Tax assessors do not work for the town. They are hired to assess the property. They are not hired to check for permits on the property they assess. That is the towns CEO's job. He may have recourse against the owner for the cost to remove the buildings and for the value assessed to those buildings but it may cost more to collect than it's worth. The real estate agent isn't required to pull permits and do Isaac's due diligence. They rely on the owner being truthful on the disclosure and they are not liable for a sellers nondisclosure. Any buildings he removes will remove the tax he pays on them so he will be reassessed.

The county has assessed that property multiple times over the last twenty years in order to raise property taxes. Don't they check to make sure what they are assessing is even legal?

The tax assessor is an outside agent. They assess the property value of what they see. They don't check if things are permitted. That is the code enforcement for the town. Code enforcement officers change all the time. They aren't going to check every property for illegal structures. Most likely it won't be noticed unless someone complains or when you go in for a permit to make changes. But the tax assessor only assesses the property, they don't look for permits to ensure they are legal.

When the title search was done for the property did they charge you for title insurance and did you get a general warranty deed? The title search property should have caught ALL of that and if they didn't then they should be paying up on the title insurance? @@irenekegel5988it's not the realtors job to protect you unless you specifically hire a buyers agent and you pay them to do the research. Realtors are not required to do research on the property for the buyer. The seller discloses to the listing realtor and the buyer is responsible to hire a real estate attorney or do the research on the property himself. Every party in the selling/buying process has a specific job. the buyer, Isaac, did not hire the specific person he needed to protect him from these issues. It was not the realtor, bank, appraisers or inspectors that failed Isaac. It was the seller and buyer inexperience. I feel awful for them. It's a shame and they don't deserve it. But, it's on the seller and buyer.

Well, everything should be disclosed upon purchasing property. The new owner of the property should not be obligated to legalize ALL the structures on said property. That is ridiculous that you get screwed just because you purchased the property. How is the contract even legal if they did a bait and switch?...it's like a money pit...that is criminal...in my opinion... It's ridiculous that you should financially be responsible for this.

Shouldn't the illegal disallowed buildings and attached spaces been discovered during evaluations for property taxes? Was the previous owner paying property taxes on illegal structures? How is that right? I think you need legal counsel and possibly representation. I would not remove anything until you find out if the county or state has been paid taxes on buildings they now claim are not legal.

They do not decide what is legal, nor do they check if structures are legal. They appraise (not inspect or research) what they see. Hello Issac, J. D., Jaylena, and Ember. I had a somewhat similar issue when I purchased my home. When I purchased my home, it was only 2 years old. During closing, my attorney told me according to the city ordinances, my house had been built 2 feet too close to the street. He went court and got an exceptional ruling which allowed my house to be exempted from that city ordinance, and I didn't have to make any changes. That's why I was encouraging you to get a lawyer. I know lawyers are expensive and it's your decision. I wish you all well. Even though you don't know me, I feel like I know you all and only want the best for you all. Hollar Homestead is adding on to a mobile home - free standing room addition with connected roof. Foundation & walls are structurally independent. Happy Birthday Isaac. So glad you have JD to help you thru this mess. OMG so much crap. Also check zoning restrictions when you check permits. Great (and accurate) explanation of code compliance, JD! Over 20 years of code compliance experience, and you are spot on

Hollar Homestead is in NC and that state has the same rule about keeping add-ons separate from a mobile home. Also, DYI-fferent is in Florida and I believe they found the same when they started renovating a mobile home.

The seller hast to disclose the structures made under his watch arnt to code and therefore makes him liable for damages. In my area you can sue for damages for up to 3 years after the sale is made. Especially if they are in the listing. That being said I knew the enclosed porch was done illegally after the mold video

First of all: Happy birthday Isaac. I can imagine you'd like to celebrate it in a different way. How awful this all is, maybe it's better you know all this now, than when you restorated the buildings. Is it possible to sell the materials for reuse? Maybe people, who wants it, can even help you with the demolition and removing of the material. I'm glad you have JD to help and support you. Lots of success.

Happy Birthday!! You're blessed to have JD as your stepdad! - - I agree with others, keep a detailed log book of your time spent driving to/from offices, in meetings, on the phone, researching, and physical labor. Down the road, if you decide to seek legal counsel, this log book will be significantly helpful. - - I wonder what would happen if you posted to Marketplace. Free housing lumber! Take what you want. LOL I'm sure there will be some useful boards, posts, etc that someone may love to have for free. This will save you some cost in disposal. People take free, used pallets all the time. It's worth a shot. --During demos, I'd save the good boards for small projects like raised planters/beds, a playhouse for Ember, a picnic table for the family, etc.

With everything JD, said Im still pissed off at the people that have no ability to live and let live. Yes, every state is different...but one thing in common is this is NOT the land of the free. This is indeed the land of Karens, bureaucracy, strangling laws, over taxation, and people that simply cant mtofb. Take care, Isaac. Happy Birthday! 😊

Since I started studying politics about 10 years ago, I call it the Corporate States of America. I realized that regardless of political preference, about 98% of them represent corporations. They should have to wear suits displayingnthe logos of all their donors, like NASCAR. There would only be a small handful of politicians who would be able to wear a regular suit, without any logos.

Always, always, always hire a real estate attorney when buying property. They represent you and they would/should stipulate in any purchase agreement, that all these structures/improvments, etc., have supporting documentation from the county/town, etc... cheap insurance for your peace of mind. I surely do hope there's some way to sue the previous owner or someone for compensation. This just sucks. Happy Birthday Isaac. And thank God for JD!!!

Unrestricted land is what most people want but don't know it. I figured this out when we bought the land I live on now. I am on grid with a septic. I am surrounded by crops and a hunt club. I am not in a city. Hint: look for a property with an old trailer or old home. Usually will already have utilities you can tap into! I hope it gets better from here. He built housing, luxury apartments in Manhattan, churches, schools and hotels in his native country in the Caribbean. It’s so good to see an elder take the time to help him go through this process.
