On January 13, 2021 I bought a 2000 Ferrari 360 F1 from CNC Motors (Lotus of Upland LLC). It was going into neutral randomly and I took it to my local Ferrari mechanic as I live about 500 miles from CNC. CNC offered to pay for the repairs, but then changed their mind 2 months in. They paid to have a truck ship the car back to Upland, CA to fix it. Meanwhile it's been almost 4 months and I still haven't received my DMV registration and my credit union has not received the title. They are not returning my calls or emails and I want my car back. There are many stories like mine. Please help me!

    Ed Bolian once said, you never engage in a car transaction where someone ends up with the money, the title and the car... one of those three things have to always be in your procession.

    If you go through a dealer, in many states you have to wait for DMV to send you the title. Nowadays that takes 2-6 weeks typically. 3 months or more, you're being scammed.

    Officer told me sort of similar with party favors. Never get caught with the trifecta. Party favors, cash and weapons. No Bueno.

    @@normalguysupercar I watched your videos about CNC also and just can't believe it's happening to a higher class of people. The question I have is base on your video when Clay came on and apologize and promise to pay everyone back. Let's say he scammed 40 customers, each one of the customers he owes approx. $50,000 (I'm just using that number), that comes to 2 million dollars, I really wonder where is he going to find $2 million dollars to pay back his customers ? The numbers that I use is only an estimate and I bet you the numbers and the dollar amount is much higher.

    This is beyond disheartening. This is bank fraud, most likely money laundering, probably mail fraud. These guys are crooks playing games with other people’s money, so to speak. They have been playing games for a while. The merry-go round has stopped and their scheme collapsed. I feel bad for the folks who have been scammed by a crooked used-car salesman.

    If clay sold the building he should have some money. They had to purchase the land before they built the building. That said, they have so many of these cases - one of our employees was a victim as well- he likely will have nothing left. The best thing people can do is call the DMV - they need to pull his license so he stops victimizing others to pay the victims. The DMV will literally come and pull all Bill of Sales and paperwork out of the building so he cannot legally sell vehicles. Here’s the link www.dmv.ca.gov/portal/locations/investigations-offices/

    Or since Clayman is such a player, he probably contacted the original owner, told them that CnC has a buyer for the Ferrari but when buyer/sales guy did a car inspection, they found out that the gearbox was stuffed. Clayman then hits the original owner with a hefty bill. The original owner shocked, refused to cough up and went to repo the Ferrari. That’s why ain’t nobody heard from Crooks N Cars.

    That wouldn’t help a lot. A lawyer would only help if there was a question of wrongdoing or a dispute of wrongdoing. There’s not. Clay knows he’s f***ed and buried. A lawyer may get you a judgement against him but he can’t get blood from a rock.

    Matt, I am a "court appointed receiver" and deal with MANY, MANY debtors such as CNC Motors. When you do speak to a lawyer you should ask if he can organize a group of the clients of CNC to toss CNC into Receivership. At that point a Receiver will be appointed and CNC can no longer operate under his/their own guise and the Receiver will be operating CNC or otherwise liquidating the company to pay back the creditors/customers. There are a lot of cogs in that wheel, but those with the priority lien or fraudulent positions will take some priority before one of his banks snag all yours and others funds and credit positions.

    Nothing to liquidate... Especially if there are investors in "First Position" Most of the inventory at CNC is Consigned or Provided in a "Flooring Plan" by lender/investors. These guys know the game. But some of us know how to beat him at his own game.

    I can see how all this started. He was just blinded by his dream car. This is where a good friend should step in to be the voice of reason. Anyone would’ve told him to get a PPI at the least before handing that check over.

    This story is a good example of how not to buy an Ferrari with no warranty sold as is, no PPI and just taking a leap of faith that you are dealing with an honest dealership which CNC is not. I would get a lawyer and go from there..

    Can you blame him? CNC was one of the most widely recognized names out there. Even if the gearbox hadn't failed, he still wouldn't have the title or registration. I would have trusted CNC to be selling a good quality car that was inspected and in good operating condition - at least well enough to get me home. I'm not saying don't do a PPI, but I don't blame this guy for trusting them.

    After having now heard your whole story I can’t tell you how much I admire your good faith. I could never have stayed so positive in your situation... the pandemic, seriously injuring yourself, the car having a maintenance issue... figuring out there may be serious fraud going on and even still you try to be optimistic and faithful that things will work out. I’ve been watching all of Dan’s videos on the subject and from what CNC is saying... if one person sort of throws a wrench in their plan with a lawsuit to get what is rightfully theirs it will screw over everyone else? I don’t want to see a lot of people lose out but as you said at the end... I think there is a serious problem there and I don’t think it’s only a recent one either. Good business would have been to stop when they noticed the issue and not trying to carry on making it worse. I hear your story and the more I learn about you the more you remind me of myself in so many ways. I’m glad you’ve recovered from your injuries, it’s my hope you’ll get through this issue with CNC quickly. I wish I had more advice than “Talk to a lawyer.” If you are going to court you’re going to want to try to either beat everyone else to the punch or go in with other owners because if what CNC said is true... one little “wrench” will destroy everything for them and potentially screw over people like you... Wishing you the best and wishing I could do something to help...

