    you left out this when the examiner ask you about the radiculopathy or neuropathy you state moderate or severe to get more than the 20 percent mild rating - the trigger words for higher ratings are severe for the highest ratings or moderate for the second highest ratings - Here is the key you got to state this with your first c&p or DBQ this is the key to the promise land of the 100th

    Thank you because my private doc is going to fill out the form and I see on page 9 I had moderate and not Severe selected. At the moment I had a flare up of back and neck, so at this time it's definitely severe.

    I knew I’d find my way back to this video. I started with 10 for back and 10 for neck. I’m now 40 back, 20 neck, 10 each leg for radiculapothy, and 20 for each arm radiculapothy. Got me over the hump from 90 to 100 P&T

    @@genjustice4766 I don’t have it connected that way but I believe I’ve heard it be connected. I mean it makes sense. If your lower back is out of wack then it’s probably logical to believe that would affect your upper spine. I’d talk to your doctor about it and see what they have to say.

    @@yolandaletitia8934 that I get tingling down my arms and legs. It can either be a numbing pain or sharp pains. When it’s a constant numbing pain it can sometimes disturb my sleep. For evidence I had an MRI showing my disc from L5-S1 bulging. I didn’t have an MRI for my upper back just an Xray. My C&P examiner was awesome with connecting it all for me.

    I feel like this explains so much. My behavior has been so different since a persistent neck and back injury. Horrible mood swings and irritability. I feel like I can’t even stand myself at times. I’m still in and getting help can be so hard at times

    It only gets worse as you get older. So make sure you apply for va benefits. Literally it can get so bad you won't even be able to function at a normal job. I'm sorry, but its the truth.

    This literally what I have I had left arm ulnar nerve surgery, 0311 overuse and overtraining fucked up my left arm but now my whole back and both legs and arm go numb and I do feel those symptoms working on my claims right now

    Dual Bilateral will also give you the 10% bonus. Also headaches from neck pain are what I get all the time, up to 50%.

    @seanaleta5527 if a condition is rated Dual bilateral, there is a 10% bonus on the condition. For example, 40% knees dual would be 44%. There are some other caveats, but that is the essential baseline.

    I didn’t put this on my claim but they gave me it anyway. I got 40% for right arm, 30% for left, and 20% for each leg. They said they gave it to me on my behalf because I have disc degeneration and spinal arthritis which caused nerve damage and pain. I have a lot of % for other things as well. Somehow I got 100% p&t with SMP (section K) my first try without any help filing.

    I’m going on the 23 this month for back neck leg pain from a laminectomy to correct pain been on meds now bowels messed up and have been told I have acid reflux and sleep with CPAP since 2014. And one C & P exam referee as 100% P & T in employable then now revered to a 3rd VA contractor. Grrrrr original claim 4/20/2022.

    I can trace my cervical pain back to head trauma in recruit training. Now my condition have worsen. I just recently submitted for a increase due to anklylosis spondylosis and radiculopathy. Have gerd abd IBS.. i have alot of service connected joint pain. The VA will check to see if my claims are legitimate. I'm sure I will get rated.

    I'm service connected to back pain, but not service connected to neck pain. I now have neckpain that I believe is related to the back pain. I've been out of the military for 8 years. Is the back pain a possible nexus for the neck pain as far as the VA is concerned?

    I am disabled for s-1 degenerated disc. I am at full benefits back. My back gave out and I broje my neck faling down stairs. My neck kills. Can I open up another claim due to my service claim causing me to fall? Beleve me I am just giving you a good valid question about claims and superseeding the initial claim amount.

    You need an orthopedic to explain exactly why your neck hurts. If you don't have that, they won't even accept your claim.

    Can you do one on cancer related claims that are covered under the PACT act? For context, I am still active duty and have been treated for rectal cancer. I’m now in remission but am awaiting an MEB. I’m over 17 years TIS but I’m not counting on being able to make it to retirement. From what I understand, once you’re in remission, it’s no longer counted as a “disability” but the chemo/radiation and surgeries have been life altering. Not really sure how to approach this in the claims processes.

    @@crabbit. Hi Crabbit, have you researched residuals in the CFR? Ex. Prostate cancer after treated you may have things like frequent urination (voiding) that’s a residual you can claim. Hopefully that makes sense.

    I am service connected at 20% for thoracolumbar issues and I have a diagnosis of Cervical strain with stenosis in C5-7 more severe on the left than the right (no claim submitted for my neck at this point). Upper extremity radiculopathy, bilaterally (more so on the left). Is there a way to connect my neck issues with my thoracic and lumbar issues? My claim for increase on my low back is approaching the 7-year mark as of April 2024!!! Please help!!!

    I just had my first exam for the neck. On the neck extension test using a goniometer, the NP wrote down 60/115. What does this mean? I can barely tilt my head back so it can’t mean 60degrees.

