I think both trials went the way I thought they should, mostly for that reason (among others). the guy with the camera also took part in trying to corner him, so... felony murder. I thought he had the best chance of avoiding a murder charge, but any felony he was charged with was going to lead to him getting a felony murder count. also, the cops were not told to stand down, they were en route, so that was also not in their favor.

Neither was the fact that Arbery tried to take the gun from the McMichael's, an act of self defense in that situation and therefore not a provocation for a lethal response. The dumbfucks grabbing a shotgun and chasing a guy down was illegal and they deserve everything that's coming to em. I think the murder ruling against the guy who filmed it was the jury overreaching and may be the most likely to be overturned or reduced on appeal, but that's neither here nor there. Ultimately, the jury came to the correct decision that the McMichael's had acted without justification and had indeed committed murder. For noting, if the police had done what the McMichael's had done, it likely wouldn't have been charged because the police have a lower standard of probable cause (eg. they already had a description for Arbery as a person of interest), and if he had run, then attempted to grab their weapon, they would have been ruled justified in shooting him. This is why you never try to arrest someone as a private citizen if you can avoid it. You're not a state actor and the burden is so much higher on you in case something goes worng. Incidentally, if you want to contrast masterful persecution (vs that clown Binger in the Rittenhouse trial), catch up on Nate the Lawyer's recorded streams from the court, she did a great job. And if you object to my descriptions of Arbery, I'm just relating the facts of the case. While he certainly didn't deserve to die, he was actively engaged in playing stupid games, and won a stupid prize.

    did you watch the trial? it seems you dont know the facts in this case either. they were asked to help look for this guy by the cops, he was known to have been committing crimes in the neighborhood. he had been caught on camera multiple times and had the cops called on him multiple times. they didnt have the wrong guy, he was the right guy. he was shot when he went for the gun, nobody in the courtroom questioned that the shooting itself was self defense. the only problem was the way the judge read the law you have to see a felony happen in order to chase someone for a citizens arrest. he had committed felonies, they knew he had committed felonies, they just didnt see it happen that day so following him became false imprisonment, which is a felony. when you commit a felony against someone you lose the right to self defense. so basically they were asked to help catch him, they had the right guy, they attempted to follow him until cops came and are now going to prison for a long time when he attacked them. personally i think it was stupid the son got out of the truck and put himself close enough to aubery to make a move for the shotgun, but if they thought he was turning on them to use a gun (they were warned he was likely to be armed by police and they had had a gun stolen from their truck earlier too) he mightve just wanted to get a clear shot on him if he pulled a gun. in the end i think the conviction (for felony murder at least) is probably correct, but its not some victory of the law. they were asked to help catch this guy who had been threatening their neighborhood, they tried to help catch him and only shot when necessary in self defense, and now theyre going to prison a very long time because of it. if this was three black men who had followed a known white criminal the same people celebrating it would be protesting and saying how racist the justice system is. and i'd agree with them that it's a fucked up situation then too.

    Interesting points...is that all that happened? I think I read Zimmerman was following him until Trayvon fed up with being followed attacked him and bodied him easily (Trayvon was nearly 6ft tall & 170lbs)...then proceeded to smash Zimmerman's head into the concrete ground, forcing Zimmerman to shoot while he still could Hm...but even with this said, I do remember the police telling Zimmerman not to follow in the first place...so I guess the case hinges on did Zimmerman continue following Trayvon or did Trayvon already get agitated enough by that point and attacked him? What's the argument the pro-Zimmerman people have for the innocence judgement?

    The misinformation spread by the media was so intense in the Rittenhouse case that even on the day Rittenhouse was acquitted a news organization printed an article with the headline "Rittenhouse Acquitted in Murder Of Two Black Men". As for the Arbery case I didn't hear much about it after it initially happened. In fact I had nearly forgotten about it. I guess the Arbery case wasn't a particularly good political football.