    You are absolutely correct in doing your due diligence but did you know that a lot of Ferrari dealerships have stopped performing PPIs for customers as it is too much of a liability for them? Gotta go to an independent.

    I agree completely. If what is being said about from Shane in his interview, this is huge with numerous bad checks being written (which is a crime) and the California BMV with 30-40 complaints, CNC isn't coming back from this and in this police officers opinion, Clay is going to find himself behind bars before it's over. I'd get my car back ASAP before investigators raid the place, put locks on the door and your car doesn't see the light of day for months, if not years. With possession of the car you at least have something besides a car payment.

    @@skliros9235 that's correct, but at least if he has the car in his garage, along with all his proof of purchase paperwork, he has something. If law enforcement ends up coming in and shutting the doors (no idea if that's going to happen) what's in the building stays in the building until the investigation is over and a judge makes a final determination of who actually owns what and whose entitled to what. Things like this can take years. If there's a lot of transactions, forensic accountants have to be brought in to see where all the money has went. Investigations like that don't happen over night. In Clays interview he said he sold his house and building in attempt to save his business and make everything right. That could be completely true. It could also be he's liquidating his assets preparing for bankruptcy court. Either way I'd want the car I'm paying for in my possession at least for the time being.

    I respect your honesty about making what was obviously a very emotional set of decisions, and I’m sure you’ve learned some valuable lessons. Obviously the real issue here is the transaction itself. I would suggest, as others have that you seek legal help pronto - hopefully from a lawyer already involved that is not starting from scratch. Make sure the proper authorities are aware of your situation as I’ve read there is an ongoing investigation. Also, I personally, would want that car in my possession, running or not. Best of luck to you and don’t be too hard on yourself. We’ve all made decisions we wish we could take back. Live and learn.

    What really is sad here is CNC "Clay" and probably his wife will be in jail in the next 30 day's and everyone of these poor customer's are going to lose all their money. At least the people with car's still there they can get them back IF Clay didn't figure a way to take loans out on those car's. We all will see soon enough it's all coming out now.

    Certainly not finance it, or any other type of transaction that doesn't involve an extensive PPI, and leaving with the car and a clear title in hand at the time the transaction is made.

    One thing when the contract says "AS IS",it means as is!I had a simular thing happen to me when I bought a 1974 lotus europa JPS,I bought my first exotic and did not do my true diligence of understanding her. When I got close to home I started to hear a noise like grinding metal,finally the car came to a skidding halt and stopped I tried to start but no go! I had it towed to a shop close to me and low and behold I had a massive transmittion leak due to slipshot transmittion engineering! The crown and pinion shaft had weilded the sincro's and gears to this shaft,each [1-4 gears cost =$2400) and the crown and pinion shaft cost $2400!! Like you I contacted the orginal dealer he told me he would help,I did not hold my breath!Lucky for me I reached to LOTUS parts west and they had a used transaxle gearbox for $1200,thank god!

    I bought my Ferrari from Phillips Auto in Newport. CNC kind of gave me the creeps. I’m in sales, and their salesman on the floor was off. Cam, one of the managers was cool, but again, something wasn’t right. My buddy went there with me to get an R8, I was going to get a Scud. Glad I didn’t. Thanks for spreading the word. Good luck.     Matt, after hearing about your experience, my heart goes out to you. I live right down the street from Woodcreek.....and if you're still in the same area, I hope to see you "bombing" up and down these same roads soon. I liked how CNC was crying "Boo Hoo" and saying "Please stop saying mean things about us because then we'll have to declare bankruptcy and then NO ONE gets their problem solved." Kind of a subtle threat, really.

    In California, legitimate dealers will register the car sold on the day it was sold and put a paper registration on the windshield. If not, stand up,, turn, and walk away. CNC is nearby and I pass it daily. Didn’t know all the brouhaha until now.

