They can claim that anytime. And cops are like a hammer looking for a nail when they look for bui. It’s all they care about so it’s all they see. The “I can smell alcohol” is a total bs line they should not even be able to claim it because it can’t be disproven or proven in court.

Went from a courteous safety stop to raging, condescending jerk. They were in the wrong but officer could have been better.