    This makes me so happy what hurts my heart is to think about all the other young black men throughout history in the United States have just been minding their business, who's murders have not been solved. My grandparents used to tell me stories about people disappearing from black colonies throughout the South only to find their bodies later hung from trees I am so happy this man's life is destroyed. I I hope this continues to happen, I shouldn't have to worry about any children I have "fitting the description," just because they so happen to be in the area. You have a chance actually watch the videos of when the cops arrived nobody tried to help Ahmad he laid gasping in the street like a dead animal and the police officers walked around his body and comforted the murderers. Finally a system showing some semblance of correctness in these situations.

    Neutral, and I can't comprehend why people think this is a right verdict. Malice murder? That's a charge that doesn't add up to the facts of this case at all. This was negligent homocide at best. The police themselves had involved Greg Mcmichael when he was sent footage of Arbery walking around on that construction site on prior occasions. When arbery did it again that day and they saw him running away, they decided to chase him, they contacted the police, Greg was actually on the phone with police when the shooting happened. And what happened there. As they were awaiting Arbery, he ran to the right side of the truck, when he got to the front, he changed direction, and charged Travis and attacked him, with lead to Travis shooting him. so, euhm, where's the malice part in this case? The Mcmichaels created the dangerous situation, but as Arbery attacked Travis, at that moment, Travis was just defending himself against his attacker. That's got negligent homocide written all over it, but Malice murder??? This is the most absurd verdict I've heard this century.

    @tobiasreaper3650

    2 жыл бұрын

    Although I like your comment, and am glad that these cases restored your hope in the criminal justice system, I am going to add to it in a way that you might not like. I understand why you might lack faith in the criminal justice system, but the reasons behind your loss of faith, probably have little in common with these cases, and possibly, reality (just a guess, I don't know your reasoning). For starters, although these cases are a good test of the system in terms of technical working, they should not be the ones you look to for "faith" or "belief" in the system, which ironically enough, is what the vast majority of other cases with the same or similar charges are good for. Most people who want you to lack faith in the system typically like to cite a macro number or percentage of a demographic or charges or sentencing or socioeconomic background or conviction rate, but by doing so, are omitting all the relevant information about each individual case. Now I'm not going to say that they're flat out wrong, but I will say that most of them use speculative reasoning to reach and absolute conclusion, that they then preach as an absolute truth. The only tangible evidence they might have against the system comes from when they start citing actual cases of proven innocence, but by switching gears to individual cases, they have entered the realm of micro numbers (note: micro can become macro of built up to macro size). By analyzing individual cases, most macro number based arguments fall apart, because all the other relevant information about the case comes in to play. Now I'm going to tell you about current injustice. I'm going to make a guess and say that most cases in which people have been wrongfully convicted are cases in which there is no immediate suspect, unlike the two cases in the video, and cases of false accusation. Over the past 20 years, DNA has helped many people who were wrongfully convicted 30-40 years ago, and in almost all of those cases, there was no immediate suspect. DNA has helped free some people convicted in cases of false accusation, but video, specifically the fact we all carry cameras on our phones and the fact that we have security cameras everywhere has helped save people who have been falsely accused, from ever being charged. Deeper down the rabbit hole, you will encounter situations where the problems are with the law itself. I'm talking specifically about cases in which there is a disconnect between the law and science, some of which have potential to be improved, and others exist because this is the United States, and people have rights. For example, the FBI definition of a serial killer is the act of committing a certain number of homicides over a certain period time, but I'm not sure that intention beyond murder is in the definition. Now, having serial killer desires isn't illegal, the actual act of murder is, and FBI definitions aren't a law, that's just an example of the law vs definitions vs rights. Moral of the story, don't confuse macro based stats with legitimate cases by case research. Objective research studies have shown that juries in general have a 95+% of correctly deciding a case, meaning that most major anomalies are caused by sloppy detective work and/or sloppy/malicious prosecutors. If you are interested in more consistent current problems with the criminal justice system in the United States, look into actual laws and legal definitions that don't align with scientific/dictionary definitions.

