It's like with the goncharov thing in Tumblr. It's part of the etiquette that you will say, at least in tags, that it's an ARG or it's storytelling. It doesn't take away from the immersion, but it also helps people who are easily scared, people who suffer from dissociation, and to not give space to hoaxers.

I think the poster should have at least disclosed or asked permission from the artist who made the doll. It's different from a mass-produced prop because that artist's hard work is being taken for granted and they probably see it as loss of potential customers to their small business. As for when to disclose ARGs, it's hard to say because part of the fun of it is suspending your disbelief that it could be real. The times I would say it's necessary are when real people's lives get mixed in, for example when the actress from Ash Vlogs was being harassed--that ARG especially seemed very close to reality and it's not a stretch to think that people would get confused. I'm sure most creators want to lean into that though, but they should probably make sure everyone involved is on board and maybe suggest that they take a break from social media for the duration of the game.

i vehemently disagree, the poster bought the doll, they own it, they do not need permission to use something they own. a seller does not retain any rights to a sold item, what is done with the item after it is sold is not remotely the business of the seller. i mean how is it going to affect their business? the store not being mentioned at all would neither negatively or positively impact the creator/store. honestly would you buy something if the seller told you "btw i get a say in how you use this item for the entire time you own it and you're not allowed to do anything with it without my permission"? no, no you wouldn't. tl;dr - you buy an item, you own that item, the seller/creator no longer has any rights to dictate what is done with it.

@@admirable_minimum2163 it's not about rights though, it's the integrity of misrepresenting the origin of the artist's creation. It's natural to be upset in that case and the artist has just as much "right" to set the record straight. If the poster wanted to avoid that scenario then they should've found an artist willing to cooperate accordingly.

@@admirable_minimum2163 you're not technically wrong, but what you typed out is just extremely immoral and shitty. If you commission a piece from a small business to use in something that is intended to reach a wide audience, you need to give credit to the artists whose work you're using to help elevate your video. You aren't legally obligated to, sure, no. But it's just the right thing to do. Take a seat. Calm down. Be a better human being.

The ARG discussion is one worth having. But, it's messy because that doesn't seem to be the point of contention. To me, it seems that the artist was genuinely concerned that their art was being used to deceive people into thinking there was a real haunting happening here. If the artist thought it was an ARG, they might have just let it go on without saying anything.

Oddly this makes me think of my own haunted doll. She's a "Living Dead Doll". A plastic collector's doll made to look like a haunted porcelain doll. She's not an old doll, and yet, you can definitely tell she's inhabited. I wish someone would do some research into what might cause spirits to inhabit newer vessels, because I get the feeling that's what happened with my doll. It very much feels like she had to switch vessels for some reason from being in something else before.

Imo, this particular case is cut and dry. The artist who made the doll has every right to take credit for their work, and the person who made the Charlotte account should have thought twice about using that particular doll for a story. Not only did the doll's appearance ruin any credibility the story had- again, IMO- but it was rude for the poster to use the doll without the artist's consent. The Charlotte account creator should have just gotten an actual antique doll if they wanted to tell a story, but something tells me they only made the account for fun, so at the end of the day there really was no harm done. Thanks for bringing up this topic of discussion, Loey, it was a lot of fun to think about!

  • @Sandrilyonaify

Unless the artist specifically states that their artwork should be credited in works of fiction etc, when they sell the doll, what it's used for is up to the person who bought it, imho. The only way it's inappropriate is if the poster claimed they made it themselves or something. Otherwise there is no reason to ask for artist's consent. The poster bought it and it's his to do whatever.

I think if you’re using artist’s work in an ARG like this person was, the creator should reach out to the artist to tell them what the piece is being used for and promise to credit the artist when the story concludes. But if it’s something that’s mass produced, it’s fair game. If that person had communicated with the artist, the ARG would probably still be going

Hmm, I wonder if there could be some universal element that could be easily included in any ARG that would tell ppl that's what it is. Like, what if there was a small logo or image ppl could put into graphics or the background of video that would confirm it. That might help save ppl time from chasing down non-args but it could be small enough to not break immersion. Could also prevent ppl from thinking that an ARG is real life and ppl are in danger.

