The plaintiff brings her neighbor to court. She argues the defendant’s vegetation is unruly and fell onto her patio. She says she’s asked him several times to get his plants under control, but he refuses. She’s suing for the cost of tree trimming. The defendant argues the plaintiff never called him in the first place, so he doesn’t owe.

    She still doesn't get it. She is already paying a company a monthly fee to keep the bush trimmed. She should be upset with the lawn service, not the neighbor.

    She probably pays for regular grass maintenance and to cut shrubs and bushes are extra. Depending where she lives it could be year round. If the bushes are the neighbors he should remove them completely.🤔

If that was the case just because how she is coming about this she would have had some evidence she was paying more money. Just get the survey done and that will end the problem because at that point there would be proof if the bushes are on her property. 🤷🏽‍♀️

    As he didn't have any communication with her (by his own admission) the defendant had no way to determine the cognitive abilities of the plaintiff. Basic politeness would have been to point out his understanding of the property boundary and his lack of responsibly for anything on her side. But these are white American boomers, the most entitled people on the planet, hence this pointless mediation case.

    no. its in the middle, which is like an easement area between his fence and her fence.. the foliage encroaching is coming from that easement and she has every right to cut it down, rip it out, etc.. good grief.. she should tell her landscaper to rip it out once and for all.. or just pour some salt on it at the base and trim it back off the fence by cutting all the branches from the other side.. the base will die and the problem won't continue..

    ​@@rickreallylikedthevideobut7899The whole point is noone knows if it's an easement, his property or hers. My property has an easement for a storm drain along my driveway and fence line. The council replaced it recently and dug up every tree, shrub and flower plant that had been there for 50yrs. We're replanting. It looks bare and bloody awful currently but couldn't be helped. She needs a survey if it's bothering her so much.

    While I agree the defendant was a jerk for ignoring the letters, it was clear that the Plaintiff is never going to understand that the cost of upkeep on her side of the wall will remain her burden.

    She probably told the gardeners to trim the bush and not cut it all down - or the gardeners didn't want to cut the entire bush down and get in trouble for it- AND she doesn't even live there so she probably doesn't even know how the gardeners are trimming/cutting the bush. She just assumes it's being done.

    I have never understood this law. I plant an oak tree right inside my property, and my neighbor is responsible for cutting the massive branches and roots that are going to cross over? That makes no sense.

    No one is sure where the property line is. Just because there are fences up doesn't mean a thing. A new survey needs to be done, then she'll know where her line is so she can then deal with the bushes.

    As the plaintiff said the over growth was going straight up, and then up got heavy and fell over. I’ve had this problem with my neighbors and these days with landscapers…that cut down and back is EXTRA! BTW- he ignored her because he doesn’t care nor does he want to pay HIS landscapers EXTRA to cut it back! And as usual, she asked a question and doesn’t allow the person to answer 🙄🙄🙄. Typical JM 😑

    After watching so many of these videos I have found that people who are causing trouble for other people are the ones who seem to be getting out ahead in life. It seems like every time somebody takes them to court the defendants seem to win because there's some kind of a law that's protecting them

    I cannot believe this is a real case since it’s one of those things that is common sense! I recently had a similar situation where the trees on my property were growing into my neighbor’s yard - he politely knocked on my door to let me know they would be cutting trees that were overhanging his roof and asked permission for the landscaper to climb our fence if needed. That’s what should have happened in this case! Can’t believe she is paying her landscapers extra for absolutely nothing they are probably having a nice laugh right about now 😒

    I have a feeling it is on her property. She said the defendant’s fence was falling apart, which probably means it’s older. She most likely put hers up second and spaced it apart, making that strip of land and the plant hers

    We had the same issue with our neighbors. I told them to cut the growth down. I can't control what happends on your side of the fence. The plants/trees are being cared for on my side. Problem solved.

    I think property owners know they can cut their neighbors’ overgrown limbs and branches of trees as well as bushes and vines on their side of a fence or property line and that It is not the up to the neighbor to pay for it.

It's essential for her to determine her property line; if the bushes indeed straddle the fences-her fence and her neighbor's-removing them would be her expense without authorization. Conversely, if the bushes extend onto her neighbor's property, even beyond his fence, it becomes his responsibility. The additional $30.00 monthly fee for her landscapers to trim the bushes is likewise her obligation and prerogative. The evidence presented in the form of photos clearly indicated the landscapers were not fulfilling their extra duties, putting her at a disadvantage. She seemed to struggle to comprehend Judge Milian's points. As for the defendant, little cross-examination was necessary since the crux of the matter primarily pertained to the plaintiff's side of the case.

    i believe the law should be changed that if you have trees on your side it should be maintained by You and I should NOT have to pay for the pruning on my side and I don't have a problem you coming on my side to get it done when we agree a time of convenience.

    If the growth is hanging on your property, YOU deal with it. My neighbor's trees are all over my yard. I CUT the branches. Easy. Why on Earth did you let it get that bad? that's not just one year worth of growth.

    $200 for a survey is money well spent, it could save her a fortune in trimming in the future, or she will need to find another gardener that will do the job she pays them to do .