    @Frank Da Tank I watched both trials very closely and was absolutely careful not to convolute fact with opinion with having a background in the legal field. I watched the videos and analyzed them pretty intensely. Whether or not that man was just jogging does not override the fact that they attempted to make a citizen's arrest based on zero evidence that he had committed a crime. I actually think that Ahmad had a better self-defense claim when he tried to fight them off had he survived what most certainly looked like an attack. Also, three armed men against one unarmed man...as a law enforcement officer now, we would consider that an excessive use of force when things most certainly could have been handled utilizing less lethal means having that ratio of individuals in this scenario. We have case law that backs our authority with things like this (in my case Graham vs. Connor and Tennessee vs. Garner) to establish what use of force is reasonable. Had that been three armed officers against one unarmed man, with one firing a weapon on him rather than attempting to use less lethal force to subdue him, that'd be those officer's jobs and potentially freedom. These may not be trained officers, but if you're trying to play officer and make a citizen's arrest based on speculation, you had better be ready to face the consequences of your hip-shot actions.

To which Robb replies "this man only watched, hang him last so he can watch the others." He was part of the posse, he could have stopped them at any time. Instead he filmed it like a vulture and then tried to weasel out thinking cooperating with the authorities would save him. Cooperation doesn't make you good or right, it only makes you are too weak to stand for what you did. It makes you a snake.

    He didn't just film. He also participated in the chase. At one point he was weaving about with his vehicle to corral AA towards the killers, and actually hit AA and landed him in a ditch. That's what he was found guilty of, false imprisonment and assault with his vehicle, but bc of the killing, those charges amounted to felony murder. He was found not guilty of malice murder (no intent) as well as the gun related charges cos he was not armed. There's video of him telling the cops what he did (and giggling about it), then he says he doesn't know if the should've been chasing him. He volunteered himself into prison. Should'a stayed fixing his porch.

    I'll probably always watch Abba and Preach cause they don't fall one side or another's opinions and stick to a pretty damn consistent and thought out set of ethics and principles, might not always agree but they give damn good reasons for their positions and I can completely understand their positions.

    I agree with both verdicts. Don't try to take the law into your own hands (call the police and mind your business) and don't try to attack someone and then act shocked when they defend themselves.

    Right, because defending property from career criminals is SOLELY a police action. Maybe wait until you're being raped to have that same stance. Don't worry, by the time the guy's finished his 5th load the cops will still be 20 minutes out. Or in this case, wait on the cops to do something while your home is being raided by a psychopath. I'm sure he's going to stick around and wait for them to arrest him and not just run off into the night with everything he can carry. They'll totally get all that shit back and your bank totally won't give you the run around while you try and reverse all the charges he made with your cards...

    @@charleshill1906 those are very different things. Your examples are crimes actually being committed whereas in this case there were 0 crimes linked to him. The home owner said nothing was stolen, the three men who chased him down had no idea about his past criminal record (with absolutely no context), the fbi found 0 links to him and those crimes so yes Those 3 men over stepped their boundaries and got a man killed for essentially no reason then lied multiple times on police reports and their story. Trust me the only reason Aubury isnt being paraded like a violent criminal is because the recording was confiscated and they couldnt "lose" it.

    @@hakumenx1 Trespassing IS a crime. In case you forgot. It wasn't his home, he had no permission to be there. IE, he was criminally trespassing. McMichael's were made aware of his criminal record by the police who deferred to them when contacted by the home owner. They literally told McMichael's about Arbery because they identified him to them. That's why they were armed. Arbery has an extensive and violent criminal record with multiple felonies one including bringing a gun to a school.

    @@charleshill1906 that doesn't give them the right to play cop and get some one killed because they wanted to be hero's. They had his name and the cops could find him if they wanted to. Also thousands of people trespass on property every day either on accident or on purpose but most if them don't go to jail their just told to leave the property and not get killed because some guys think their hero's
