Don't open the door for cops. Let them stand out there and knock. If the music wasn't on when they pulled in they have no evidence your music was too loud.

Even if they do have evidence - let's say it's in violation of an ordinance and they used a decibel meter, there's still no benefit in opening the door. They can go get a warrant if they need to talk to you that bad.

@@elhior23 Unless the witness can offer evidence that the music was louder than allowed by law, a citation is unlikely. Citations are normally going to require more than a he said/she said.

There are noise ordinances in each city, the officer would need to have a decibel reader in order to actually charge you with “loud music” that would be the precise “evidence” he would need in a court of law for this to hold up. I know this bc I’ve played in bands for 12-15 years and have done MANY house shows, we always call the city beforehand and verified what the noise ordinance was (usually there was no ordinance until after a certain time so we typically finished playing before that point) we had the cops called on us multiple times (allegedly) but the cops never actually showed up

There is an ordinance and it has stipulations. As long as you aren't breaking the ordinance, it doesn't matter. In my area, they use a sound meter and it can't be above a certain decibel. He may not even have been in violation.

Why turn the music off. They have to have a decibal meter and get a reading that violates a noise ordinance and that a law has been broken. Without that they can't do anything. Play your music just a little lower.

He did he decide that his music was loud. Did he measure the decibel level of the noise? Was it above the City code?
If the cops heard that it was loud and it’s unlawful then they had probable cause. He probably just got himself a misdemeanor for failing to ID / obstruction. If he never steps outside, he doesn’t commit the secondary offense of failing to ID / obstruction, because he had no obligation to talk to them without a warrant. Don’t screw yourself, don’t open the door.

Probable cause to do what? Make an arrest? Based on a call? They can only detain you and ask you questions unless they have reasonable articulable suspicion that a crime has been committed, is being committed, or is about to be committed. You're right let them leave their little card.

It appears from the words that were exchanged, that the police heard it and asked him to turn it down, which he did, and then came back to video the police. It is an infraction to play loud music, since he was outside and did talk to them, he would be obligated to provide his information, for the ticket. When he refused, it is arguable, that he committed a misdemeanor to fail to ID / obstruction. He could not have been arrested from his curtilage, legally, but he certainly could still get a misdemeanor warrant placed for his arrest. Also, Judges issues warrants for infractions all the time. Those police can easily get a warrant for the code violation of loud music to force him to pay a fine or go to court, or whatever remedies are in that towns laws.
The volume for sound is quantifiable with a decibel meter. I would have asked the police officer to measure the volume with a decibel meter and see if it exceeds the ordinance. My guess is the city ordinance doesn’t specify how loud is too loud.
