown out.     Would she even fit in her cell? Most likely not. I was a correctional officer for 2 years and the cell is NOT very big at all. I’m between 5’10” and 6’2” depending on which convenience store I’m leaving, and about 185 pounds, and even I almost seemed bigger than the cell when conducting a routine search for contraband. Basically speaking, to give you a visual on the actual size of a cell, if the average-sized man were to swing a puppy around in there, he’d kill it.

    I'm sorry. Judges are supposed to be more composed and neutral regarding their personal feelings. Are not supposed to show "Like" or "Dislike" toward either the plaintiffs or defendants. Not saying the verdict was wrong or right. I'm just going ny the emotion shown by the Judge. That's not good.

    Oh man... getting stabbed more than 15 times, sure had been a very painful and horrible experience for your dad... thank God and also sheer luck he survived! Here in Brazil, in the Maringá city (Paraná state), occurred a similarly horrid crime in 1989: a man killed his ex-wife with no less than 72 KNIFE STRIKES across all her body (not even her face escaped the blows)! None of them aimed at any vital organs so the scoundrel made sure the woman suffered a lot before death by profuse exsanguination.

What do you think our law is built upon if not emotion. One cannot determine justice purely through emotionless determination. That’s called legal positivism and it’s frowned upon

    Put it this way. Sure, it's unprofessional, but look at this form a personal perspective. If you have a judge who shames the killer of someone close to you etc., the first thing you would think is a bit of gratitude because he understands and wants to remind the killer about how everyone feels about them. If he just acted normally, it's like the judge is acting in a "been there, done that", attitude, like he doesn't give a shit about the outcome or how it transpired. Sometimes it's gratifying if the judge feels for you when you are at a grievous time, considering unlike you, he had nothing to lose since the killing occurred. That was a mouthful, but I think this should clear it up.

    My ex girlfriend is exactly like this girl. An evil narcissist, has a smirk on her face and sees nothing wrong with her behavior. She emotionally tortured me throughout our turbulent relationship, threatened to dump me because of my problems, lied about me to some of her friends and never cared when I was sad and crying about something. Worse, she told me she'd put a push pin in my shoulder if I "cheated". And she tried to get her brother and father to beat me up. She always smirked or smiled when I was going through a bad time. Utterly horrible person.

    My ex was similar she never knew she was pretty to I told her and told her and made her realise any man would love to take her out but once she knew she was the biggest bitch going and she messed with my head but I denied cheating on her till 1 day I thought the only way out is so to tell her which I did and it was over ... technically I never cheated she wanted a break so she got 1 ... funny years later she came crawling bk but I was with someone else and I wernt interested

    Would she even fit in her cell? Most likely not. I was a correctional officer for 2 years and the cell is NOT very big at all. I’m between 5’10” and 6’2” depending on which convenience store I’m leaving, and about 185 pounds, and even I almost seemed bigger than the cell when conducting a routine search for contraband. Basically speaking, to give you a visual on the actual size of a cell, if the average-sized man were to swing a puppy around in there, he’d kill it.

    @@mylra4689 fair point but in the case represented in this video, there were no firearms or other weapons involved beyond the knife she stabbed the guy with. I should have provided more parameters in my question; if two or more people are involved in a hand-to-hand fight, and the individual claiming self-defense doesn't have a mark on them, how is that self-defense?

    @@Tehstampede The idea is that an equal amount of force ought to be used as offered by the perpetrator. If the perpetrator slaps you then you cannot pull out a gun and shoot him. The exception is if the perpetrator is a burglar in your house. Generally you do not have a duty to retreat, though different states approach this differently. I represented a guy who was charged with felony murder. He and his friend was on the property of a small farm and in the act of stealing some things from the property. This was in the wee hours of the morning. The property owner came out with a rather large gun with hollow point bullets and claimed one of the burglars lunged at him. He blew him away. He died. My client ran and was later found by a K9 unit. He was charged with the murder under the felony murder doctrine. There was never any marks on the property owner. And the story about being lunged at was probably fabricated.

    @@siradmin6791 the defendant’s lawyer could’ve called a mistrial due to that emotional outburst of rage he let slip out near the end, it could get the conviction thrown out completely. i don’t blame the judge though i actually commend his behavior if i were him i’d be foaming at the mouth lmfao

    @@relentero8547 because any chance of having mistrial would allow the defense team to formulate a different defense strategy that could end up letting her walk free and not be convicted, even with all the evidence present. this is why i feel like the court system definitely needs a rework.

    During sentencing a judge can pretty much unload as the case has been settled and they are rendering what they believe is the proper sentence based on the law in the state and the verdict by the jury. Judges generally have to be super professional during the trial portion of the case so to not prejudice the jury but once it’s done they can pretty much say what they feel with regards to the defendant if found guilty.

    That judge is not fit to be a judge, no matter what he is expected to keep his emotions in check. Of course it is easy to blame the accused for her behaviour, if a judge can get provoked by criminal so easily -think about all the accused in gun violence at schools. They were bullied or laughed at , and they pulled the trigger too because of the simmering anger inside.