    I know exactly how you feel same thing happened to me a few years back but with a Porsche ( south Africa) after about 6 month of fighting everyday with them and going to the shop every day it was finally sorted , very scary, and these guys are so convincing that you actually believe them and feel sorry for them, but at the end of the day you out of pocket, good luck hope it gets sorted

    I bought a 458 from them sight unseen from out of state about 6 years ago. Smooth and seamless transaction. They used to have a great reputation with incredible inventory. That doesn't happen by mistake..... wonder what's happened over there.

    thanks for sharing all this mess with us, hope this tale about the shifting encourages everyone to get a PPI BEFORE purchasing an exotic, even from a dealer. They really seemed to give ya the run around. I know you wanted to make a video of you and the camera of your experiences with them but would have been cool to see the videos and the documents you're referencing as a part of the story. Hopefully you can prosecute CNC to the flat fullest extent of the law. Time to lawyer up!!!!!

    Hey Matt -- I bought a 2003 Ferrari 360 Modena spider from them back in August 2020. While I didn't have the nightmare time you had, there were definitely some of the same patterns. Customer service from everyone besides Casey (KC?) definitely lags and feels like they're shorthanded and just not on top of things. Certainly poor follow-through for even a regular dealership, let alone a high end dealership reseller, let alone a super-car dealership reseller. And I had the same issues with the title and DMV stuff. I bought it in August 2020, temp plates expired in Nov 2020, by March 2021 still no plates. I attributed all this to Covid delays either at CNC or DMV, until I called CNC, and learned "oh that car needs a smog check before we can submit the title paperwork, sorry no one's called you, we're a little shorthanded." It finally got taken care of, but I had to call back twice. I finally got plates, title, registration. Let's do shout out to Casey though, he's a star there. I had some service done, and it was all perfect. He was always professional. A couple of question/items for you on your purchase: - Did you do a pre-purchase inspection (PPI)? When I researched my 360, every site said to get one to avoid costly hidden repairs, so I made sure to get one on all the cars I was seriously considering. Dealerships all seemed cool with getting one done, seems common. - Early models of the 360 (1999-2002) are supposedly a little less reliable and more quirky than later models (2003 and later), just because the line was new and they were still shaking bugs and design hitches out of the line. This may be the cause of some of your issues? - Title: If you financed a portion of your car, won't the bank get the title until you pay off the loan? Just addressing your expectation of receiving the title. You should definitely get plates and registration paperwork tho. Good luck getting it back. They're so much fun, it'll be (mostly) worth the wait! If you tire of this battle with the 360 though, consider maybe trading it in and upgrading to the 430, which is apparently a little more reliable? Once you get your next bonus(es) :)

    Thanks for sharing your story and it’s heartbreaking but I don’t understand why the people who have come forward have been so patient with CNC, especially with such high value cars. A similar thing happened to me at a dealership on LA and I immediately went defcon 5 and had my lawyer go after them and I had my car back two weeks later. I understand that these are emotional purchases but business is business and you cannot just trust the other party, you must verify.

    Hire a lawyer. Tell the bank what happened. They will try to reverse the payment, however, it may be too late. I have had fraudulent charges reversed up to 90 days after they hit the bank, but I have heard others have not been so lucky. Next time, do research before you buy. Get a pre-purchase inspection. Don't buy something you can't afford to maintain. Don't buy sight unseen. Also, file a claim with the BBB. At a minimum, others need to know.

    I am sorry about your experience. I recommend once you get you money back you go to website Ferrari Chat and read up and research before buying. There are buyers guides etc. Number one rule is get a PPI ( pre purchase inspection) from a reputable independent as well as look for a car with a complete service history. The issue with your heat exchanger may have been easily detected by simply removing the cap from the overflow reservoir and checking for oil in your coolant. Good luck.

    Sorry to hear about this, I almost bought a f430 from them years ago but it seemed super fishy and odd and I walked away. I hope it gets resolved for your sake soon but I think a ppi on this 360 upfront would have saved these headaches since the inspection would have showed you the car had transmission problems

    Three things make up a car deal. 1. The car 2. The title 3. The money. If you don’t have of one of the 3 at any given time your setting yourself up for something bad.

    Please check with the Consumer Motor Vehicle Recovery Corp. They have a website. This is a Corp set up by the California Legislature for dealer Freud.

    This is a more common problem than you think. There are some bad dealers out there whether it is a independent or a new car store. I have been in the automotive business for almost 40 years and have herd this story more times than I can remember. Like your story they are working off other peoples money and the customers that get caught up with these guys tend to give the dealer the benefit of the doubt. More times than not your money and your car are gone or you end up paying twice for the car or for repairs. In the case of the loan your bank will hold you responsible for the balance due. They will want it paid off in full immediately as you do not have ownership of the car no title no ownership. The car if you have it will be taken by the title holder wether it is the bank or owner. I would get the state police involved to start with and hire a lawyer to protect your interest as best as possible. People in your position need to get aggressive to close this guy and others like him down, Clay and the people who work with him are thieves. Never pay or give more funds to a dealer or seller than you are willing to lose with out seeing the title to a car. No title no check. If they can not do that time to look for another car.