    I was diagnosed with DDD and arthritis in the neck by the VA recently after an MRI. I put in a claim for primary SC for the neck and was denied for lack of evidence. I'm already rated for bilateral knees so I put in another claim for the neck seconday to bilateral knees and was also denied because of lack of evidence. I went over my medical records and saw one complaint that I made for a stiff neck, hard to swallow, and feeling light headed. I was prescribed tylenol. Can I use that one complaint as evidence of having neck issues starting in the service and appeal the denial for neck?

    VA Provider doesn't necessarily mean nexus, especially if you are beyond a year out of service. It just means you have it now.

    I was in a car accident in service. While transporting soldiers to and from a military hospital in my pov. All my stuff was privately taken care of.. I submitted all the documentation with my original submission in 2014. They denied me service connection and I left it alone cause I dident know what I was doing then and dident know I could appeal etc. Now all these years later I'm wondering if I could refile.

Yes, I definitely would resubmit including evidence you are still recently being treated, evidence of being treated shortly after the car accident, any evidence of the car accident itself, and a bulletproof personal statement to tie everything together.     I’m always with mild lower back pain and if I do something wrong it turns into aggravated pain. I retired from the Army in 2013, and got diagnosed with Degenerative Disk Disease in 2016 by a private doctor. Now, it will take more than three years for DDD to show up in X rays but I don’t have anything back related in my medical records. Should I gather docs and make a claim?

    Did you check or mention in the paperwork for your exit physical anything related to back or joint pain? Have an MOS that required heavy lifting, load bearing or routinely engage in activity that could jack up your back, e.g. jumping out of perfectly good airplanes? If not, maybe get lay statements if anyone can corroborate any symptoms. Otherwise, check out "VA Madness." He might give you some ideas in his spine, neck or knee vids.

    Please, please, please, continue to visit the VA to document you are still having issues with your pain. If not, they will give you a 0% rating thinking your pain is not bad enough.

    No but that really helps because it is in your active duty medical record make sure you take the whole thing when you leave active duty

    @user-tq7ks2xu1c you have another year after you file a claim to upload evidence and such. VA is a nonadversarial system so you have as many chances as you need to get it right, just be thorough and honest, eventually you'll get there

    You can still claim anytime. At the age of 65, I went from 30% to 70%. But I'm not finished. Just be sure to have a good VA medical system, unlike NE Florida. I moved to central Texas, who has a far better VA system.

    Can't alot of musculoskeletal conditions be effectively treated by a chiropractor or PT? Interesting to me they don't require this before giving someone a rating or permanent and total. Any opinion on this?

    They check for all this stuff. If it's a problem that can be easily fixed they won't rate you. But if you have something permanent like arthritis if the cervical spine, there are no known cures for that condition at this point medically.

    I was diagnosed for this and mentioned it to my C&P examiner and was rated for both bilateral upper and lower extremities! Personal statement and the treating physician mentioned in med record what I had on my personal statement how and when it occurred in service.

    Hi Vets. I need help. I just received my 80% rating. It's a total rating. Spasms and Sciatica. I have at 10% for tinnitus, and I suffer from neck pain, headaches and this ringing in both ears is killing me. I I focus on it I will go insane.     I have a 20% rated low back condition that is being reviewed for an increase that I won't know the conclusion of until about December. I suspect they may rate it much higher since I am unable to walk without a walker, or quad cane now. I now have a nexus letter for secondaries, that includes my neck pain, and other conditions written up by my private physician. Do I need to file those secondary claims now - while the VA is still reviewing my primary claim?

    @@vaclaimsacademy Thanks! My doctor charged my insurance and made it part of a regular visit, as we discussed my physical problems for treatment purposes. Writing the letter was free. He humorously refused to fill out any DBQ's. I don't blame him. Those DBQ's would've take hours. I'll also check with the VSO on this and decide if I should wait for the decision. Thanks again!

    Doing a new claim at this point may delay your current claim as they may lump them together, so be aware of that. At minimum, do an intent to file to preserve your date of claim.

    @@shepatown I understand your already rated for your back correct? than why would you wait to file your secondaries when you already have your doctors diagnoses and a Nexus.. I had the same issue but I wasn't even rated yet for my back-Pedr my VSO We filed my Mntl hlth claim secondary with the lower back claim-I had diagnoses for both. I was approved for both

    Once you reach 100%, do these other claims, such as 70% more, get added to now be 170%?

    No, in fact if you are already at 100% it’s almost always a good idea to NOT file a new claim

    So I get out in 98 days. Terminal in 48 days. Working on getting my medical records from my PCM, therapist, etc. My question is, is it worth doing a BDD claim if I don’t have all my records and then just filing a separate claim later on afterwards, or should I just wait till I have everything together. I’m not certain that I’ll have all my paperwork together before the 90 day mark.

    @@muffinsparadise8228 I was kind of thinking the same thing. Allows my separation physical and other exams to be put into my service treatment record, as well as allow for personal statement letters and NEXUS letters to be drafted.

    Veterans will listen more to your videos if you would talk a whole lot more about that Veterans DO NOT need "Nexus" letter.

    They need a doctor to say they believe the neck injury was related to service. All claims require this.
