It wasn't just a matter of the defense 'accusing the prosecution of hiding evidence;' the fact is, Baldwin had the right to access of all relevant evidence & the prosecution never provided it to them. In fact, the defense wasn't made aware by prosecution that the evidence even existed until part-way through the trial - a clear Brady violation. Just as the defense wasn't told that the FBI testing of the gun would cause damage to the gun nor were pictures taken of the gun after it had been damaged by the FBI until the start of trial. The gun obviously was a key piece of evidence. And finally, there were numerous pre-trial hearings in which the judge admonished the prosecution for not following through on her orders to provide the defense with other relevant evidence and/or didn't do it until too late for the defense to adequately judge for themselves whether they wanted to use said evidence at trial. 'I specifically asked you time and again if all relevant evidence had been provided to the defense & you (the prosecutor) assured me it had been when you knew it had not. Had the judge not ruled for dismissal with prejudice & Baldwin was convicted & appealed the conviction it would have looked like the judge did a shoddy job of judging the case as there was a very clear Brady violation part-way through the trial. Prosecutors gave the judge no choice but to dismiss the case. The burden for this mess falls squarely on an overzealous prosecutor, period.

You could understand his intense reaction when the judge dismissed the case. It's been ongoing for a few years, and I'm sure it put extreme stress on him and his family. However I can't forget and remember with sympathy that a mom, wife, and cinematographer lost her life.

@CherylYung-zb2pz Alec was 1 of 6 producers. He didn't have full control over the set, a lot of the responsibilities were distributed differently. Alec was an actor and a producer, he hires experts to cover roles he's not qualified to fill. If your building a house you trust that the construction workers are built by those with experience, not your 5 year old son. Also the way PROP runs are handled on set is different from actual guns. From what I've read in reports that have been released, they were filming a rehearsal shoot, he was told the gun was cold, but when Alec removed the gun from the holster it fired hitting the victim in the chest. Alec was being witch hunted because of his poltical ideology. Thier have been simliar deaths in Hollywood in the past, but this is the first I've heard becoming such a profile case.

The evidence supplied by that good samaritan didn't have to blow up this case. The Specious Prosecutor blew up this case. She could have turned it over to the defense as the rules dictate, instead of hiding it under a different case #. But so weak was her case against Baldwin, that she knew she had to keep any impeachable or exculpatory evidence out of the case. This fear of hers was exacerbated when the judge disallowed any evidence that Baldwin was a producer on this movie. As an actor, Baldwin is innocent of any crime. As a producer, he has some financial culpability. And the CST, and the cops are just as culpable as Morrissey. They should face justice as well. The judge said it was a conspiracy of all these people to keep that evidence from the defense. Alex Spiro is a fricking genius. He just made his career.

Hannah had live rounds mixed in with dummy bullets in her fanny pack. She admitted to having just grabbed 2 out of her fanny pack, shaking the 2 at the same time, heard a 'noise' that she took to mean both were dummy bullets & put them in the gun without actually checking them. She then told the AD that the gun was 'cold,' handed it to him, he yelled out to Alec that the gun was 'cold,' twice meaning it was safe to use. So yes, definitely carelessness.

I understand the argument of negligence in gun safety but i also think it would be ridiculous to take it as far as throwing this man in jail for this. If the armorer did their job correctly this never would have happened and i get why you might get complacent after having a long acting career probably checking guns all the time, never having issues, etc. you start to feel like whats the point cause in 30 or 40 years of acting every time you checked it was perfectly fine. i can agree that there was some negligence going on but its a more complicated issue than that and the bottom line is live ammo should never be on a movie set under any circumstance. Trusting other people to do their job in providing safe guns with safe ammo shouldnt be a crime. He already needs to live with knowing he was holding the gun when this happened and the hatred from the public for being that guy and i dont think more punishment needs to be added onto it.

Well of course he's responsible civilly. But all of us are responsible civilly for a death in some cases even when we are not at all at fault. Think about it. If you are driving down a rural highway and someone is on the side of the road and trips right in front of your car and you hit them and they die, your insurance company has to pay their family. You didn't do anything wrong criminally, but yet you are financially responsible. I don't see how this is any different than any other auto or industrial accident. That's why people and companies have insurance.
