Alec Baldwin’s Lawyers Get Fired Up, Says There’s Too Many Issues in “Rust” Trial

On the third day of trial, both defense attorneys for defendant Alec Baldwin, Alex Spiro and Luke Nikas, reveal they believe this case has had too many issues. Spiro said, “I’ve been on many high-pressure cases, and there have been more issues in this case than I’ve had throughout my career.” Spiro also said he believes that state attorney Kari Morrisey has been signaling to witnesses on the stand. Nikas got furious regarding the conduct of the prosecution.

Famed actor and movie producer Alec Baldwin was indicted on one count of involuntary manslaughter in January for the death of 42-year-old cinematographer Halyna Hutchins. Hutchins died on Baldwin’s “Rust” movie set. Armorer Hannah Gutierrez-Reed was found guilty of involuntary manslaughter for Hutchins’ death. She was sentenced to 18 months in prison.

    It appears this prosecutor targeted AB, she refused to let it go even though she didn’t have enough evidence. She was going to get him at all costs. That is not how our judicial system works.     The moment Kari gave Sarah immunity and she threw ammo away I was immediately convinced that Kari is dirty. I understand Hannah was not responsible, and she loaded a live round in this gun, and she’s at fault, but not Alec.

    I don’t like Alec Baldwin, but I don’t think he could have reasonably known this gun was in anything other than a toy/prop. How could he know there was live ammunition? If it had not fired at Hutchinson, would another actor have been shot during a scene?

    He did know. That was the issue for him. Mr. Baldwin didn’t exercise his 5th amendment right to self incrimination, he specifically told investigators that he KNEW it was a real gun lol. Not that it matters now, government made a fatal error.

The issue is that he knew it was a real gun and a reasonable person could conclude that without checking the firearm yourself, pointing a real gun at another person and pulling the trigger could inflict serious bodily harm. That is the essence of willful disregard that resulted in culpable manslaughter.

    Alex Spiro got all the credit but Luke Nikas nailed the case for dismissal of the case against Baldwin. The judge really was given no choice but to dismiss the case. Kari Morrissey the prosecutor should be punished for her dishonesty.

    @@maryjaneshoe-fm4yr Someone else might have intentionally made sure there were loaded rounds. This did come up briefly in Hannah’s trial how the prosecution ran into a dead end trying to prove Seth Kenny was responsible. Ms Hutchins death would be the responsibility of the person who intentionally supplied live rounds and poorly trained Hannah Gutierrez imo. There are other ways to argue the case. Imo Alec only removed the gun from the underarm holster. Hula was standing right there. There was no “pointing.” Idk if they showed the rehearsal video this time but you get a different idea than a regular point and shoot.

    @@MayaGTKdoesn’t matter, there are pictures and video of him pointing the gun with his FINGER on the trigger and thumb on the hammer. That is how a single action Army pistol works. What matters is Baldwin held the gun, pointed the gun, and had his finger on the trigger. He obviously did not check the pistol when it was handed to him. He did not open the loading gate, with finger off the trigger, pull the hammer back to the half cocked position, then rotate the cylinder 7 times slowly, to visually check that each of the 6 chambers were empty. ( 7 so you are sure you went passed your starting chamber). If he saw a round chambered, then he should have called for a stop, and ask why is this weapon loaded? They aren’t in court to find out how live ammo got on set, just that he was negligent and shot someone. It’s miss direction.

    @@Faretheewell608 according to her testimony, she says she didn't feel it was relevant to the defense. unfortunately for her, it's not her decision to make. failure to disclose all evidence lead to the dismissal with prejudice. so they actually can't try him ever again.     The lead investigator admitted that she consulted with the prosecutor and they decided to create a new file for the evidence rather than file it with the other Rust evidence. That is hiding the evidence. Luke Nikas Baldwin's lawyer explained why the case should be dismissed and the judge agreed

    Seth Kinney directly recommended Hannah and our her in armorer AND prop duties, on a film with dozens of guns and hundreds of different ammo types, knowing fully well she'd had one armorer job prior. The investigation was botched since Hancock allowed Seth to be privvy to information instead of treating him as a potential suspect from the start.     @@88jeebs Because the director I believe did not allow the armorer in the church where the scene was being filmed and the director called the gun out as a "cold gun" when he handed it to Alec even though he had no training and absolutely should not have done that which is why he pled guilty because he knows he's wrong. EDIT: Also he was listed as executive producer but as everyone knows those titles mean NOTHING.

    What he did was proclaim it was a Cold gun even though he was not qualified to determine that it was a cold gun. This all happened because the armorer was not permitted to be in the church during the rehearsal and because the gun cart could not be locked.

    Hannah Gutierrez should have received life in prison as the primary armorer who failed to reinsure the rounds were blank. She got so lucky with only a sentence of 18 months for killing an innocent person! I don't like Alec Baldwin but I believe he is not at fault due to the armorer's gross negligence! Hannah Gutierrez testimony is worth crap against Alec.

    Life in prison? You don't live in reality. The AD who took the gun from Hannah and walked to another location to hand it to Baldwin didn't check it either and told Baldwin it was clear got probation. Seth Kinney recommended Hannah and also hired her to split duties between props and armorer even though he knew every other armorer passed this job up because there are so many guns and ammo that needed overseen it really should have employed at least two experienced armored with assistants, yet he hired HALF a young inexperienced one.

He even tried to call it an example of cutting corners to save costs, which to me sounds ridiculous. I mean how does that save money, did he intend to charge more than two people's wages ? And if he were to do the two jobs, isn't it likely there would be job safety and quality issues from an overloaded to-do list? We learned in Hannah's trial that Sarah did not respect Hannah's authority as Armourer, that she was annoyed that Hannah had duties besides being her prop assistant, and that Sarah wanted her fired (without just cause)...oh, and also that Sarah and Seth were romantically involved.

    They were pointing out a couple of other technicalities that piled up, e.g. the destruction of the gun by "agressive testing methods" in an FBI lab, dubious chain of property of other evidence, and withholding potentially exonerating evidence from the defense. If the judge hadn't dismissed the case, it would never have survived appeal.

    A real gun was used in a scene where a fake gun could have been used. Baldwin the actor / producer OK'd the use of a real gun ( why ???) Baldwin never checked for fake bullets or even if the gun had bullets Baldwin pointed the real gun at the victims ( why ??? ), the gun goes off. One injured, one dead.     It's right to complain about his gun handling and actions but this still stems down to the fact that hannah was the one who loaded in the rounds. Still they're talking about ammo because investigators and the crime scene technician have to turn in evidence and since they didn't, it doesn't look like Alec is getting a fair trial.

Something tells me that the jury sees it and feels it too. Crazy they were arguing not to allow his demeanor immediately following the shooting to be allowed into court. Because it came off cold and callus and like Alec didn’t care 🙄 Yeah, it sure did come off like that ..
