Who can carry a gun in Texas?
CBS News Texas decided to look into what Texas' laws say about who can own firearms and where it's legal to carry them.
In the wake of the shooting at an Allen outlet mall that left eight victims dead, there are still a lot of questions lingering about the gunman and whether he legally owned his weapons. CBS News Texas decided to look into what Texas' laws say about who can own firearms and where it's legal to carry them.
Two years ago, the Texas Legislature amended state law so that Texans no longer need a license to carry a handgun. But there are still a number of requirements and exceptions to the law -- and a long list of places where guns are still prohibited.
To help clear up some of the confusion, CBS News Texas anchor Karen Borta spoke with a law enforcement expert.

    when I was in school students, including myself, sported gun racks in our trucks and drove them to campus. Never heard of a school shooting in those days.

    The law means 100% to those who are abiding by it and 0% to those that choose to ignore it. Law cannot stop crime; law can only indicts and punishes criminals. It is the fear of such punishments that DETERS wannabe criminals. Such a basic Old Testament's understanding that I am shocked that nobody knows anymore.

    As a Singaporean I agree, we have harsh punishments on a number of things and that deters A LOT of crime. It's why we have one of the lowest crime rates in the world.

    It makes no sense to me that nonviolent felons are prohibited from having firearms. 1: they have already paid their debt to society. 2: for it to be a nonviolent felony, there can’t have been a gun or any violence involved in that person’s case. It makes no sense to say that a white collar criminal can’t have a firearm when a firearm literally had nothing to do with their crime. 3: the very thing that distinguishes a right from a privilege is the fact that rights can’t be taken away. No one in their right mind would say that a criminal shouldn’t have the first amendment rights to freedom of speech or any other right defined by our bill of rights. This law sets a dangerous precedent that only some people are allowed the rights that are clearly defined. If a person has truly proven that they are too dangerous to freely exercise the rights of every American, then they shouldn’t be released in the first place. But if they are considered safe enough to be free and around innocent people, then they are obviously safe enough to be able to exercise every right that is inalienable from every other American citizen.

    luckily the sign prohibiting guns in businesses does not apply to licensed carriers, only non permitted carriers

    The 2nd Amendment has nothing to do with hunting and long guns. Those framers just fought a war of Indepence from a tyranical State and wanted to ensure the people had protection from such tyranny ever again. This is NOT my take on the situation as the 2nd Amendment has been challenged numerous times in the Supreme Court and everytime they have upheld this. For a professor to lob this notion is disengenous at best.

    Actually she is WRONG! 6 months ago a 3 federal judges ruled that part of Permitless carry law and our license to carry law not allowing those 18-20 to carry a handgun UNCONSTITUTIONAL. So NOW Texas is issuing a LTC to those 18-20 AND those 18-20 can now carry with out a permit.

    @@jables611 yes in Texas, you can get your Texas License to Carry, and Yes you can now buy a handgun in the state of Texas. You will still be limited to what other states you can travel too with that handgun. But in Texas you will be legal.

    @@shivam_singh_9999 The point is that "big guns" like AR-15s give the person holding it a better chance of defending themselves against someone, or even multiple someone's. In an actual gunfight you're going to be under an immense amount of stress and pressure and you'll probably miss a lot of your shots. Most criminals use pistols when they commit crimes, so its good to have an unfair advantage.

    18-20 year olds CAN get a license to carry and legally do so in the state of Texas. First hand knowledge trumps misinformation.

    Also having a license to carry in Texas let's you skip the federal background check as there is a place on the form where you type in your ID information and that gives you an automatic proceed with the ATF/FBI because it assumes you qualify across the board due to having acquired a license. Businesses who don't want you to carry must show the correct legal signage at the door before you enter. 30.05 is no guns at all, 30.06 is no concealed carry, 30.07 is no open carry. If you enter and a sign is present and they ask you to leave because they discovered you have a firearm on you then you must leave, if you don't you get charged with trespassing with a firearm. You also can't carry in a business who displays the 51% sign meaning 51% of it's revenue comes from the sale of alcohol meaning a dedicated bar.

    So much incorrect in this video considering the title, “ Who can carry a gun in Texas”. Research the rules and learn them for yourself and I recommend taking a license to carry class even if you don’t file to get the license. The legal guidance on carry and self defense law is worth it.