To vaguely answer your question Loey, this isn't the first time nor will it be the last; I don't know if it's the correct term for it, but I've always called it the "War of the Worlds" dilemma. With modern technologies being what they are, the line between fiction and reality can become exceptionally blurred to the point of nearly being invisible. So perhaps when a story starts to cause wide spread panic, or endangers people and/or areas. In this case I don't think it was particularly harmful to the creator, but at the same time artists should absolutely get the recognition they deserve. So a catch 22 for the creator. Do they wait for the story to end and hope they get credit for a now very famous creation, or do they out the story as fraudulent in order to maintain their creative work? The only one that can answer that is the creator of the item being used in such a way. Granted this is nothing more than my own perspective on this and other such works, and is in now way definitive.

This situation I feel like does open an interesting question on ARG's. This person not only took someone else's creation and claimed it as a creepy antique, but also brought in a historical figure into their story that could not only be disproven very easily, but felt a bit disrespectful. Someone else's art being used in that manner should have gotten permission from the shop. To go on further, I think kidnapping and murder ARGs should be stated as ARGs. We're getting into a day and age where I am SCARED that someone is ACTUALLY going to harm someone on camera, people are gonna watch it and think it's another ARG and not report it. Not to mention the ARGs that weren't real that got reported because it was too realistic and people got rightfully concerned. Peoples safety are on the line with that and I think too many ARGs cross the line with how graphic or realistic their kidnapping or murder ARGs go. I don't think paranormal ones need to be outright stated as long as someone isn't using someone else's art or IRL people for their paranormal ARG, I just think they deserve the mystique.

As an artist, I 100% side with the doll's creator on this one. I'm just thinking about how upset and angry I'd be personally if someone had stolen my work for storytelling without my consent and used it to become famous on the internet instead of creating their own original work to do that with. If you can't do that on your own, you don't deserve an artistic or creative platform in the first place. That person should have spent all of their time building skills and talents of their own instead of simply stealing from someone else. That's completely wrong and unfair. The person who created the doll deserves all of that credit. I'm glad the person with the Charlotte account was called out for doing such a horrible thing, they deserved it and maybe now they'll think twice before trying to steal again. That's all I have to say about this one. Thanks for sharing Loey, this is a very important story to spread awareness about, especially to the artistic and creative community. 🙂

I'm an artist too and I have to disagree, at least somewhat. Whether or not the OP should have gotten permission from the doll maker is debateable but I personally don't see this as "stealing". Rather, I see it as transformative work and I feel it not fair to say that OP's work was not original... it's not unique by any means but they obviously put _some_ effort into the illusion of haunting and had to have had videography/editing skills too. Unless it was specified otherwise in my terms & conditions for purchasing a product from me, I'd be fine with another artist using my art in that way. However, since you feel differently and stated that you'd be upset and angry, I can acknowledge that not everyone would see that as okay.

Hey can you help me see your side of this? I struggle with the stolen concept. It was purchased? Then belonging to the new owner was transformed into a new idea. If someone buys something from my shop and utterly changes it, uses it in a way I didn’t intend… I just personally don’t see that as stealing. Now if they resold it and labeled it their creation. Then yea that’s concept theft, however they still had to buy it. An exchange of ownership occurred. That’s my thought however, so if you’re able or wanting to, please talk me through what you see. How you get to ownership remaining with the creator and theft.

@@littlestive I agree. It would've been courteous to let the artist know hey I'm going to use your doll in an arg or something and then maybe @ them. But it's like when KZreadrs take clips from other shows, movies etc and transform them into something else. They're not stealing from the original creator.

I have to disagree - they did buy the doll. Not everyone is a dollmaker! After that, I don't think I'm qualified to make any judgements, but I can't see this is stealing, since they paid for it.

The dolls creator sold the doll, so it was not stolen. it did not come with instructions and rules. They could do as they please with the doll. Including destroy it.

I think something as simple as tagging it as an ARG. Doesn't have to be a big announcement but just something small to disclose it as one.

Personally, I think people who make these videos, especially ones that seem very realistic, should let it be known it's fiction. They don't need to say it, but at least in the caption do so. Mainly because if it seems too real, that's when people get concerned and take real-world actions to see if someone is ok, which can have consequences. Movies and TV shows need to say it's fiction in the end credits, so I don't see how it would take people out of the experience on these types of stories too.

Imo this wasn't an ARG. An ARG requires audience participation and game elements. This was just someone trying to hoax a haunting. The story they made up about it once belonging to Princess Whoever was laughable - you only have to look at the doll to know it's been horror modified and wasn't picked up from an antique store like that. I can understand the seller being irritated that something they put time and effort into is being used as a hoax or as part of something viral that they're not getting any credit as part of. The creator could've easily said where they really bought the doll from and then claimed a haunting, so the seller could get some good engagement from people interested in the videos.
