On 3/25/2023 FWC officer was conducting water boat patrol around Mullet Creek within New Smyrna Beach. While navigating through the creek from the Intracoastal Waterway, Officer observed a vessel leave the sandbar and almost cause a collision with another vessel. Once the vessel cleared the congested area, Officer initiated a vessel stop and established reasonable suspicion the operator was under the influence of alcohol or drugs. The operator submitted to standardized Seated Field Sobriety Tasks and after administering the sobriety tasks, Officer placed the subject under arrest for boating under the influence. The subject was transported to New Smyrna Beach Police Department for a breath test. The results of the breath test were not conclusive because the operator failed to provide enough breath volume. The subject was transported to the Volusia County Branch Jail without further incident. The Violation of Navigational Rule 5 (risk of collision) was also addressed.