    As a CCW holder I think the training aspect is extremely important. This includes proficiency but also safety rules, so that children and others are protected from accidents. We had some students with some scary handling behavior that got fixed that day - or were told to leave. People absolutely need to be screened and background checked to carry.

    So for people who go “ThAt MeAnS aNyOne.” No it means anyone who follows the law. People who don’t follow the the law do whatever they want, permit or not. All this law does is make it so the same people who would never use a gun in a wrongful manner, can carry easier. Having mandatory permits is retarded.. those who shouldn’t be carrying will do it anyone regardless of the law. Then again if we had a correct justice system EVERYONE outside of prison should be able to carry, but we won’t see that in my lifetime

    Citizens from Louisiana, and all Southern states, with a CCP, are allowed to carry concealed in TX. Louisiana also has allowed open carry for many decades, but I seldom witness it being used. When our new Republican governor takes office in January, he has promised to sign legislation allowing concealed carry without a permit.

    by telling the officer for the officers safety she means so that if it ever comes to the officer searching your vehicle or your person that they don't shoot them selves accidently with a gun they didn't know was there. but then again as a criminal wouldnt you want the officer to shoot them selves. just more rules to make it harder for the law abiding citizens

    Not a bad presentation. Some "misinformation" was presented, but otherwise covered the general idea. However, the reporter neglected to mention that, although businesses can ask and/or bar you from carrying a firearm into their establishments (via signage), if you DO carry a firearm in to such an establishment (concealed for example) and your weapon is discovered, their only recourse is to ask you leave. You cannot be "charged" with with a crime simply for the act of carrying into that establishment. That said, if you refuse to leave when asked, you could be charged with misdemeanor trespassing. However, if you comply with the request to leave, no criminal charges can be levied for that interaction (assuming you have no other outstanding criminal warrants, etc.). Also, carrying in court houses and Federal buildings (including any Post Office!) has long been established federal law, and has nothing to do with Texas state law. More guns = less crime!

    Here in Brazil is not easy to buy a gun, a few brazilians have a gun at home and we need to have a license to use it, I mean a gun license like happens with you all in Texas. Having a gun or weapon is not part of our culture.

    No need to worry about Law Abiding Citizens. I had a Deferred State Jail Felony over 23yrs ago. I filed a Non-disclosure (basically sued my DA to have my Record Sealed). It was granted, never convicted of a Felony. Now I can buy & Carry in TX

    You can still do that. It has been legal in Texas to have a firearm "not in plain view" inside of your vehicle for some time now. You just can't be a prohibited person, legally.

    The US Supreme Court has held that every American citizen has the right to carry arms in public for lawful purposes, such as self defense; and, it applies throughout the Republic including territories and possessions. Re. Heller v. D.C. (2008), McDonald v. Chicago (2010), NYSRPA v. Bruen (2022).

    Pretty sure with a license you can carry in an airport, just not past the security checkpoint and if you’re flying with a gun, you must declare it, it must be unloaded, in checked luggage, and in a locked container.

    Before it became constitutional carry in Texas. A year earlier 32.000 Texans lost their conceal carry permit. Due to gun violations. It's safe to say there's 32k folks out there just asking for trouble.

    a lot of folks. I am an Instructor for Conceal carry and Home Defense and will be DPS certfied soon for TX LTC. The demand is never ending. That said, no one should have to pay the State for the right to self defense

    I have USCCA, not the same insurance you think it is. And I get training all the time. Rifle training, CQB courses, handgun training.. your doing a disservice to yourself and your family if you just buy a gun and toss it in your safe

    @@mrsjamessmom9044 What do you envision that mandatory training consisting of? I've been carrying here in TX since before Constitional Carry was a thing so I had to take that "mandatory" training. I can tell you from experience it wasn't what you are envisioning. I sat in a class for 6hrs watching videos and talking then took a written test that a 3rd grader could have passed. The shooting qualification was a joke and I'm fairly sure no one ever failed it in the few times I had to take the course. Now for that "right" i had to pay $75 to $100 each time to the Instructor and then turn around and pay the State of TX another $45 to process the form. It was clear to everyone that the process was just a money grab for the State. Being in the business I hear from folks all accross the Us and it's basically the same in their States as well. I don't think that is the "mandatory" training you envisioned but in reality it was never adequate. As an Instructor I am with you on the need for training but where I differ is it being mandated and pointless. I think the perception of State mandated training is that of military or police level, which it never was or should be

    What danger exists for cop not knowing a law abbiding citizen is armed? I would argue its not the gov business to know. Cops who are told take possession of weapon when no crime exist and violate peoples 4th, 6th and 2nd amendments by calling in serial numgers and illegally registering gun to person via the check.

