Unfortunately if they catch the person and they go for attempted murder charge, the defense could argue that his attempt was to harm the person but not murder since he had opportunity to do so after he pushed her. I don't know if it exists but there definitely needs to be a term for this that shows the intent of the timing. Had he shoved her to the ground on level ground, it would be a lot harder to say the attempt was to hospitalize or kill the victim. But purposely meeting her at the top of the stairs to shove her backwards onto the concrete down, shows a willful lack of concern of causing death. A sentence stronger than involuntary manslaughter regardless if the victim dies or lives. The victim surviving life threatening injury doesn't make it a lesser crime.

And once again we have proof that Scott Adams was right again.

Looking at that sweet older lady, I believe that if he approached her and asked her for help she probably would have given him some money. If a person is willing to do this to others, what good does it do to ever allow them to be free again? You think this type of kid will become anything other than a threat to everyone else? Let's look at the stats, here. Crime is going up and there's more of this nihilistic type than there was. Pishing strangers into oncoming trains, slashings, etc. In a city where the populace is not allowed to defend itself against the force threatening their every day lives, aren't we effectively being pinned into a high danger environment? Which, itself, raises the risk of violence? If police and judges will not do the job of protecting the population, and the laws and policies in place are objectively inneffective, don't we have the right to take measures for our own protection? Starting with pistol permits. If guns are going to be a forever problem, I see no benefit to being unarmed, myself. Just telegraphing I'm an easy target by default, no? If we gotta walk on thin ice, might as well dance. Tired of being the smallest voice and the biggest pile of bodies. Time to become a direct threat and stop relying on the half empty promise of possible consequences, long after I've gone cold. It isn't preventing anything but my abiliity to defend myself.
