    Hello Sir, my name is Edward from Ghana West Africa. I'm 26 years old and unmarried and I don't have a child yet. My father has filed for me on February 2022 and seven months later he became a US citizen and added his naturalization to the petition. Anytime that I check my case status it says that My case is being actively reviewed by USCIS. Please i want to know when USCIS will approve my case.

    What if visa was expired when married?

  • @DarianLaw
    @DarianLawКүн бұрын

    That doesn't matter for 2 reasons: (1) if you entered with a visa you can probably (with some exceptions) already apply for adjustment of status and don't need Biden's program, and (2) Biden's program is only for people who didn't enter the US with a visa.

    So, what you're saying is, Utah agrees to marry two people via zoom without either person stepping foot in Utah or having met in person..., but does this marriage certificate enable those same two people to apply for a spouse visa without having met in person within the last two years? Does the marriage certificate negate the "in person" meeting requirement?

    I really hope that they also include some kind of waiver process for certain crimes. If the main purpose is to help those who would otherwise qualify for adjustment of status without requiring leaving the country for an interview then it should be taken into account that waivers already exist for those individuals and we shouldn’t be left with a program that in effect requires those with the record to do out of country interview and those without having it no longer neccessary.

    @@DarianLaw my wife falls into that category and would likely qualify for a waiver as the system is now. But if the parole in place does not consider the same waivers then they have left a hole in the system. Many people are going to have opinions about this new policy but most also will not understand that the primary purpose is to help those that were already eligible to adjust status from having to return to a country they haven’t been to in many years just to conduct and interview and that separates them from their children.

    Good information! I have a composite question outside that topic, please. My husband is a US citizen and our case have been Documentarily Qualified by NVC one week ago, I am pregnant waiting a baby by last week of September. What happens if my consular interview is before my baby is born, would we have a way how to get an immigrant visa for him, could the baby travel with his Canadian passport instead of an immigrant visa?

    You are wrong about there being no filing fee for the work authorization permit and the travel authorization permit. Anyone smart enough isnt going to risk leaving the states during the green card application process to risk losing it anyway, the travel authorization is pointless and a waste of money.

    @Pouyan, I hope you are doing well. I’ve been looking around all the Internet to get guidance for this particular case that I have. My mom has become a US citizen since 2017 but due to some mistakes with my name and date of birth my I-130 petition was denied. She did submit DNA result and all but they never reopen the case. It’s been such a long time and now I’m married and all, I lost my 25 year old brother in the USA LAST YEAR, couldn’t make it ( I’m not sure if was going to go anyways) and want to visit his grave this year and I am VERY SKEPTICAL. I am applying for the b1/b2 while my I-130 case was denied but now I’m extremely stressed and not seeing anyone giving opinion based on that. Any thoughts?

    Hi Darian - I recently received a 10 yr replacement Green Card and my name is spelt wrong. I believe I understand the process based on your video and the USCIS website, but I don't understand why the USCIS website has a section titled "Typographic Error' which you can fill out for a mistake made on a green card. It's a very straightforward eresponse and the page states "Did you receive a notice, document or card from USCIS and it contains a typographic error? We can assist you in correcting the error." To me this is confusing. Am I meant to a) Send in I-90, with Green Card, and other ID or b) Fill out this "Typographic Error" form on the USCIS website or c) Fill out both. Any insight would be appreciated.

What is the latest situation? Since my son is a student, he has a very limited income and tax return, but we can show enough bank accounts for him and for ourselves. Would this be enough?