    Owning any gun should have those requirements. Owning a firearm should be something only an upstanding law abiding citizen has the right to. Not criminals and those who disregard the law. When you beak the law and get a criminal record you lose the right to that 2nd amendment as you have displayed your mental ability is not there to be responsible with one. Gun ownership and responsibility fall hand in hand, if you disagree you should seek counselling. You have the right to not commit crime or be arrested, exercise that right and you get to keep your other rights, overly simple.

    Its about entitlement, selfishness and the fact no one feels any connection or give a damn about anyone else. No one talks about anything and we get offended to easy and delete people from our lives just because they say something we dont like.     I think you got your finger right on the pulse of the problem. Don't see the root problems getting better any time soon though, with all the new communication technology it's harming our usual societal dynamics. Checking for mental health before gun purchases may reduce the number of crazies with their hands on weapons, but it won't stop them all, and it doesn't solve the root problems.

    @@GregariousAntithesis US stopped being a Christian majority nation since 1950s. Majority of so-called Christians nowadays are Catholics that were forcefully baptized as a baby so they "inherit" their Catholicism and bible-poor Protestants that were peer-pressured into believer's baptism before graduating HS and at least go to church for GF/Easter/Christmas eve every year.     This is false reporting! Campus Carry in Texas refers to the legal provision that allows licensed individuals to carry concealed handguns on public college campuses. For campus carry, the handgun must be concealed and the person carrying the gun must have a license to carry. Also, 1:47 what a load of crap! Law enforcement expert? Lmao.. okay.. so I’m guessing he’s not a constitutional law expert. He has no idea what he’s talking about. The 2nd amendment was never for hunting. What a joke! He probably works for the ATF administrative department.

And technically, it’s not just federal buildings, at least in the case of the Post Office, it’s also their property (parking lot, as an example). And obviously that’s not just a Texas thing. Her report accuracy was marginal at best!

    To my knowledge we now have a huge army and local police and other emergency response agencies. Hell we even have modern cars and even planes, this is something we never had when the constitution was signed. In fact the life expectancy was 40 years at that time, 40!. Fun fact, states with no to very little gun laws have a higher murder rate than any other state. Look it up, I did. A car or any vehicle is a weapon and we required insurance and a driver license. A license is to proof that you can drive a vehicle, the insurance is protection from accidents or intentional damages. Do the same with all weapons, just simple common sense. Of course we have criminals stealing vehicles and weapons. This has an easy fixed, make it 25 years minimum jail time for stealing a weapon or using a weapon not registered. As long politicians continue to receive millions of dollars from gun manufacturers nothing will change. Remember that your car seatbelt had to be a mandatory required by law or else we wouldn't have seatbelts today.

    We had an army when the 2nd amendment was added, so whats your point? Also, your lies about states with fewer gun laws is wrong. Look at Chicago, DC, Baltimore etc. Obviously you didn't look it up. And driving is a privilege, not a right. Also, don't confuse the constitution as something that gives us rights as citizens, it doesn't! It tells the government what they can't do.

    It's has been legal to carry long guns openly in Texas for years. When I was a kid, it wasn't uncommon to see rifles hanging on gun racks in vehicles at the grocery store. By the way, most hunting rifles are more high-powered than an ar15.

The 2nd amendment isn't causing anything, criminals don't give a sht what it says and would carry even without it. The data also says guns are used 2million times a year for lawful self defense. In Mexico it's not a right to own a gun but how many gun crimes do they have? The laws didn't stop the cartels from getting and using guns. Perhaps you should move there where guns are illegal...

    Veterans with an Honorable Discharge should be able to carry without question and not required to take any exams or range practice ! WE have done that and are more qualified than most !!!!!

    That's why you do don't say "hey I have a gun." If detained by a LEO you say "I am required by law to inform you that I am conceal carrying today" and you hand them your Texas LTC. If you'd went to a LTC class you would know that.

    ​@@DYLAN102001 it's not a requirement to hold an ltc anymore. So with that being said those classes should be mandatory and instead of a license to carry it should be more of a license to purchase and own firearms and ammunition. any sale to persons not holding such a license should be prohibited. The class should include a 1 on 1 session with the instructor and a qualified mental health professional to determine if each candidate is worthy of such responsibilities.
