We Need Supreme Court Reform with Rakim Brooks

America is facing a judicial crisis. From lower courts to the U.S. Supreme Court, it’s clear that reform is needed to protect democracy and secure our rights. And as the Supreme Court is about to start a new term, change is needed more than ever. Rakim Brooks, Democracy Docket contributor and president of the Alliance for Justice (www.afj.org/), joins to discuss the issues plaguing the judiciary and what reforms are needed.

    They need to end lifetime appointments period. It's time to give them terms just like the other lawmakers and judges. That should be step number one to reform the US Supreme Court.

    Term limits is only part of the answer. The other is Professor Tribe's suggestion to appoint more Justices to the Supreme Court! Think if you limit the Supreme Court to 18 years, as suggested here, it doesn't unravel the present corruption on the Court. The only way to solve that problem is to out man them, so to speak, with the addition of other Justices to the Court. Accompanied by a written Code of Ethics that will require the Supreme Court Justices to follow the same ethical standards that every other Judge in this country is required to follow. After all, no man, or Justice for that matter, is above the law!

    @@user-zd2uv3ss9z An unfettered Supreme Court is stripping American citizens of rights established by precedent, in some cases, for 50 years. Not to mention stripping away established laws that functioned as necessary guard rails that protected Americans from harmful pollution caused by large corporations. Nope, an unfettered Supreme Court is NOT what is called for during these dangerous time! They are adding to the Trumpian chaos. The worse part is that the majority of the people in this country don't want the America they are trying to birth. Arguably the corruption of Justices, such as Thomas and Alito, is in plain sight for all to see. These two men know how to butter their bread on both sides in order to live large. Thomas has a conflict of interest because his wife was front and center in trying to overturn the Biden victory and both he and Alito failed to report the monetary manna from their wealthy benefactors as did several other conservative Supreme Jurists. Now you are advocating to turn these wise-guy Justices loose? I say no way in hell!

    I have to put the faith in the American people to vote for DEMOCRACY over dictatorship. I won't live in a dictatorship so my life depends on all the true Americans to vote for DEMOCRACY.     First, the judges go by the LAWS, NOT over rules the FACTS, the juries go by the FACTS. When a criminal such as Donald J. Trump also known as MOB Trump should be rules by the juries, not the JUDGES. When enough evidence indicates to public, court cases MUST present in court, juries will go by the facts present in court, NOT the Judge. Therefore, the SUPREME Court judges SHOULD NEVER ALLOW to get involved until the FIRST court case is COMPLETED. In recent days, most of the Supreme Court judges are SUPER BIAS, if the judges are bias, they SHOULD NOT SERVE as a judge, the judge should be in IRON FACE, it does NOT matter whom the defendant is INCLUDING he/she is part of your family members. The judge can pardon ONLY pardon when AFTER THE CASE and depends on the criminal is a complete VIOLENT, TERRORIST ACTS, or a psychopath. Do the SUPREME Court Judge(s) can identify himself or herself as HONEST as said, please ask yourself are you being BIAS, CORRUPTED or GREED, you all should know in your mind, ask ourselves to have I been STANDING in a MIDDLE PATH?     We need to go to : uscourts.gov and flood complaints about the supreme court judges and judge Cannon for protecting Trump and not giving us a NO IMMUNITY FOR TRUMP and not giving us a speedy trial for justice for us all. It's a page and half form to fill out.

    Finally! People discussing what can be done to fix the broken court system. Yes to fixed terms, fixed tenure or age limits! Anything is better than terms for life. Elsewhere, only royalty has the privilege of a job for life. Fixed terms should be a feature throughout the political and judicial systems of all democracies.

    Thanks for all the hard work your doing. Love watching your shows. Democracy MUST prevail, not just for the US sake, but else where in the world where we trade and have good standing with US.     Any reform process needs to change lifetime appointments to the SCOTUS. And perhaps an independent process for their appointment, with more diversity. And, more importantly, an ethics guideline that includes various penalties for breaches would be a great addition! Loved the discussion! Thank you both for taking on the fight for democracy!

    They claim to have ethics guidelines now. I agree with you. There should be ethics rules with clear and severe penalties for breaking them. It should not be up to the SCOTUS to.police itself; it won't.

    I think term limits are a very good thing. Just as commercial companies update their product campaigns, so should government. Refresh, regroup and be relevant. We have had way too many old white people running our government for way too long. Term limits for all roles in government plus getting corporate money out of government will go a really long way in healing our country and saving democracy.     What a great interview. Our youth are going to save us. I was a school nurse in 1972. Several young teachers were in NOW. We celebrated when SCOTUS made it a law. When they turned in back to the states I cried. I worked in a children’s hospital ER for several years in the 60s. I have seen what happens to tweens and teens who tried to have an abortion by any means possible. There was so much damage that many were never going to be able to be have children. This is now our future.

    "For life" in the 18th century was, on average, a much shorter span than it is now. In my view that's a factor militating for term limits for Supreme Court justices.

    If Thomas is “unaffected “, in his rulings by all of his “ gifts”, why did he not report them? Term limits are necessary to stop least change the corruption.

I LOVE Democracy Docket bc not only do I learn so much but I love having to look forward to more and the updating of the docket and what's going on there!     1. It is time to add 4 Justices. 2. Amend the Constitution to include SCOTUS in the ethics guidelines. 3. Investigate financial gains of justices and family then start impeach and tax declarations.

    I would love to see an episode on how to vet the candidates in judicial elections. In my district, I often don’t know anything about these candidates who often run as the nominee across all parties (Republican, Conservative and Democrat). How do I research these judges?

    One of my favorite pieces and absolutely enlightening. I graduated in '69 and survived Reagan, Nixon, both Bushes, and finally see how all the many threats against our preference for a democratic gov't are rooted in our past, back to the civil war. That ended but was never resolved and that same power struggle is what we are seeing play out now. Power is the name of the game. Politicians come and go and should not have any power that works against our great experiment for Democracy. Checks and balances have nearly disappeared and that all shows itself in the judiciary top to bottom! Fascinating yet terrifying! Thanks, as always!

    I was pleasently surprised how well Rakim used sports analagies to expose how casualy incompitent SCOTUS has become. Calling people unethical can open a tiresome debate but, calling out clearly unprofessional behavior wakes people up. Good Post!

    We truly need to keep the supreme courts accountable and not let them serve longer than our presidents and they should have be voted for each term everyone else in general has to be voted for and that would keep them honest and not able to take advantage of of anyone and can’t get away with breaking laws written clearly that some seem to break .thank you for your programming s Gadeken

    The Left needs to get the House and Senate, by a large margin, to do anything. Setting term limits for Justices is one thing the must be done. Setting term limits for all of congress also needs to happen. The court also needs to be expanded to 13 seats, Stat!

    Thank you for your programs . Enjoy them all. Very informative and up to date. Know more about the supreme court. I am a proponent of term limits, lifetime appointments to anything is too long. Votes are needed for everything involving people and their parties and ideas and ideals. Even with appointments there should be EQUAL division for bi-partisonship for every branch of government.

    I really like the idea of term limits for Supreme Court Justices. Staggered terms would allow every President to nominate a justice or two during the term of their presidency and if the Senate were prevented from obstructing those nominations by requiring prompt hearings and votes, the court would likely be much more balanced and worthy of being trusted.

    Rakim Brooks' point on the Senators withholding their blue slips from confirmation was eye-opening and seems like a change that might solve part of the issue. I am not sure I agree that switching out the court as rapidly as you suggest, @jeffschroeder4805, would be better; I tend to agree with Mr. Brooks that an eighteen-year term might have the salutary effect.
