STORYLINE
LAMB OF GOD FRONTMAN ACQUITTED OF FAN'S DEATH
A court in the Czech Republic has acquitted the lead singer of the US heavy metal band Lamb of God of causing a fan's death at a concert.
Randy Blythe was charged in December with causing bodily harm to another person with lethal consequences.
He was accused of pushing a 19-year-old male fan from the stage during a 2010 concert at Prague's Abaton club.
The man hit the floor with his head and later died of a head injury.
Prague's municipal court ruled on Tuesday (5 MARCH) that Blythe was not guilty because what he did was not a crime, a court spokeswoman said.
Blythe, who had pleaded not guilty, acknowledged he pushed the teenager because the band doesn't tolerate any fans on the stage but said he was not aware of any injuries.
He made statement to the court during which he seemed close to tears.
"I am very sorry for your loss," he said. "Daniel was a fan of my band. I had no wish to harm him. He was just a boy. I wish he was still here."
Prosecutors had demanded a five-year prison term for Blythe, who faced up to 10 years behind bars if found guilty.
In its ruling, the court said it was the concert's organizers who are to blame for the accident, the spokeswoman said.
The state prosecutors, who had demanded a five-year prison term for Blythe, said they will appeal against the verdict.
The 42-year-old Blythe was arrested in June when he returned to the Czech Republic for another gig, not realizing that he was being investigated there.
He was released five weeks later on 400-thousand US dollar bail after a Prague court dismissed a prosecution request that Blythe be banned from leaving the country, fearing he wouldn't return for the trial.
The relatives of the fan, who are seeking compensation, were told by the court to file a separate case, the court spokeswoman said.
The prosecution said they would appeal.

    It wasn't a case of murder. He was charged with bodily harm resulting in death (§ 146 par. 4 of the Czech Criminal Code), which stipulates a sentence of 5-10 years, which sounds like a lot, but in his case, under these circumstances, he would have received a maximum of 2-3 years of parole. (I am a Czech lawyer).

    To be honest, can you blame any musician after what happened to dime bag? Sure most people there are there to have fun and a good time but what about the people who make threats online or whatever for whatever reason? I don't blame these guys at all, it would be nerve-racking having people clutter and storm the stage.

    Exactly my thoughts too. After what happened to Dimebag, you can't take any chances anymore. Fans should be able to have the presence of mind to realize you can't just run up on stage with the band, because if you are allowed to do it, then so is everyone else.

    Czech lawyer here... He was not charged with manslaughter or murder. He was charged with Bodily harm resulting in death (§ 146 par. 4 of The Czech Criminal Code). There are two main problems here. The first is that Czech law does not allow charges to be withdrawn at the request of relatives or victims if there has been a death or serious injury (otherwise it would happen). The second problem is the classification of the crime. For it to be "Negligent bodily harm" with a far lower punishment (despite the possibility, there is practically no possibility of going to prison for this), his actions would have to result from a breach of an important statutory duty, which a metal concert is not. Czech law simply does not allow "accident" very much and you are charged with some form of negligence. In the end, it's just a tragedy that he faced like a man, even if convicted, he would not go to prison and boy's family forgave him (never blamed him either).

    Just to make this straight. It's been clarified that Daniel is not the guy who can be seen stage diving in the video, it's someone else. We don't know what happened at all.

    If you watch the actual footage, it clearly shows his Bodyguard was the one who shoved Daniel off the stage. Randy barely had any actual push. But Randy is a stand up guy, and took responsibility for something he Really didn't have to.

    I’m glad he was found innocent. Randy pushed Daniel off the stage because he never knew what Daniel could’ve been up to. If you look at what happened to Dimebag Darrell, you’d understand why Randy didn’t let him on stage, but he had to think in the moment on how to get him off, however, the worst case scenario happened and Daniel unfortunately passed away, but Randy didn’t intentionally hurt Daniel.

    No metal band will ever intentionally push someone off to get them killed. All that is done is in the name of fun. And yes, every fans that come , just for fun. If it wasn't fun, does the question of even going to a concert arise. I mean, do you wear your favourite dress cos, you have to ordo you wear it cos you like it, it is fun. Sometimes, tragic incidences happen. But that doesn't mean it was intentionally done to kill someone. If makes no sense. Why would an artist kill one of it's own fan, that also, by pushing off stage. This seems like a court case, sneak out money. Smells fishy. Yes, you damn rats, you like to smell money out. And for that you will do anything. Go to hell and rot.

    I broke 2 ribs at Mayham feast and it wasn’t the bands fault or anyone else i was pumped up decided to get in the round pit got pushed up against the fence by someone who had no idea he did it,it’s all in the moment you know what you are getting into when you get front and center at a metal concert, I lasted the whole concert hurting but left next day went to hospital but not once did I blame band or anyone around me, to this day I still owe money to hospital lol

    @@markzuccerberk8757 I just read his book "Dark Days" and he actually explains it. Throughout the trial all reporters were real jerks, placing their cameras and flashlights upon his face, even hit his head several times. So once he was found not guilty, he decided to pay em back with the same action. He asserts all reporters felt uncomfortable and that was his purpose. So yes, it was kinda mocking unto them.

    of all the concerts they've played, and are still playing. this case was a simple close, but i'm sure the judicial system just wanted to evaluate it, have the process finished. for the sake of the family. would like to know the truth, but its probably all just a bunch of ridiculous misunderstanding. metal heads are tough people. you don't expect us to just die falling from a stage, but if you were to hit a gate on the way down and it rotates your body, it could end up braking your neck ... would that be randy's fault? come on... we mosh at these shows and beat the crap out of each other.

    @@docdave1994 Haha sorry, I don't know how many people pushed the kid off stage, but either randy, a bouncer or randy and two bouncers pushed the kid off stage I think after he had repeatedly came onto the stage. The issue is Dimebag a guitar player who was shot and killed by a crazed fan who came onto the stage. So absolutely no people are allowed on stage so its like just asking for trouble, they act violently to get people off stage for the safety of the band, you might say that's bullshit but lets say somebody was trying to stab randy or something, you need to push him away as fast and effectively as possible.

    @@ChristopherMcLarenExperience That kid was in Prague, not in the US with their gun control problem. He didn't shoot nor stab anyone, nor was he trying to. He didn't have any weapons. Probably he didn't display any agressive behavior towards the band.He was just an overjoyed kid who got carried away to the point of jumping onto the stage, which he shouldn't have. Yet, the singer responded in a violent way while he wasn't being attacked, and that response caused the death of a kid. Fans invade the football fields sometimes, football players never respond the way he did.

    Randy may had partial blame but the promotor and venue were ones who were to blame venue was tiny and security was poorly set up, it was an accident waiting to happen another thing that puts into Randy's favour his nearsightedness because he could mistaken Nosek to another fan, Randy accepts responsibility but it's not his fault
