I have a 50% rating for my PTSD. I was prescribed a CPAP thru the Va over a year ago. Little did I know they monitor the usage of my machine even when it has never been connected to my wifi? Go figure? They have had detailed information from my machine for all of my follow up appointments. I use my machine religiously! I am now ready to begin the process of filing for sleep apnea. I will be uploading my Bluebutton file this week from MyHealthevet and consulting you for my NEXUS letter. Looking forward to working with you

Thanks, it has always been one of those things I'd like to do more of, but with my to do list so long it never gets prioritized. I finally hired a full time assistant so hopefully I'll have more time for writing and the odd video now and then

I filed a claim for Apnea 2nd to PTSD that has been in the 'evidence gathering, review, and decision' phase (for over a month). I submitted numerous articles from reliable sources indicating a true connection. Hopefully someday soon I will get a decision.

I will be contacting you next week for a diagnosis and nexis letter. I have depression related to sc hearing loss. I also am being treated for severe (VA diagnosis) sleep apnea which I believe is secondary to my depression. I can use your assistance.

Just had a CP exam. But the examiner never contacted me. Basically states Sleep Apnea is not secondary to PTSD. All they did was simply describe what OSA is. Says my medical records didnt establish the secondary. But I have a medical diagnosis of sleep apnea.

Is there any validity to sleep apnea aggravated by anxiety (sleep apnea secondary to anxiety)?

It is a broad statement in itself- there are factors that can potentially be associated with each (ex: weight gain, hyperarousal, etc.) that can lead to the aggravation. Dr.Finnerty writes awesome nexus letters, however I was denied with mine. My claim was for OSA secondary to PTSD and was denied. Dr. Finnerty sent me a rebuttal letter couple months later so I added that and a personal statement to the supplemental claim(which I forgot to add on the FDC initially) hopefully that and the rebuttal letter will reverse the VA decision (fingers crossed) Im getting tired of going back and forth with the VA. Seems like the VA hates that combination; OSA 2nd to PTSD.

@@martingarcia-ez5uz they said the medical opinion from the VA examiner was more persuasive than Dr. Finnerty's IMO based on a thorough review of my relevant military and or personal history & contained a more convincing rationale. VA examiner said my OSA is less likely than not due to or the result of my service connection condition of ptsd. Basically saying there was no connection to ptsd because OSA is a physiological condition vs. psychological. So ptsd is less than is likely is not the primary etiology of this condition. It also goes on about aging tissues blah blah blah... Im 43 btw. So that's what their decision was.

Did you do a HLR or a supplemental appeal? I have heard of you do a HLR there seems to be a high chance of approval because you can claim you evidence is sufficient for a claim and the opinion of the C and P examiner was not required. Plus I believe the weight of the Nexus is higher because of the field Dr. Finnerty is in. Usually you get a Nurse Practitioner or PA. Dunno 🤷🏻‍♂️ also it always depends on who’s desk it lands on.

I have Tinnitis and Sleep Apnea and need a nexus letter.

That is an understandable question but unfortunately I don't have that data. If I review your medical records and the science and agree that in your case there is a nexus-- yet you are still denied-- I will stand by my opinion. While there are no guarantees of success, if you send me any relevant new data (ex: a rating decision, new C&P exam, etc.) I will write a letter responding to that for free.

I definitely think you should tone down the sound on your videos or speak more softly. Although just barely, i can still hear you.

My va shrink says ptsd does not cause sleep apnea. She is the one that ordered my sleep study.
