    If Marshall had refused to retire, Clinton would have been able to pick his replacement given that he ended up passing away on January 24, 1993. But Marshall cared more about the Court not looking overtly political and having someone in the seat that was fully able health wise to perform the duties. RIP Justice Marshall.

    What an astute man. Pick the most qualified person, not someone based on their color. Focus on improving the lives of all, not just one color. How far we have strayed form these ideals now that gender and identity politics controls so much of our current decision making.

    Thurgood Marshall was in horrible shape at the time of his retirement. However, unlike RBG, who actually had the opportunity to ensure a successor with similar political views, he never stood a chance because the Republicans held the oval Office for 19 of his 24 years.

    Marshall did not want GHW Bush to pick his successor but his health was failing. Sadly, Marshall died less than a week after Bill Clinton was sworn in as POTUS.

    There is speculation that because at the time, following the Gulf War, Bush's approval ratings were so high that it was widely assumed that Bush would win reelection in 1992, Thurgood Marshall thought holding out longer was pointless.

    Well he didn't live long after his retirement... Now RBG not retiring before she died: that was a mistake... or more of a wake-up call that we should cap lifetime appointments on the bench
